I am wanting to demolish my deck and replace it with a patio. Same dimensions. I submitted an architectural application for approval from HOA. I was told I needed a plot plan in order to get approval. I emailed ********* and verbally spoke to ******* because I was having trouble locating it with the city. I was told by ******* to contact the assessor's office. I physically went to the assessor's office and was told they don't handle plot plans. I called bns and was.told.all they could find with my address was the deed. I finally got the plot plan and ********* says that works but I needed an updated plan that includes the deck which was already here when I bought the house. I feel they are very unprofessional and are doing little to assist me with my home improvement plans. They obviously don't know what they are doing and how to get a plot plan. I've asked how do I get an updated one and have yet to get a straight forward answer. I would.like my project plan approved. This is a control tactic.

Omni Management Services is the management company for the homeowners association in which this individual owns a home. The rules of this homeowners association require members to submit architectural change requests to make exterior modifications to their properties. These requests are reviewed by the association's board, which makes a determination to approve or deny the requests. Such architectural change requests must include a plot plan, specifications of the project being undertaken, and other information the board may require to determine whether a proposed modification falls within the rules of the association. Omni does not have control over the association's rules or architectural change approval process, but we have attempted to guide this individual through the submission process.

This HOA management company continues to harass **. They have given us multiple false violations. Then (according to them) it becomes our job to prove that they are false. The most recent stated that we had trash/items stored openly. Ive looked all around our house and found nothing. I called to ask for specifics and they refused to call back and said in an email that I have to send them pictures but wont tell me of what. The prior complaint said we had our trash can out and construction debris in our driveway. We did have our trash can out. It was the day before trash pick up and my husband was actively cleaning the garage. Thats the perfect time to clean, the day before trash pickup. A different notice said our mailbox was out of compliance. Our mailbox is the exact color of the trim paint and has been since we moved in almost 20 years ago. My husband has painted it periodically to keep it from fading or looking bad. Again, **** never replied or made us send them pictures to prove ourselves innocent. When I asked them for proof or evidence that we were in violation, they told us they didnt have to. We keep a nice house and nice yard. I try very hard. This is extremely distressing. Very rude. Very unprofessional.

Part of the benefit of living in a ********************** is the fair and consistent application of the association's covenants. In the *** in which this customer lives, some of the items described in this complaint are a violation of the covenants. **** performs regular inspections of the community, and notes any violations present at the time of that inspection. These violations may be temporary and may even have been corrected before the owner receives notice from us in the mail.

This owner has received four letters for violations since the start of 2020. No fines were assessed, and no other enforcement action has been taken. At this time, all of these violations have been marked as closed/resolved.

Our staff has spoken with this customer, and we believe they are satisfied with the results of that conversation. We consider the matter resolved.

The company did reach out to me. They were unable to tell me what my violation was. It was admitted that they used a random covenant to attach to my violation but had no notes to give me the proper information to correct said violation. They simply said my violation was closed. It is a lie that my initial write up to the BBB involves actual violations. My mailbox was not a violation. They cant even tell me what the current violation is/was. The prior violation was also not a violation. I am allowed to pull my trash can around to throw away trash. I just cannot store it in front of my house, or in view. It was not being stored. It was being used for active cleaning - not a violation.

The phone call I received was respectful but was forced by a complaint.

The HOA management company is itself in violation of several covenants that it has yet to correct within the neighborhood.

I live in ******************* and unfortunately our HOA has hired Omni management services. We have nothing but problems with them for years. Im over it. I have requested our legal counsel to give me a call regarding the continued harassment from Omni management services to the homeowners. Yet again, I received three violation letters on August 3, dated August 1, with an inspection of July 31. I emailed and called ****** who is our property manager but apparently Im being told by ****** that she does not deal with clients that her assistant ********* does so I emailed and left her a voicemail as well. In the meantime, ****** doesnt know how to deal with upset client so she just hung up on me. I received a call from her manager and she could not help me either. Today August 4 I received a phone call from ********* who proceeded to tell me that the violations go to our ***** of ********* for approval, which contradicts what the ***** of ********* have told us. she refused to tell me who approved these violations and told me that I have to contact them by phone every single time I get a violation and tell them what Im doing to my property or not to my property. When I started to tell her that I dont need to call her for every violation, that they need to be more specific on these stupid violations, and she hung up the phone. I called back and have a course. Nobody answered the call and it went to ******* voicemail where I left my phone number and requested that my voicemail be sent to the owner of Omni as I require a phone call back. Furthermore, in our neighborhood chat our ***** of ********* have stated theyre having nothing but problems with **** and their lack of response. Therefore they have requested a meeting with ******* manager on August 8. The homeowners are adamant about terminating Omni management services in hiring a new management service due to the non-response and harassment of homeowners.

