    I started contacting this company on 6/1/23 to schedule tours for several of their properties with leasing agent *******. On 6/15/23 I went to see the house on ****************** I put a deposit of $895 the same day over the phone with *********************************, she emailed me on 6/21/23 to ask did I know what date I would be moving in I called her on 6/22/23 to let her know I wouldnt be moving in that property I found something else, at that time she told me my deposit is non refundable. This was the first time I had been made aware of that Ive had several interactions with ******* and spoke to her the day I paid the deposit and the fact that the deposit was non refundable wasnt disclosed to me until that very moment needless to say I was very upset but I did not use any foul language I explained to her that I was totally unaware of that and they should have been transparent about something so detrimental to someones financial situation, the info isnt on their website or stated during the application process. She told me that this is common knowledge I should have known and she hung up on me and wouldnt answer any more calls from me. Ive been deceived by the company they were not upfront regarding how they handle the deposits. I had to call the location in ********** ** to try and get a phone number for corporate they tried to be helpful but didnt have a phone number to give me. The house that I put the deposit down had been on the market so long that the rent dropped down about $40 dollars for whatever reason so they were having a hard time getting someone to move to that location. There is no way I will be out of $895 due to their negligence in disclosing pertinent information with me about how they handle the deposit throughout this entire process. Im being scammed and robbed by a legit company whos making it seem like its within their rights to keep my money but I have the right to know what would or would not happen with my money before I gave it to them.

    To Whom it May ******************* a tenant signed the application (signed application is attached) and pays the application fee, they acknowledge that they have read and agree to all the the above terms. 

    I have read, agree and affirm that all of my statements and information provided in this application are true and complete. I acknowledge that false, undisclosed, incomplete or misleading information herein *** constitute grounds for rejection of this application, termination of right of occupancy of all residents and occupants under a lease and/or forfeiture of deposits and fees,and *** constitute a criminal offense under the laws of this state.
    I understand that this application is preliminary only and does not bind you to execute a Lease or to deliver possession of the premises to me. I authorize you to contact any references listed above and to obtain consumer reports, which *** include credit,rental payment and/or eviction history and criminal background information about me and in order to verify the above information. I understand that as my prospective landlord, any co-applicants, occupants, or guarantors that *** be added to this application *** need to consent to and successfully pass consumer background screening reports.
    By agreeing, I authorize you to obtain subsequent consumer reports, including credit reports, to ensure that I continue to satisfy the terms of my tenancy, for the collection and recovery of any financial obligations relating to my tenancy, or for any other permissible purpose. Further, if I have included information on co-applicants, other adult household members, and/or guarantors on this application, I affirm that those individuals have knowledge of their inclusion on this application and expressly authorize you to obtain subsequent consumer reports, including credit reports. I understand that you *** report all positive and negative rental payment history to consumer reporting agencies who track this information for landlords, mortgage companies and other creditors.I and all occupants or guarantors hereby release from all liability or responsibility all persons and corporations requesting or supplying such information. If your application is approved and you place a security deposit to hold the property (up to 30 days),then the security deposit is NON-REFUNDABLE. 

    The last sentence of the terms states in all caps that the security deposit is NON-REFUNDABLE.  We also have on our website *******************************************************************************

    Once you have been approved for a property and you would like to commit to the property, hold the property, and take it off the market, and move in within 30 days   Now its time to put down your deposit.  To pay the deposit, please call ************ for ************ or ************ for **********.  Once the deposit has been paid our property manager will reach out to you about move-in details and signing a lease!

    A deposit is considered a pledge for a contract and and on a rental to cover a loss or damages.  The property owner removed the listing of the market for the tenant resulting in loss of rent. 

    The client placed the deposit on the property on June 15, 2023 and the unit is still off of the market.  The client has until July 16, 2023 to sign a lease and take procession of the unit.

