      I hired Roof Top Designs to put a new roof on my garage. I signed the contract on 8/22/2023. I did not have a roof leak with the old roof. Three months after Roof Top Designs completed the work, the roof started to leak water into the garage. Roof ********** had removed the metal flashing from around a post protruding through the garage roof. But they failed to install new metal flashing around the post to prevent the rain water from leaking into my garage. Roof Top Designs created a water leak where there previously was none. Roof Top Designs refuses to properly repair the roof. I got a repair estimate from an independent roofing contractor. The cost to repair the roof leak is $500.00. Roof Top Designs refuses to properly repair the leak and they refuse to pay me the $500.00 cost to repair the roof leak. I paid $9,737 for a quality new roof, but that's not what I got. Please help me.

      First of all, we thank *************** for being a customer. We appreciate her going with our company and hope to resolve this issue for her as expediently as possible.
      *************** wishes to have her post flashed to prevent leaking. What needs to be understood here is that we installed a roof, around an unsafe live wire and post (See attached photo labeled Hech Home), though *************** was asked to turn the power off for safety reasons for our crew. Because of this, we were unable to seal or flash this post. We offered options at no additional cost which included a universal pipe collar, which would seal around the post and a sleeve to cover the rest of the post. However, the post has live power for the house attached, which is not to code. We need the power to be shut off and the lines removed to install the pipe collar and/or sleeve correctly. When this was presented to *************** as a solution, she denied the service.
      What is recommended is to remove this post completely and move the power lines to the ***** (see attached photo labeled as Proper Example). Should *************** do this, we will offer to close off the roof where the post used to be, sealing her roof at 100%.

      I am rejecting this response because: Rooftop Design's response to my complaint is a PACK OF LIES! Rooftop Design does NOT speak the truth. Attached is my reply to Rooftop Design's PACK OF LIES. I speak the truth and my attachment states the true FACTS. Rooftop Design is in breach of contract and should NOT be in the construction business!

      On 4/10/21 a roofing contract was signed for Rooftop Designs and the following summer (2021) work began. The workers first placed a generator on my lawn killing my grass. In addition, my original gutters were removed and then replaced with smaller less structurally sound gutters, and water is getting into the building because of the new gutters that were never requested. There are cracks in my siding from the way the gutters are attached to my home. I have been going back a forth with them, speaking with several ****** and finally ********************* (Regional Manager) came to my home to address the issue. I had to call ***** to follow up, and then I was directed to speak to the Owner. The owners suggestion, on Wednesday August 2nd, is that I split the cost of replacing the small gutters with the size that was originally on my home. This has gone on entirely too long.

      We have spoken to ************************* on several occasions, and we have responded the same way we are doing now.  We have no contract or record of installing gutters for her.  Our contract with her is for roof only.  I have attached a copy of the signed contract with this response.  We have asked for any paperwork that she may have that shows that she paid, and we installed gutters at her property.  Rooftop Designs is not liable for the repairs and or replacement of the gutters.

      I am rejecting this response because:
      my gutters were changed to smaller gutters.  The only thing Rooftop Designs  was supposed to do was detach and reset my gutters. They did not reset my existing gutters they completely changed them with smaller gutters and have damaged my siding doing so.  

      Attached is a photo of the old gutters and the insurance claim with what was requested.  They were not asked to replace my gutters, however, they did.

      We previously submitted a copy of the signed contract between Rooftop Design and *************************, which states that there was no gutter work to be done.  This document was also submitted by **************************  As for the insurance scope that was provided, that is what the insurance was covering for payment to homeowner but that was not what our contract was based upon.  This contract was signed and installed in 2021 and until this year this is the first we have heard about the gutters being an issue.  We did not contract to remove and replace and have no documentation that this occurred at ***************************** property by Rooftop Designs.

      Please re-open case # 20422924-590B5.  I am rejecting the response from Roof Top Designs.  

      After speaking with a gutter professional, I realize that my complaint and responses may use the incorrect terminology.  The downspouts, not the gutters themselves, are not the ones that we originally had on my home.  

