      I did a purchase order with Ever Dry Waterproofing on 05/06/2022. I cancelled my order on 05/09/2022. I waited for 11 days for my refund to show up on my credit card, which it did not. I called to talk with *************************** on 05/20/2022 at 12:55 p.m. and at 4:36 p.m. on 05/20/2022. He was at lunch on the first call, when I called back he did not return after his lunch. I called on 05/25/2022 at 9:45 a.m., and I was told he will not be in the office at all today. I have a refund of $500.00 coming back. I cancelled with-in the 3 days, and I would like my $500.00 returned to me

      In September 2021, we bought a house. We knew the house needed foundation work but we fell in love with it so we bought it. Also in September 2021, we contacted Everdry to get an estimate for the foundation work and the salesman came out. This guy was extremely pushy and my husband and I both felt uncomfortable but we listened to what he had to say. We signed a contract for them to do the work but as time went by, we realized that what they were going to do wouldn't solve our problem, the blocks at the footers are holding water and Everdry was only going to dig down 2-3 feet, this would not solve the water problem at the footer. I emailed Everdry to tell them that we wanted to cancel the contract but I never received a response so I sent a second email, I never received an email response but somebody called and talked to my husband. My husband agreed to let the salesman and the regional supervisor come back out so he could explain to them why their solution wouldn't work but I told my husband that they are just going to try to convince us to change our minds which is what they did. The regional supervisor even said something to the effect that once it's out of his hands, corporate can put a lien on our house, seriously! This scared us and I had previously looked over the paperwork and found a section on cancellation which states that any changes on the buyers part entitles the contractor to 28% of the contract price which is $8337.36. On 12/27/21, we get a letter from them demanding this amount within 10 days or we will be turned over to collections so I sent them a check, we didn't want to lose our house which is what they made us think would happen. In no other complaints I've read has anybody else had to pay to get out of the contract and they all got their deposits back and we want our money back too, I will not stop until that $8337.36 is back in our bank account. If you can't provide a solution, I will be contacting an attorney to solve it, Everdry are crooks.

      As the owner of Everdry of Michiana for nearly 30 years I can appreciate any customer complaints and concerns albeit they are few and far between. I have reviewed the file and all legal documentation and Everdry clearly did a clear and good job documenting all findings and following the letter of the law. We pride ourselves on educating all customers and findings and options. The contract was signed on 09/16/2021 and rescission forms were left if the customer wanted to cancel. ******* law gives 3 business days to cancel for the very reason of pushy people of which we are not. In fact the ***** cancelled via a dated email of 12/21/2021, more than 3 months after signing the contract. The contract is quite clear on how to cancel both inside and outside of the Indiana state law rescission period. The ***** understood and agreed to the terms. Based on the ***** closing statement of they will be turning this matter over to their attorney and the defaming statement of calling us crooks, we will be turning this matter to our attorneys.       I am truly sorry for sending you this complaint, my husband had a stroke a few years ago and it really messed with his brain and he wanted me to send this complaint. His mind hasn't been right since the stroke and he insisted I complain about Everdry. I tried to explain the situation to him but he doesn't "hear" me and I didn't know what else to do. Everdry will not hear from us again, I will make sure of it. Unless you live with somebody who has had a stroke or similar medical issues, you have no idea how hard it is. Again, I sincerely apoplgize.

      I had a wet basement repaired in 2014 initially by Everdry in ***************, IN. I have received bills and paid $75 annually as insurance to provide a lifetime warranty. Leaking has occurred several times since and Everdry has upheld their obligation to remediate the situation. Everdry has since changed ownership and is now based in **********. The new business continued to cash my insurance checks, accepting the associated liability of the insurance contract. In spring of 2021, the water barrier failed to perform as contracted, resulting in more severe damage than before - the carpet was saturated, the furniture and walls had mildew growth, and I had to hire a contractor to resolve the damage which cost me nearly $1000. Once again, Everdry fulfilled their obligation and took extra steps by digging up the basement wall, sealing, and installing french drains. I am grateful to Everdry for fulfilling their obligation up to this point. But now, I have had consistent leaking since April 2021, with interior damage and mold growth, and Everdry has refused to remediate the situation. It is my understanding that Everdry's new owners have a licensure issue in ***************. I understand but cannot accept the neglect of this situation. I have become ill, and my home is becoming unlivable due to water damage and mold growth. I am an 85-year-old widow and I just want a dry basement. If Everdry cannot or will not perform the services for which they have been paid, I would ask them to hire someone else to address this problem so I can live in a clean and healthy home again.