Omni Management Services is the management company for the *** in which this individual owns a home. The ***'s board of directors, made up of elected members of the ***, makes all significant decisions regarding *** policy, contracts, etc. One of ****'s roles is to assist the board with enforcement of the ***'s covenants. This is accomplished by performing regular drive-through inspections of the community, with the purpose of identifying violations of the ***'s rules and issuing notices to the owners in violation.

The owner in question received notice of various minor violations following our inspection of the community. This is sometimes part of living in a homeowners association. This owner has been properly notified of these violations and has been advised that correcting them will ensure she does not receive additional letters.

It can be frustrating to receive these notices, but we attempt to reach positive outcomes with all customers. The owner in questions contacted our office, and was verbally abusive to various members of our staff, their supervisor, and a member of upper management. We made our best efforts to reach a conclusion that would leave this customer happy.

[Provide details of why you are not satisfied with this resolution.]

this response is an absolute lie. I have asked for specific details regarding the violations, as the violations are vague. I was told by ***** that I need to figure it out and upon their next drive-by inspection if I dont get a new notice that I fix the situation. Thats unacceptable example if you say, I have bushes that need to be trimmed, I have one ****, and it is trimmed professionally. So I want an explanation in writing specifically to what **** theyre talking about. I reserve the right to ask for specifics. At this point it is harassment if they continue to send me these violations, and refused to answer my questions about the specifics, this is considered retaliation. And I will pursue legal counsel regarding that. I was also told that I can no longer call that they will continue to terminate my phone calls. The reason the calls escalated were because of their staff not being willing to answer my specific questions. The dues I pay annually go towards their fee. So therefore, I am a paying customer and reserve the right to ask specific questions. I have requested a list of our current board members and our legal counsel and of course **** has yet to respond to that request that I sent via email.  **** continues to provide horrible service to the homeowners in my community. They have an emergency meeting with our Board tomorrow because they dont even communicate to them. You are welcome to read our neighborhood. Chat where everyone is complaining. I refuse to continue to pay for a management company that does nothing but harass me. I have lived in my home for 28 years and I dont have to answer to anybody about my property. I adhere to the covenants and if you send me a violation and I want an explanation to it. I deserve it. I have also asked for a copy of the contract that ******************* has with all me and they have yet to provide that to me as well. I will not be going away. I am fed up years of this over and over. Im over it!

Me and my wife are constantly being harassed by this company with threatening letters about our trash can and other false violations , we have made 4to5 attempts to contact the property manager and no return calls or email. They give us 10 days to discuss and resolve but have no communication. Which puts us in a very bad position and we are very stressed out about this on a daily basis. The harassment comes from us questioning the property manager about unresolved issues in the neighborhood ,at this point I am convinced she is targeting our home , we received letters of false violations and we have cameras throughout our home that prove all these violations are false and the manager refuses to communicate about the issues. We have communicated via phone and email and no communication. we pay for a service and have nothing in return, this is not the first time from this company nor am i the only one with these complaints of constant harassment.

Omni management services manages the homeowners association in which this individual resides. In our role, we are responsive to the HOAs board of directors. Part of our role is to notify members of violations of the HOAs governing documents. This is done following a routine drive through of the property and/or when we are provided evidence of a violation by another member. Neither Omni, nor the **** is targeting this individual.

This customer is fully aware of our role and of these procedures, as he was a member of his HOAs board until recently. He was removed from the role by his HOA because he is not a deeded owner of the property and has not paid his HOA assessments.

The complaint requests we contact this individual to discuss his concerns. We have done this.

Unfortunately no proof has been submitted by Omni ,and  i have all video proof for the day in question with violations, showing that they are false and offered the management company to see them,Only  1 call was made by them to discuss this complaint and a follow up call that was never made. Unpaid dues and not being on a deed , and no longer being on a board has nothing to do with this conversation and complaint.

This issues started when omni was questioned about how they are managing the neighborhood we live in and then the violations started coming in.

