I bought this car from Davios Auto in ********** like 6 months ago and out of the 6 months Ive been making payments on it Ive only been able to drive it for 1 month due to things constantly breaking on it. I understand that I bought it from a used car lot however car sales places are supposed to be selling road safe cars in the state of *******. Not only did they sell me this car that is not road safe due to missing part of the subframe for the vehicle but also the tires showing wire which could have blown as I was driving it home along with an oil leak which I discovered same day. A few times after me driving it I rolled my windows down and when I went to roll them back up the drivers side window motor went out. Next up is the thermostat and radiator **** bearings going out which lead to my car being undriveable as it would overheat and shut off. I learned also that my ball joints are bad which means a control arm is bad as well. *** had to replace the breaks in this car 2 times within the time I have paid on this vehicle while only being able to drive it for a month. Icing ontop of the cake is that something is now wrong with the bottom end of the motor causing a rod knock in my motor which has now deemed my car undriveable yet again. I put a $2000 down payment on this car and traded my old vehicle in for it, I currently still owe close to $3,9600 on it while I cant even use it. Also my motor and transmission were supposed to be under warranty per the salesmans words and when I called Davios explaining what is happening they told me my warranty is up and they cant do anything to help. When I was looking to buy this vehicle I talked to their mechanic who said everything has been up to date on the car and he just replaced the motor, so how is it going out already? Not to mention Davios threw their mechanic under the **** after he no longer worked there and told me he wasnt really a mechanic he was more of a wires guy. *** spent more to fix than worth.Business Response

When **************** came in on 3/16/24 to purchase the vehicle in question there was originally no way to make the deal happen to put him into this vehicle. It was understood that this is the only vehicle **************** wanted so his salesman *** made an effort to get him into it. *** called the general manager and a special concession was made with the stipulation that the vehicle needed to be sold absolutely AS-IS. *** stated to the General manager that he told **************** this and also **************** signed 2 different AS-IS forms. That being said, **************** still came in 3 weeks after the sale of the vehicle stating that the vehicle had an issue with the subframe which he has described in his original complaint. The general manager again made a special concession for him even though the vehicle was sold AS-IS and agreed to knock $650 off of the total price of the vehicle for this issue. **************** agreed to this and that is the last we have heard from him about the vehicle. It has now been over 3 months since the vehicle was sold, it was sold AS-IS and therefore nothing more can be done in the way of a refund or exchange. However one last concession has been agreed to by our general manager, he is willing to agree to a further reduction in total price. Davios is willing to reduce the price by a total of $1600, if **************** would like to call us or come in we can provide further details on this.Initial Complaint

I apologize for the delay. As we had scheduled vacation time with employees and also the 4th of July holiday. We needed time to corroborate the information.
*********************** purchased a vehicle from Davio's Autos on 05/05/2022. On 05/16 customer brought vehicle to mechanic on sight, said motor running hot, temp gage is up. Mechanic checked out vehicle and bled coolant system, added fluids and checked for leaks.
Everything checked out.
On 05/20/2022 customer came into office to make car payment, as scheduled. Customer then spoke with mechanic once more and said that vehicle was losing oil and he has to keep adding oil. Mechanic advised customer not to drive vehicle much further so that there is no major damage done to the motor, to leave the vehicle so that the oil leaking can be addressed. The customer refused to do so. Customer said that he needed vehicle to get to work, and did not leave vehicle that day. Although mechanic topped off oil as the vehicle had no oil.
On 06/06/2022 Customer brought vehicle to mechanic to try to get oil leak addressed. Customer took it to our second mechanic as he is located one door down from his place of employment. our second mechanic found issues. Mechanic did an oil change and replaced a harmonic balancer. Noticed that the engine had a slight noise to it.
On 06/16/2022 Customer had our second mechanic replace a serpentine belt.
Although the vehicles are sold as is, without warranty, we had performed all of this mechanical work, parts and labor at no cost to the customer.
Finally, On 06/18/2022 Customer called our office and spoke with me and stated that he does not want the vehicle anymore and that he wants his money back. That the motor is bad in the vehicle. And that we are very unprofessional.
I stated that the vehicle was sold as is, and that the motor was not bad when we sold him the vehicle. That we did everything we could on our end and that if the motor is in fact bad it was a direct consequence of Customer driving it without oil. That we would not give customer his money back. The vehicle belongs to him, and he would have to replace motor.
But he was not satisfied with my response. So, he decided to voluntarily give vehicle back as a repossession. And form a complaint.
If there shall be any further question or concern regarding this complaint, please feel free to contact the office @ ***************.
Thank you for your cooperation in this matter.
Respectfully,
