Background and Clarification:
The complainant received a text message regarding a 1993 court case for an individual named ******, referencing a fine owed to ********** County, **. The complainant asserts no connection to this case and expresses concern about data use, digital security, and potential misidentification.
Our Position and Findings:
The phone number contacted was provided by **********, a leading data vendor, via standard, yet best in class, skiptracing practices. We believe the possible link traces to ***************, which may have created a crossover in contact records.
This process was necessary as the citing agency or the court does not collect phone numbers or SSNs at the time of citation. As a contracted agent of the ********** County Circuit Clerk, we are tasked with locating and notifying defendants under the authority of Illinois statute 730 ILCS 5/5-9-3.
The message sent was compliant with all FDCPA and FCC requirements, clearly identified PayCourt/CCP as a collector, included opt-out instructions, and linked to a secure payment portal. It used the court seal per our authorized role.
Data & Device Concerns
The message does not install software or collect data from devices. Our links lead to secure HTTPS pages hosted within the **** secured AWS Cloud.
No personal information was compromised, and the recipient could not access case data without authentication.
The complainant's number has not been sold or shared and has now been permanently opted out of all contact.
Steps Taken
Weve opted the number out of all systems and contacted ********** to investigate the match error.

Response to Requested Relief
While we regret the inconvenience, there was no unauthorized data breach or unlawful conduct. The complainant is not liable for the debt, and no further contact will occur. We do not believe compensation is warranted but are happy to confirm the permanent opt-out and explain our legal framework and privacy practices in more detail.

PayCourt contacted me saying I owe ******** County circuit court close to $2000 for fees related to a case that was dismissed back in 2009! She advised there is no statute of limitations for county or state. Thats almost over a decade. Really? I am on **** and really cant afford to pay more than $20 monthly but if this is legit, why wasnt I contacted while bedrock was still in occupationBusiness Response

As you can see there were 2 counts to this case. 1 was indeed dismissed (per your recollection), but the other charge/count was not dismissed, and it has remained outstanding all these years. Looks like ******** County assigned this case to us last year and we were finally able to connect with you just recently. Hi ******. Several things to unpack here so please bear with us. First, the do not call registry is primarily for solicitation type communications. We are not soliciting anything. The state's attorney of Macoupin County Illinois hired us to reach you to you regarding your outstanding court fines. These are owed to Macoupin County (not PayCourt directly). Second, there is no statute of limitations on criminal adjudicated judgments in ********. Your attorney should've known that. We would welcome a conversation with him/her to straighten this out. Lastly, and contrary to your complaint you've spoke with several of our agents over the years MANY TIMES and yesterday was the first time we were instructed to not call you anymore. Because we absolutely respect your privacy, we removed your number. Unfortunately your cell phone was also connected to another account. We removed that one today. Also, you stated that you texted us back to a number that called you, those lines are not monitored for text messages and was never received (just an fyi). So in closing, we appreciate you reaching out but I'm afraid you're going down a possibly incorrect path due to bad/inaccurate/incomplete legal advice from your lawyer. Hi ******. Apologies in our directness but we must correct your most recent response. 1) The ** you received on Nov 1 was from an agent (******) (not from our VP, *****). If you'd like to discuss this with our VP, the door is always open. 2) The first time we actually spoke with you or received your desire for us not to call you was on 11/18 (which we respected). 3) We're not looking to harass, in this particular case, we're looking to help you understand that these two Macoupin County fines are in fact owed and outstanding. Unfortunately, we've been unsuccessful in that objective. Having our VP speak with your attorney directly might be an excellent next step. If you feel that is not an option, maybe the best course of action would be for us to close this case out from our system with notes for the Macoupin County State's Attorney office, after all, per IL statute, their office is ultimately response for the collection of outstanding fines/fees. In closing, we're truly hoping not to escalate this matter further ******, but Macoupin County hired us to facilitate consumer-friendly engagement with folks that owe outstanding fines/fees. My county, Macon County, in ******** had tried getting a court document handling fee from anyone that had a child support order against them. In ********, child support for working people, is taken out of the paycheck and sent directly to ILSDU, so no need to pay at the circuit clerks office. My husband and I are recieving phone calls regulary about him owing this fee, along with every other male in macon county, I have tried to explain to Paycourt that he paid child support through ILSDU and never at the clerks office, they didnt care. I also informed them that the childern that they are talking about are 31 and 28 years old. I do not understand why we have to pay this when he does not owe child support and never paid at the clerks office, ever.Business Response

Our role is to collect the fee on their behalf, and we do not have the authority to modify or waive it. This collection company has cold called me on a weekend (their offices aren't even open) and I have no debts. It looks like they primarily deal with traffic tickets and I don't even own a car, and when I signed into their website it said ineligible.Business Response

We had a group of agents work Saturday morning (which is in fact outside of our standard working hours - good catch). And you are correct, in that we work primarily with court fine accounts (i.e. speeding tickets, etc). So it turns out we had your number down as a good "can be reached" phone number for another party. We were not trying to reach you. We've removed this phone number from that account and you won't be hearing from us again. Apologies for the confusion, but thank you again for reaching out to clear it up. I just received an email from this business. I have an outstanding fine that tells me how much I owe. I owe half of what they say I owe. I'm on SSI and pay my bills with nothing left over for myself. All these third party businesses are shady. So, PayCourt, just leave me alone.Business Response

Years ago as a kid and young adult I broke the law and I never paid my fines. Years later paycourt finds me and I start paying my debt. No big deal. So anyway I'm in the process of buying a house and Paycourt can't seem to provide me with terms and agreements to prove what the "mandatory minimum monthly payment" should be. I've called and used the "chat" option on the website. Just to be sent another summary of what needs to be paid. Not the requested information of the mandatory minimum monthly payment. I'm sure I'm not the only person who has a bad past that is paying paycourt and is buying a house. My FHA loan depends on this info. This is information that you would think should be readily accessible from the website. But it is not. Outside of this specific issue everything about paycourt is simple and straight forward. And the telephone operators are always super polite. It probably the most polite I've ever been reminded of court cost and fines. Thank you!Business Response

After being asked MULTIPLE times over the years to cease and desist all calls and harassment (not just to me, but to my family members, even distant family), they are still calling. They have been told that they will not be receiving anything and if they continue to call they will be promptly hung up on and blocked. At this time Ive had to block 4 different numbers from my personal phone and my family has had to block several on theirs. They even attempted to call my late grandmother my dad still has her phone so we can listen to her voicemail sometimes. There are certain lines you dont cross, thats a pretty big one. We have all asked them politely (and, eventually, definitely not politely at all) to stop harassing us and trying to contact us. Ive had enough, it needs to stop. Theyre not getting a thing from me, and harassing my family is not going to change that.Business Response

Paycourt contacts my phone 3+ times a day, every day attempting to reach *********************** in regards to ****** County fees. We do not know ***********************, he is not at my number, nor will he ever be at my number. I would like the company to update their records and remove my number from their information and stop calling my phone.