This is a very unethical property management group. They did not send me an HOA bill for an entire year, so I did not know where to forward payment or even who to contact about making my payments. I reached out to my realtor, mortgage lender, and even asked my neighbors, but none of them knew the answer. My neighbors were renters so they did not pay HOA fees. Obviously without a bill or any information, I could not pay the bill. **** sent me an introduction letter about a year after I purchased my home and it included a bill for $1500. I reached out to explain my situation and the two ladies understood my frustration and agreed to let me pay it off over time without any late fees charged. Those two ladies left and now I have to deal with a new person by the name of ***************************. She is a headache to deal with and unresponsive to emails/phone calls. They ignored my original payment plan and charged me fees despite knowing about my previous payment plan. I spoke to another woman who works in accounting, but she was just as committed as ******* in charging me fees. Her name is *****************************, and she charged me fees even though I was paying on my account as agreed. They are involved in shady business practices to force residents into paying fees. They do not send information/bills on time. They are unresponsive when you reach out to them. And they have some of the worst customer service Ive ever experienced. A truly terrible company. Others have had very similar issues according to ****** reviews. At the very least, I would like them to remove any fees they have charged my account. I feel powerless as they keep charging fees for something that was ultimately their fault.

Omni acts as the property management company for the *** in which this customer owns a home. In this role, **** acts on direction of the ***s board of directors. Omni maintains accounts, produces financial statements, and obtains bids for services for the ***. The board of directors makes all decisions regarding the associations budget, spending, and assessments. All money collected on behalf of the *** belongs to the association, not Omni, and is held in a bank account belonging to the ***.Omni is paid a flat fee for our services.

This customer is sent a bill from his *** once per quarter. He has also received several late notices. The *** agreed in April 2021 to defer collection action and late charges while he caught up on his past due balance. As a result, he received no late fees or collection action for two years, though he has remained far behind on his *** assessments.

This customer has received an unusual amount of leniency from his ***, but he has made no serious effort to pay his past-due balance. He currently owes more than his balance at the end of the first quarter 2021, which the *** agreed to defer collections on.If this balance remains unpaid, the owner should expect to receive late charges from his ***, and for action by the ***s collection attorney to follow.

I moved into my home in 2020 and Omni failed to send me a bill for an entire year. There were no instructions about where to send payment or even how to contact my HOA property manager. **** sent me an introduction letter and a bill after about 13 months of me moving into my home. In that letter, **** demanded I pay the entire bill of about $1500 for the companys negligence in sending pertinent information. I called the company and spoke with two employees of **** and they agreed to not charge any fees, and also to put me on a payment plan since **** was at fault for this issue. The payment plan was not set up for me to pay the balance off quickly, as it was just $20 more than the quarterly bill. Again, **** is at fault for its failure to send a bill when I originally moved into my home, and also for setting up a payment plan that would take time to be paid off. Omni is at fault for this situation yet they are making me pay fees for their mistakes. I have agreed to a new payment plan that I intend to comply with as long as all fees are removed from my account as that is what was originally promised.

This company charges unwarranted fees to residents in order to turn a profit. I have always paid my bill according to my payment plans; however this company still charged me a $65 late charge. It was separated into two lates fees at once, the first fee was labeled LATE FEE and the second fee was labeled LATE ADMIN FEE. When I asked them to reverse the fees, I got a snarky email from a girl named *****************************, in which she denied my request for a fee reversal. Ongoing last couple of years. They are a property management company that is not taking care of the property yet we as homeowners are continually being charged with ridiculous charges. This last winter they charged us $17,000 for snow removal and we didn't have any snow they never came around with salt or anything. And I this is a letter I have from them stating where all the money is going it's in black and white I don't know how to attach it to this. They refuse to stop making the children that are stuffing grass sticks and trash down into the main sewer line which ends up plugging everything up costing homeowners more money. The ******************* I don't know where they found them but I think my dogs could do a better job they're not taking care of the property all of these complaints and there's many more are things that this homeowner association should be addressing and they're not doing anything about it

Omni Management Services acts as the management company for the *** in which this customer owns property. In this role, **** acts on direction of the ***s board of directors, which is made up of property owners in the association. Omni maintains accounts, produces financial statements, and obtains bids for services for the ***. The board of directors makes all decisions regarding the associations budget, contactors, spending, and assessments. All money collected on behalf of the *** belongs to the association, not Omni, and is held in a bank account belonging to the ***.

The ***s board has to weigh a variety of factors when making decisions about the ***s services. While they always try to get the best service at the best price, not all members of the *** will always be happy.

*** is managed by OMNI. *********************** property manager is providing false information to Board members as well as regular members. They are not enforcing the covenants, they do not provide proper annual assessments that are accurate by any means. In fact ****** has the *** board doing illegal collections of *************** because they are not following the law or the CC&R'S OR bi-laws of the association. They were hired to do a job. Why should we pay them when they are not only not doing job but making things worse financially for the entire *** I would like OMNI to ************* with the laws and our CC&R'S.

