I called several lawyers offices about potentially getting assistance for a ******** application. Some came by the nursing home I reside in some were only telephone calls. It was decided that my nursing facility would apply for ******** on my behalf and if I ran into issues then I would try additional help. I have only received and invoice from 1 office and that is , Beers and Mallers. They were one of the attorneys I contacted by phone. All I did was make a phone call and inquire about a possible service nothing further. They did not state I would be charged any thing for reaching out to their office and all of a sudden I receive a bill for 300 dollars. I had our *************** reach out to ask what were they attempting to charge me for. They said they would investigate and I have not heard back from them but received another invoice I do not understand what they are wanting a payment for.

      Business Response

      Date: 05/26/2023

I am the managing partner of the law firm, and on behalf of Beers Mallers, LLP, I appreciate the opportunity to respond to this complaint filed with the Better Business Bureau. On October 5, 2022, an elder law attorney at Beers Mallers, LLP engaged in a teleconference with ***********************************. According to billing records, that teleconference lasted over one (1) hour. The records also reflect that the focus of the phone call was ******** and the filing of an application on behalf of ****************************. Subsequent to the phone call, the elder law attorney opened a file for **************************** in accordance with normal file opening procedures at Beers Mallers. The matter was categorized and titled "********".

Billing records reflect that the elder law attorney and his paralegal spent an additional 0.6 hours on the ******** file in October 2022. The total time spent on the file was Four Hundred Ninety-Five and 00/100 Dollars ($495.00). The elder attorney provided a courtesy reduction to **************************** and billed Three Hundred and 00/100 Dollars ($300.00).

The records indicate that the elder law attorney followed normal procedure for the opening of a new client matter and accounting for his time and that of our staff. The attorneys at Beers Mallers, LLP have discretion to provide courtesy reductions, and this attorney believed it to be appropriate for ****************************. With that said, Beers Mallers, LLP has written off the balance of Three Hundred and 00/100 Dollars ($300.00) and **************************** owes no monies to the law firm. I have instructed our accounting department to send no further invoices to *****************************

I trust that these actions today will resolve the dispute and, again, I appreciate the opportunity to respond.

      Sincerely,

      **********************, Managing Partner

      Beers Mallers, LLP

      *******************************************************

      ***************, ******* 46802
