    On 8/19/2022 we hired American Fence Company to install a fence. On that same day, we gave a check that was a 75% deposit of $3,700 to the owner of the company. We signed a contract and he said he is 6 weeks out with the installation. 6 weeks came around and he did not show up. My husband called and texted and the owner kept promising to come within the next two weeks. After he did not show up, my husband followed up again but the owner started ignoring him. I called and pretended to be a new customer so he would pick up the phone, he explained that he had a hard time and promised to make it right and return the money. I have reached out to the owner on multiple occasions. He told me he was going to the bank to get a loan and pay back his customers, then he said the bank denied the loan, last we texted was on 1/17/2023 and I told him the deadline to get us a check was on 2/28/2023. Today, on 2/28 I texted and called *** (the owner) but he has changed his phone number. This is a large amount of money that he took and at this point, this is nothing but a scam. Attached is the contract that we have signed and text receipts from the owner.

    On 10/28/2022, we got an estimate from *********************** (Owner of American Fence Company, **** for $800 to fix 30 feet of our back yard fence. At that date of 10/28/2022, my wife wrote *** a check for $400 as a deposit for the work. *** cashed the check the same day we issued him the deposit. He said that he would be at our home to fix the fence the following Tuesday, yet never showed up on that Tuesday. Since then to this date of 12/28/2022, we have made numerous attempts to call ***. We had no luck reaching him. We left several massages on his voice mailbox and had no return call. Finally, after several more attempts, his voice mailbox was full. My wife now switched over to texting him about 5 weeks later from the date of 10/28/2022. He responded to the text at that time and said he would be over again the following Tuesday. Again, there was a "no show". We texted him again and asked for a refund since he could not do the job. The date of this text was Tuesday, 12/13/2022. I asked him to send us a refund for the and send us a tracking number for the mail that the refund is enclosed in. He agreed to do this. Today is 12/28/2022 which is 2 months since we got the estimate and wrote a check for a job that was never started or completed. I texted him again today and asked again for the refund and that we will have to take it to a legal team if needed. He has not responded to this text. We are seeking a way to get our refund back and also to make a complaint about the bad business practices of this company. Attached is 1) the receipt that was given to us for the estimate and deposit. 2) the back of the check showing he signed and cashed the check 3) the ******** site for the business 4) a photo of our fence as it looks the day the fence was wrecked (10/28/2022) 5) a photo of our fence as it looks like today (12/28/2022).