      Customer Answer

      Date: 09/28/2022

**************** is lying. We meet yesterday and he asked me if I would consider withdrawal of my complaint. I replied that I would consider it as long as Omni Management were to correct the discrepancies that I have pointed out to them and they provide legitimate, correct answers as to how these illegal activities came about and they have corrected all known known discrepancies in accordance with our CC&R'S, bi-laws as well as Indiana code.
I had an appointment at OMNI yesterday and today to view the *** documents Yesterday, I drove 250 miles only to get there and find out that all requested documents were not available and that They would not honor or keep my appointment for today even though our Bi-laws state they have 5 days to make the documents available. I Made a request back in February of 2021 as well and those documents also have not been provided.
So it appears to me that *** ******** issue is that he employs a person who is incompetent as well as unprofessional. That falls on him. OUR *** pays him for services which he to date has failed to provide as contracted. Thus constituting breach of contract.
I would recommend employing someone who who is competent if he does not like the fact that ****** is not or provide her with training so that she can provide the contracted service.  No questions about the matter ****** has and still continues to this day to provide 100% incorrect guidance and advise to Heritage *** which absolutely dooesnot align with her fiduciary duty to the *** as it is in direct violation of all governing documents. I fail to understand how me simply asking for compliance with the CC&R'S, BI-laws and Indiana Code would be an issue.  I will provide 1 example of such discrepancy below.
      On 2-23-2021

      "******,

Would you mind explaining why the $148,664.24 surplus from the last 3 years
(2018- $30,874, 2019- $47,631.46, 2020- $70,185.78) has not been rolled over to the following year as a credit twords our dues as per our covenants seeing as how the reserve goal of $70K was meet sometime in 2016?
According to my calculations in accordance with our CC&R's after properly applying the surplus from the last 3 budget years and considering the current years budget normal homes dues for 2021 come to a total of $173 and $185 for the "alley homes".

      Respectfully,
      ***********************"

      Mackie replies as follows.

      "****,

Your email was again forwarded to the ***** of *************************** communities financial decisions are made by the ***** of **************** Every homeowner has the option to attend the Annual or Quarterly ***** Meetings.  You can discuss your concerns with the ***** at that time.  There are no Covenants that state any budget surpluses are rolled into the new year. If you reviewed the December financials that were provided and available on the website or Caliber Portal.  In 2020 the *** was over budget $11,000.  The over budget amount is highlighted on page 3 for your convenience.

      Have a nice day,"

For the record I would like to point out
1-There have been no notice provided for such Quarterly meetings.

      2. Financial decisions especially any expenditures not specifically listed in the APPROVED budget, must be approved by a vote of the majority of the associations members.

3-Our covenants absolutely do address the allocation of ALL funds that are in excess of the years actual expenditures. There is no option to spend the money as ****** falsely claims.

4- 2020 budget status that was presented at the annual meeting clearly shows surplus of $70,165.75 as of the date of meeting. There were less than 10K in expected budget expenditures and an additional Income of $7,000.
Thus ****** flat out lied saying 2020 had a deficit for $11,000.  Income was $293,805.60
expenditures were **********. Which leaves $26,538.34 surplus, that should have been applied to the following years ***************.

5- for the 2020 Budget year $12,000 was included in the budget but NONE of the budgeted $12,000 was ever placed in the account as budgeted. Even though there was a surplus which today can not be accounted for, thus this constitutes Fraud by deception and clearly amounts to mismanagement of funds entrusted to the ***** members as well as OMNI Property Management.

6- these exact same errors have occurred for 2019, 2020, 2021 and Omni is not providing the documents that are required to be made available within 5 days as per our BI-LAWS article 5 section.

Thus I hereby inform **************** that I have a claim under 32-25.5-5-10. In the event these errors are not corrected immediatly the *** members shall have no option but to seek an emergency injunction which compels Omni Property Management and the ***** members to fully comply with the CC&R'S, BI-laws and Indiana Code, Management contract as well as compensation for damages incurred by the members of the association.

I also expect all *** documents to be available on Tuesday October 4th at 10am. In the event they are not You shall be liable for my Expenses and time for traveling to your office when you are willfully withholding documents that I have every right to inspect and intend to inspect to get to the bottom of these discrepancies.