    Im not accepting this response- The transaction happened within 7 business days of me giving the deposit for the rental- When I called and spoke to ******* on June 22nd 2023 to let her know that I found something else, at that time she said the deposit was non refundable she then assured me she would speak to someone higher up to see if this issue of me getting my money back could be resolved she never did that- She wouldnt answer my calls at first, later in the day I ended up calling back one more time to see if she would answer she did but was on the defense soon as she heard my voice because she knew shed lied about talking to someone about me getting my money refunded- I asked to get a number or speak to someone from corporate or to speak to the person higher up than her she denied me of that right as well- Why would I move into the property when like I told ******* I found something else that better suits my needs and furthermore after the way Ive been treated by them I wouldnt ever want to deal with after the way Ive been treated so unfair and disrespectful I would never give them another dime of my hardworking money- The way Ive been treated is a direct result of how they would treat me as a tenant I would be a fool to pay someone to continually mistreat and disrespect me and be the slumlords that their current tenants say they are and I definitely believe them-*********** couldve easily put the rental back on the market they purposely didnt do so so they could try to justify keeping my money they knew after the horrible interaction I had with the staff there was no way I would move in that rental- This shouldnt be acceptable for companies to not be held accountable when they rip people off and they will continue to do so if theyre allowed- Theyre a dishonest company theyre thieves they have horrendous customer service and reviews more people should take the appropriate actions and report them and stand up for themselves maybe that would change their ways and minds being a better business I will not accept this result

    Im not going to accept this response regardless of whatever ******* is saying why would you keep that $895 after having it in your possession for 5 business days (7 days counting Saturday and Sunday) also why would ****************** and tell me she would speak to someone higher up in management to see about getting my money refunded but then never contact me back and wouldnt even answer the phone until several hours later and I had to contact her and then I get disrespected and treated very nasty from herself and whoever the other woman in the office was- She made the choice not to be truthful and lie about getting me my money back they couldve given me my refund and put the rental back on the market for someone else to move in- But this untrustworthy unprofessional company made a choice to keep my money knowing they should have and could have given me my money back they knew for sure for more reasons than one its unfathomable to think I would move into that property especially after the way I was treated and after what transpired- The reasoning behind them not refunding my deposit is illogical and should definitely be illegal.

    I moved into a residence that has not been legally split into 2. I have severe electrical problems most outlets dont work and any lights that are built in flicker when I try and use them. I have water coming up through my living room floor. My A/C unit does not work properly. My light **** averages $350 a month so I believe the utilities have not been properly split between the 2 units as mine is the smaller half and my **** is more than the bigger half.

    The tenant at ********************* October 2021.  They have submitted 14 work orders since they moved into the property; 11 work orders were completed, 2 canceled because the tenant corrected the issue, and 1 canceled due to tenant admitting to the damage during move-in.  We have full records of all the work orders completed.  The tenant has paid rent late every month since they moved into the property.  In June, they started to fall behind in rent, but were communicating via email with us.  In July, they fell further behind in rent and we sent an email stating the eviction was going to be filed if we didnt receive a payment towards the outstanding balance.  When we informed the tenant of the eviction, they filed a complaint with the BBB.  The eviction has been filed at this point.  We try to work with every tenant, but we cant allow for a tenant balance to be over $2000 when rent is $800.

    I apologize for my late response regarding this issue. They have 14 work orders that were opened and closed, the simple carpentry ones were completed successfully. The most important issue has not. My A/C unit is still leaking out onto my floor almost daily. I have not submitted another work order because the tech that came out the first time said that the equipment is old and cannot maintain the temperature when it's really hot. In the winter the same unit caused the breaker to flip several times and when the techs came they discovered it wasn't wired properly and had been burning so the electricity shutting off was a safety feature. I believe the unit needs to be replaced. I have email correspondence from one of the employees of FS houses admitting that the house is "split" into 2 units and they have not registered it as a duplex. I have also contacted the ****** county ***************** and the Permits and Licensing agency and the woman who I spoke with told me a zoning permit has not been obtained on this house since **** when a garage was constructed. I was also informed that the house is still being filed as a single family home. I was denied rental assistance because they said my address does not exist.