      I have sent a photo of a piece of downspout that was removed from my home to work on the roof.  My home has flooded several times because of this.  I have witnessed water coming out of the downspout joints. I am looking into estimates to have my downspouts replaced with the correct size.  Roof Top Designs should be responsible for that cost.

      I sat in my living room with "*****", who stated that he was a Regional Manager for the company.  My granddaughter and I were both in the room when it was revealed that the entire office responsible for the roofing work that I received had been replaced due to excessive complaints and issues.  This speaks to the reason the work was not completed as requested.

      I signed a contract for a new roof with RoofTopDesigns. The first meeting was in November of 2021 and a deposit was given in the amount of $6000 on Feb. 3, 2022. The contract states they are responsible to obtain approval from my HOA, get the building permits, and we discussed that they would need to work with our **************************** to get our claim handled. It is April 6, 2023 and we have no new roof. As of last communication with our HOA, 3/28/23, no documents were submitted so only document management company had was the ***** forwarded to them that day, and nothing at the city permit office for our property. We want a full refund so we can move forward with another company because at this time we have lost confidence in their business and feel they breached the contract with none of the paperwork being completed to get approval for the roof replacement and now leaks occurring due to their not getting it replaced prior to failure.

      hello ******************* as you can see the contract is contingent on hoa approval which you are responsible for. We can help with the process by supplying samples or photos to present to them however many homeowners associations will only deal directly with the homeowner and as of today we have not received an approval or denial for your project which makes the contract still active furthermore you postponed the project due to family health issues and we offered to help you with it, but we received the wrong hoa information from you. We are here ready to install the job and we will even honor the price from the original contract date even with the price increases on material we have gotten since then.

      I am rejecting this response because: 
      The contract is contingent on the company getting the Association and City Approvals not the Homeowner. We would have never agreed to get either because we are not in the roofing industry and are not the experts. Industry norm is for construction companies to handle both. The company has failed to do any of the required paperwork to get the approvals. They have failed to meet with the insurance company as promised. 

      Proof that they were supposed to provide it is on the contract with the contingencies checked. Their employees were given the information to do so twice and I have one of the *** applications that I signed and returned to them on 11/8/22 but somehow they arent responsible. I would be happy to supply these to BBB but not to the company.  

      I also have requested my previous sales agent to write a letter stating what was agreed upon.  

      I have requested a statement from our homeowners insurance claims adjustor stating it is normally the roofing company not the homeowner meeting them to discuss the damage.  

      At this point they have not done any work, gotten any of the approvals per their communication, not met with the insurance adjustor, or provided any service while holding our deposit of $6000 since February 2022.  We want a full refund.

      Rooftop Design has every intention on completing the work that was contracted.  As you can see by the attachment, the arc application needs to be signed and submitted by the homeowner.  The hoa representative did inform us that it was submitted by the homeowner in March.  Once the board has approved the contracted project, once the hoa sends the approval we can apply for and provide a permit.  Once we have received both in writing, we can schedule the work to be installed.

      As for getting something in writing from the previous representative, there is nothing on the contract representing what you have stated.  That representative, as of six months ago, is now working for a direct competitor.

      I am rejecting this response because:


      The complaint should not have been closed. They have not refunded our money, They have not completed the ARC or gotten city approval as per the contract requirements. They have had our money for a year and a half without completing any work. I have a copy of the signed ARC copy that was given to their company in November 2022 after they finally completed that paperwork. I have a copy of a shingle report after I climbed a ladder to get a sample for our insurance company. I did work with them until I was told not only by the city of *******, ************* Ins., and another roofer that we should not have to be having to handle any of the requests by RoofTop Designs. I have stated this fact repeatedly that they are the reason that the roof is not on and has not been completed. They have a complete and signed copy but have not provided it to our HOA. They cant apply for the building permit from the city until they have the ARC. They have not met with our Insurance Adjustor which stated they need them to so that a settlement for the damage can occur.

      They are still in breach of the contract and I need the BBB to do their job and look through the companies empty words and circles. They should have their rating decreased and other consumers should be warned about their poor business practices and lack of professionalism.