      Business Response

      Omni Managements Response:

Omni Management Services is the management company for the *** in which this customer owns a home. In this role, **** is responsive the ***s board of directors. The ***s board is made up of individuals who own properties within the association, and makes all significant decisions regarding assessments, budgeting, covenant enforcement, and contracts of the ***. For the duration of the time we have worked with this ***, its board of directors has operated normally and with integrity.

This customer has a made a wide range of false and defamatory claims about Omni, out employees, and his ***. When we have explained why these are false, he ignores the explanation and moves on to something else. He has requested access to most of the ***s records, which we have granted him. We have scheduled multiple meetings for him to view these records. He has consistently shown up late to these meetings, sometimes by several hours. We have attempted to explain his ***s financial statements and governing documents to him. We have explained the distinction between his *** and Omni, a management company. We have gone above and beyond what is required to try to help this individual understand the above. We have done this at no charge to him or his ***.

Despite our best efforts, this customer has failed to understand our role as a management company and the basic functions of his ***. He has been rude and demanding with our employees. He surreptitiously obtained personal contact information of senior staff, and made attempts to contact them outside normal channels of communication. We receive frequent, often repetitive emails form him. His behavior is abnormal and sometimes aggressive. Multiple employees have expressed concern to management about having to interact with him face to face. We have told this customer he is not permitted in our office without an appointment, and we have issued a cease and desist demand for defamatory statements he has made publicly.

In the interest of addressing this customers complaints to the BBB.

      1. This customer previously informed Omni that he was willing to withdraw this complaint, but has since decided otherwise.
      2. We have provided all records this individual has requested. We have done this in a timely manner and at no charge.
      3. The customer lives 31 miles from our office, 62 miles round trip, not the 250 miles he claims.
      4. The board of directors for this customers *** seeks advice on how to interpret their governing documents and applicable laws from outside legal counsel, not from Omni.
      5. Omni is responsive to the ***s board of directors, not the other way around.

      Customer Answer

      Date: 10/25/2022

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

I will preface this response with the following comment. This response is 100% rejected for the following reasons.

1- ****'s reponse fails address any of the issues or discrepancies that OMNI  Management Services is responsible for taking care of, which happens to be exactly what our *** pays them to perform. This also constitutes breech of contract as well as dereliction of duty.

2- Every public statement I have made about Omni and their actions has been 100% factual. The fact that ******** actions reflect poorly upon Omni is beyond my control and the sole responsibility of Omni Management Services.

I am ready and willing to back every comment I have made with the supporting documentation, in a court of law where I am confident summary judgement, in the favor of the **** would be the outcome of such proceedings plus court costs & atone fees associated with the claim would be awarded. Your lies would serve one purpose which would be to confirm what I have already stated.

3- Omni has assigned a property Manager who 1- is clearly incompetent, lacks basic knowledge of her duties 2- lacks integrity on a profound level. 3- Makes up lies when responding to *** member inquries. This is indisputable as per the written email records clearly display lack of competency, basic knowledge as well as integrity. Further her actions thus far are contrary to not only the governing documents but State and federal laws as well thus Omni is responsible for its employees actions.

4- I do not need anyone to explain "the distinction between his *** and Omni, a management company" as I am fully aware of the distinction, as well as the governing documents which Omni is ignoring as well as the Contract between the two parties. The *** pays Omni for serices that are not being properly provided as per the contract. The *** has met all of its requirements of payments since February 1st of 2019. To date Omni has yet to properly comply with several of the agreements contained in the contract. **** is responsible for several accounting errors in financial statements, some of which have been brought to their attention and they have been repeatedly asked to correct, their only response thus far have been to lie in their responses just as *************** is doing in his most recent response.

5- Our *** has absolutely paid Omni for the serices that **************** claim were provided at no charge to me or the ***. Thus yet another lie from *****************

In the interest of addressing the discrepancies mentioned in my complaint, I hereby certify the following to be factual comments.

1- I have never at any point in time agreed to withdrawl my complaint. Nor have I even remotely indicated that I no longer had such complaint. I did tell *************** that I would add some details to the complaint, which I have already done and **** has continually failed to address.

Try honestly answering the following question ****************, if you answer reflects badly upon Omni perhaps you should simply do things correctly vice ******** screwed up way of doing things.

Why would I withdrawl my complaint, when the legitimate complaint has not been addressed by any means? Care to explain that or is this also beyond your competency level as well?