      Everdry of Michiana did not install the work. We are separate and legal entities. If we received a warranty payment, we will refund.

      Date of project July 12 to July July 15, 2021. Project consisted of waterproofing basement per their "patent system" consisting of a two part weeping tile system inside the house and outside the foundation. I was told by sales AND Region Owner after work was finished the work would be cover for the lifetime of the house, and any repairs or rework that needed to be done was covered under this lifetime warranty. the paperwork was signed July *******; this consisted of a letter to the bank stating work had been complete. The total cost of work was $17,000, paid via bank loan. Everdry is committed to provide waterproofing of the basement and upon completion the house will have a lifetime warranty of any future work needed or problems with water penetration into the basement. The dispute is the day after work was completed, there was a heavy rain. water poured through the cracks in the walls. I have pictures of every time this has happened. I called and initially had someone on the phone, someone came out even to look and said there would be a crew to fix the issues. a date of Oct 7,2021 was set. I had gotten a phone call stating the entire staff had Covid and that work would be rescheduled. I attempted to call on 10/14, 11/24, 12/1, and 12/10; all attempts have ended with leaving a voicemail or note; with no return contact from the business. The last call in-fact I was told that the staff all had Covid still and that there wasn't anything I could do, not even talk with a manager or the Owner, but I could feel free to leave a message, which I did again. The account is tied to the address of the property, or at least this is what I have been lead to believe.

       I am rejecting this response because:

      On October 6th I was called and told that the service was cancelled due to the entire staff contracting covid. Corresponding to the dates initially indicated, I've attempted to call to find out what the status of things were only to be ignored; Now, this response is broad with the intent to indicate that there has been an ongoing covid contraction from Oct 6 up to and including the current date, furthermore materials are now in short supply or are in a backorder state. If the job was ready to be works on Oct 6th then where did the materials go? How can anyone claim that their staff have had covid for a duration of this magnitude? Am I to understand all this time I have been setup with false information? I was initially understanding of the circumstances of staff having covid; however, this reused claim of covid amended with a material shortage is unacceptable. I had stored personal belongings in my garage to accommodate the basement work, after the cancelled appointment I had to make other arrangements via rental storage to safe guard my belongings as the basement isn't an acceptable location to keep such items. I paid for a service, and so far the claims of the work hasn't met the standards I was sold, further more I've had to make more expenditures to accommodate the inability to fully utilize my basement this is not only a hassle but a further drain on my finances which has been an unexpected one given what was claimed would happen. For this dispute to be resolved I need the work to be completed as it was sold to me. will I be reimbursed for storage fees incurred thus far?

       I am rejecting this response because:

      If Everdry is unable to handle the work then outsourcing what needs to be done is the next step. I do not accept the response of "we will eventually get to you", furthermore, I am astonished that given the length of my previous response and all of the questions that it did not warrant a response to said questions?

      i had by basement water proofed by everydry of ******* had them back several times because it still leaked they went out of business ******** my acount to evrydry of michiana they said ****'t fine a records and i need to proved i payed my yearly warrantie how can i do that if no one sent me **** for it

      I can appreciate the concerns of the **********. I would like to state a few facts to help provide some clarity between all involved.

       

      Everdry of Michiana did not perform the service nor receive any funds from the ********** nor has a contract with them. The service agreement between the ********** was not kept up to date between the ********** and Everdry of Northern ******* which is ******** Industries based out of ***************.

       

      With that being said, Everdry of Michiana in ********** is trying to help. The ********** currently have no warranty as they did not keep up on the service agreement with ******** Industries in ***************. Everdry of Michiana at its own expense and no trip fee charged drove all the way from ********** on June 10 2021 and did send a service manager out to assess the situation. The annual service fee is ***** plus there is a charge for the service work of ****** which would bring them current and all future service would be at no charge as long as the ***** annual service fee was kept up to date with Everdry of Michiana in **********.
