Dealer lied about price he was charging for vehicle ended up charging more, then said the price was higher related to interest already being added to financing. He stated the antifreeze that was sputtering all over the serpentine belt would be fixed before we left. It never was. Stated he would fix the air bag sensor that was broken within a week or so when part came in. My husband called to question the charges from the finance company and he proceeded to yell, cuss, and name call then hang up on him. The dealer was dishonest about several things.Initial Complaint

Car dealership sold me 2009 Bmw X5 35d knowingly that the car did not have a particular filter on the DEF System. The car is noncompliant with the federal emissions act. It is illegal for the car dealership to sell. I would like them to pay the repair cost and labor $2600.00Initial Complaint

Just called in to check on parts ordered for my car. Asked a few questions, inquiring about it (a week after i brought it in to be looked at). Banks Daughter who runs the front desk was rude, blew me off, got upset with me for asking the update on the parts ordered, wouldn't let me talk past mentioning parts, told me to "take the car somewhere else" because she doesn't have to or want to help me out. I was accused of trying to force her to do something when i only asked about my car, im currently buying from there. She hung up on me after that. I called back because i couldn't even get through 2 questions. She immediately got ****** and said calling back a bunch wasnt going to change anything. Story short. Ive never had anyone talk to me like that from there. Part of my contract buying from them was the promise and written clause saying they'd work on the car as long as paymemts are being made for free plus the cost of parts. She straight up told me my car wouldn't be worked on at all and yo go somewhere else, even though it's in the contract.Initial Complaint

I went to banks on May 16th to look for a car. First red flag, when we test drove the vehicle they did not give us a license plate to put on the vehicle and told us we were not allowed to drive it on the highway. I believe that ***** ***** (co-owner) lied on my finance application. She said I was working 40 hours a week when I was only working roughly 20. I paid 3 thousand dollars for a down deposit and drove off in it that day. On august 24th my car broke down. I dropped it back off to then for them to fix it. I called 3 different times and the people there were telling me they were still working on it. I called around September 8th and spoke to *** (the owner), he told me that they did everything they could but they didn't know what was wrong with it. My dad picked the vehicle up later. On September 15th I attempted to drive the vehicle. Not only was it not wanting to run, now the brakes had went out. I had to buy a whole new car because Banks told me there was nothing they could do. Yesterday I attempted to call for the last time to see if there was anything I they would do about the car. ***** yelled at me on the phone. She told me she gave me receipts and an estimate on what it would be to fix the vehicle, which is false because I was not the one to pick up my car. She called me a liar and told me it had only sat there for 4 days and that they had 3 different mechanics look at it. I never got any recommendations for what to do, I never got any copies of the 'mechanics' diagnosis on the car, I was told that they didn't know what was wrong with it by the owner of the company. ***** was very unprofessional with me, she laughed at me and screamed at me for 10 minutes on the phone. I know that I am not the only person they have done this to either. Below are text messages with dates from me to my friends explaining what *****, ***, and their 'mechanic' were telling me. Business Response let's start this off by first off saying that all credit applications are done by a finance company and verified by the same finance company. Second of all cars are sold with an as is no warrenty.lastely we are not able to issue any refunds as we do not have the loan on the car as we are not the financing company. when her car was brought here we did have three seperate mechanics look at it. we had ******* look at it, our in house mechanic, and ***** performance from ********* also look at is as he is the one in the area who specializes in timing chains on 3.6 motors in our area. I spoke with ******* the day they can to get it and i reiterated everything to her father when he was here in the building. We told them it would need a timing chain and by driving it away from this lot could cause the timing to go the rest of the way out and at that time they would have to replace the entire motor. her father informed me he understood and stated him and buddy would be able to change the timing chain themselves. I encouraged him to haul it and he told me again that it would be ok and he would take the back road. we did not hear anything from this young lady so we had assumed they had gotten it taken care of and there were no longer any issues. she then calls in december asking for her money back. um what? she then informs me she had purchased another vehicle and could longer afford this one and i told her she would have to contact the financing company as i do not hold a lein on the vehicle and that they do. she said that the finance company told her she c ould reach out to us to see if we wanted to repurchase the vehicle but we werent required to. i am unable to repurchase a car that i told them that by driving it from this lot could result in needing a whole motor the quote to get a new timing done from ***** performance was $2700. we offered to pay half to help her out but at this time there is nothing we can do. i truly wish she would have allowed us to help her put the timing in the vehicle while it was her bc the chances the valves are now bent and at this point the motor is probably not good and worthlessInitial Complaint

I "financed" a 2011 ford fiesta from Banks one stop auto using a $700 deposit/down payment towards the vehicle on 6/28/21. Later that afternoon the vehicle broke down resulting in me needing to take a $125 Uber home. Banks one stop auto went and picked up the vehicle and towed it back to ********* Indiana, but stopped responding to my questions, calls or texts after financing fell through. The financing company informed me that Banks One Stop Auto are the ones responsible for returning my money, but they refuse to return what I paid down or work out any other arrangement of any sort. In addition, the papers that were notarized on 6/28/21 were notarized by ***** *****, but the stamp used said *** ***** so I can only imagine what else is being done.Business Response

On the paperwork you received you received a copy of a loan application. On the loan application it was marked that you had no open bankruptcies and you sign this exact document 4 times verifying that the document was true and correct and that anything on that page was correct. Well this is the beginning of where everything went wrong. Yes the car broke, yes we sent ***** money to get to you so you could get an Uber, and yes we had it towed back to our lot so we could fix it. We put a new motor into the vehicle. We were doing that as the finance company called us to inform us that you had an open and active bankruptcy, and that the trustee of your bankruptcy would not allow the debt and told us to immediately take the vehicle back as you had committed perjury. As soon as we found out we called you and informed you of what was told to us and that we wouldn't be able to sell you a car. My question is you said you told ***** why did you never tell the person whom did the paperwork? How did you not catch it on credit app? How are you asking for more than your original deposit as we allowed for a lesser deposit so you could get insurance? Why does it take over a year to ever send in any complaint or message? There is nothing we can do but have advised the attorneys that we may pursue the perjury charges. We will be happy to go to court if you would like but there will be a counter suit for the perjury that you openly admitted to on facebook multiple times. We do not know why our original response wasn't recorded as it was done verbally on the phone with the lady from this office. I am sorry your trustee said no. I am sorry that you lied on the credit application to get the car in the first place and feel you have been wrongfully treated. I am sorry that a code reader done by a secondary shop showed recent over revs was the cause to the blown motor. I am sorry we fixed the car and did resell it. I am sorry you have to drive a nonsafe car now and believe we are to blame for it as well. I am sorry you got denied by the financial institution for your loan for no fault by our company but your own neglect and misinformation given. I pray that 2023 looks better for you and your family. Further I can provide copies of these documents in their entirety if requested in case you have lost the copies that were given to you the night we stayed open super late to try to help you.Customer Answer

I didn't commit perjury. They knew about my bankruptcy, a conversation took place between ****** the horrid lady in the office, and my boyfriend. The claim that I was rough on the car is absolutely ridiculous and falsely made as well. I have all the paperwork, including the proof of the down payment.
