    On December of 23' I had an agreement with ****** of Hometown Hot Tubs LLC to purchase a used Hot tub for $3,500. We agreed that the hot tub would come with a brand new top, He would remove my old hot tub and a one year warranty. I still have not received the new top, my old hot tub is at my house and now the hot tub he sold me is not working. I have called, text and emailed him many times. I have even gone down to his shop over 10 time and no one is ever there. He never answers my calls, texts, or emails.

    Last summer ***** offered to take my hot tub back to his shop to repair it. The filter assembly was leaking and he claimed it was much easier to fix at his shop. He insisted he needed $1500 to order parts. I reluctantly paid it after talking to him many times about it. The next day he texts me and says I need to trade it in on a new one because mine was shot. I told him I did not want a new one I wanted mine fixed. After weeks of negotiations we settled on him returning $750 to be since he could not repair my hot tub. 6 months later I still am out a hot tub and $1500. I hired an attorney that has been in contact with him but no money yet. He refuses to return calls or texts to us.

    My husband and I have been working with Hometown Hot Tubs since building our second home . We purchased a hot tub from ***** in 2021 and he has since serviced it from time to time. We built another property and reached out to ***** to purchase a hot tub for the new ******* December 2023, ***** reached out to inform us of an end of year sale. We landed on a unit and a final quote. ***** sent us an invoice for the full amount and we put half down as a deposit. In January, we received word that the unit was ready to ship and that ***** needed our final payment. We wrote a check for the remaining balance, expecting the hot tub to be delivered and installed shortly thereafter. After a couple of weeks, I reached back out to confirm the delivery date. I was informed that he had made an error and the final payment was not for our hot tub but for someone elses. I asked him to reach out to the manufacturer to accelerate our unit and reinforced that this was a major error.I continued to follow up with ***** weekly, both by phone and text this was very out of character for ***** so I texted the number asking if it was still Cesars. ***** finally returned my text confirming that it was. We continued to go back and forth Id ask for a date and he would reach out to the manufacturer. At that point, I let him know that I was going to call them myself, and he informed me that he is filing for bankruptcy. I sought guidance and was advised that we needed the bankruptcy filing number as this is legally required as part of bankruptcy proceedings. I contacted ***** to retrieve that filing number. He continues to reach out to his attorney, leaving me with the sense that he is 1) not filing for bankruptcy at all or 2) does not intend to share that information.I have text messages that document ***** openly admitting to all of the above. I'd prefer to settle amicably versus pursuing a lawsuit.
