    The contractor ran into my existing basketball hoop with his machinery, bending and twisting the pole. After I informed him, he said he did not realize he did this. He attempted to straighten it by pushing shims in the ground between the concrete anchor and the grass. In the end saying "As good as it gets". Definitely not! As good as it gets would be how it was before he ran into it, without the wooden shims that will rot eventually. It's not plumb and the back board is slightly twisted still.Also, when putting down the asphalt, the heavy machinery resting on the edge (lip) of the concrete (overhead door threshold), cracked and spider webbed in a few places. This is going to faulter, crumble and create a hole sometime in the future. I asked that he simply finish this seam as if he were doing this work on his own driveway. He tells me "the concrete is 90 years old and has only a few hairline cracks and that I should stop trying to get something for nothing". He also said the city gave me a free pass on this as the neighborhood requires concrete driveways. First of all, what does that have to do with the quality of his work and accountability? Secondly, they wouldn't have issued the permit to him if it was a problem. And thirdly, did he say this in an attempt to justify him not being accountable for the damage he caused nor finishing the seam properly? The city gave me a free pass, so I should be happy with what I got? He should have to replace the basketball hoop since it can't be fixed and cover the cost to fix the damage he caused to my existing concrete.

    I did not hit anything on his property ,i backed up right to it ,i dont think i touched it ,at the time i asked the spotters if i touched it he said no . i looks for marks on machine and ***** pole and could not find anything. We left ,base needed dry out time and the basketball pole was same as it was. ***** was there at that time , we talked some about the base ,Let the 2 weeks pass .When we returned to finish the driveway The basketball pole was leaning to the south, customer is saying we hit the basketball poll ,i dont thing i hit the bb pole ,in a nutshell it looks like some was grabbing the rim and hanging on it .Who i  do not  know ,maybe some kids when  he is at work.Hair line cracking he hired us to do the job ,We finished the job, properly and good as gold, when you own things, you take risk , its unfortunate to have his patch fail , and some hairline cracks , any concrete work would be over and above the original estimate and i asked for his thoughts and have not received comment

    Attached you will see a picture of the basketball pole and the scuff and markings from where his equipment ran into the pole and caused damage.  Also a picture showing the pole pushed to the right.

     I am rejecting this response because:

    The basketball pole has damage from where his machinery hit it.  It is is fresh silvery colored scrape and dent from where you hit it.  You most certainly did run into it.  Why would you attempt to fix it if you did not cause the damage?  The spiderwebbing of existing concrete is from where your heavy equipment rode on the very edge of the concrete and resulted in the damage.

    being a good human , helping a fellow man. under no circumstances helping a client is not a admission of quilt .                                                                                                                                                                             if you cant stand the the fine line cracks ,why dont paint it.

     I am rejecting this response because:  He wasn't being a good human and helping a fellow man.  Knowing he caused the damage he attempted to fix it.  He ran into the pole with his equipment which you can see the damage in the pictures from the impact.  

    Suggesting I paint the cracks you caused is unacceptable.  You damaged my existing concrete in addition to the damage you caused to the basketball pole.  You should accept accountability for your actions and make it right.