2- *************** had their attorney issue a fraudulent Cease and desist demand in response to this VERY Complaint which absolutely is legitimate and backed up with the actual communications between myself and Omni Management Services. The information provided to the attorney who wrote he letter was absolutely FALSE and lacks any merit what-so-ever and I have replied to said demand letter with my own demands which have yet to be meet, (simply comply wih Governing Documents and  binding Manaement contract) even though **** has been paid in full for said services. Yet again breech of contract on behalf of OMNI and its employees.

3- Omni continues to employ and assign property manager, *********************, who is incompetent and misinformed about BASIC functions of her duties to Omni as well as the ***. This constitutes gross negligence on behalf of **** and makes them liable for any and all of her actions especially seeing as how I have brought these discrepancies to their attention back in February of 2021.

4- On the morning of the original appointment on Sept 27. I absolutely did drive 250 Miles to get to the appointment, only to get there and find that all of the requested document were not available. *************** at that point canceled the appointment for the following day because he said he would not be available, we rescheduled to Oct 4th, I was 15 minutes late due to stopping ad buying donuts for his employees (this must be why they have so much fear of me or prhaps ****** telling the secretary to call the police when I arrived at the office after her ending me multiple emails instructing me to pick up rqueted douments at the office) At this point **************** felt out refused to answer any questions about the discrepancies that had been brought to light. Further documents were requested that were missing and he has failed to provide such documents which would help in correcting the discrepancies. All of these actions by *************** clearly show he lacks any good faith intentions in reeling these legitimate discrepancies.

5- I fail to understand why **** refuses to simply comply with *** governing documents and certify that any and all responses to request to do so have been responded to with either false information (*************************** Opinion) or flat out lies, as is clearly evidenced in the quoted text provided in my previous response to ******************** lie about my complaint being resolved. I've taken the liberty to copy and paste the

It should be noted that every one of these documents was in electronic format and could/should have been sent to me in 30 seconds, instead ***** & ***** both DEMANDED that I visit the office to view the documents, supposedly so that ***** could be available to answer any questions or concerns. Yet **************** only had concerns and comments bout this very complaint, he basically said "I'm not sneering any questions unless you withdrwl your complaint to the BBB" Then as soon as I left **************** wrote an email to the BBB Stating the Lie about me no longer having such complaint after telling me his response was already typed up I told him to send it.

***************, Perhaps you should reread these concerns and try addressing them directly vice responding with lies and nonsense. I believe once you do this you might actually get somewhere in resolving these issues and it won't be necessary for me to resend the same concerns on multiple occasions nor will it be necessary for a judge to compel Omni to comply. Stick with the facts leave ******* and your own opinion out of the equation Read the governing documents and applicable laws and apply them as written. No need to insert ******** or your own opinions which are absolutely incorrect as the governing documents.

Speaking of rude, how is every single response from Omni containing false information attempting to deflect responsibility to board members and straight up lies not considered Rude on you behalf? You can not legitimately dispute a single statement I have made pertaining to the discrepancies that I have mentioned. Not one**** is this why you haven't even attempted to do so? Your lies about where I actually reside at any given point in time sere no purpose other than to expose your vast ignorance.

Even though there was a surplus which today can not be accounted for, thus this constitutes Fraud by deception and clearly amounts to mismanagement of funds entrusted to the Board members as well as OMNI Property Management.

6- these exact same errors have occurred for 2019, 2020, 2021 and Omni is not providing the documents that are required to be made available within 5 days as per our BI-LAWS article 5 section.

Thus I hereby inform **************** that I have a claim under 32-25.5-5-10. In the event these errors are not corrected immediatly the *** members shall have no option but to seek an emergency injunction which compels Omni Property Management and the Board members to fully comply with the CC&R'S, BI-laws and Indiana Code, Management contract as well as compensation for damages incurred by the members of the association.

So seeing as how *************** has wasted my time on Sept 27th & Oct 4th by refusing to address the concerns on all 3 appointment dates as well as failing to provide all requested documents I hereby demand that he pay my travel expenses as well as compensate me for my time wasted in the matter since he shows no good faith intentions in resolving the issues. Further since **** insist that the accounting errors are actually accurate how about OMNI pay Heritge *** the actual amount of any actual errors as per the governing documents as well as refund our money which wa paid to perform profeuonal serice and not to make negligent errors, since **** seems to be so confident in their services rendered.

Failure to properly enforce covenants as contracted, accounting errors in excess of 6 figures, false information provided to *** member is not what we are paying for, **** has yet to provide the serices as contracted Thus the *** holds these claims against Omni.

      Respectfully,

      ***********************
