    The owner of this business is a nurse practitioner. She advertised for another nurse practitioner to join her business renting some space from her to practice medicine. There was a lease agreement signed with a one-year expiration date. About 3 months into the lease, she started making demands for more money without compromise. Threats were made from her that if a new lease was not signed with her money demands, I would have to leave. By this time, I had started seeing patients and developing a thriving healthcare practice. Attempts were made to compromise again, and she responded with insults, anger and basically an ultimatum that I would have to leave. Eventually she sent a certified letter to me, giving me 30 days to vacate the premises, despite the fact that the legal lease agreement was still valid. I have since vacated on August 1st and she has yet to pay me the deposit that was agreed upon in the lease. She also refuses to release my patient's health records to me. Since then, I have discovered that she did the same thing to another nurse practitioner approximately one year prior. I am very concerned that she will do this again to someone else in the future. The resolution I am seeking is that she releases my patient's health records to me because for one they belong to me and so that I can continue providing care to my patients.

    The complainant is also a nurse practitioner who set up their own business practice using a shared table space and is responsible towards her own patients and patient's records. The lease agreement in question was month to month not for a year. The complainant made verbal business agreements and then refused to pay for her agreed upon share of the cost. There were no threats made and no insults were delivered. A new lease agreement was proffered in consult with a ***** volunteer counselor obtained through the Small Business Administration to make sure the complainant could see her fair share of the cost for doing business. It was simply an accounting decision. When the complainant decided not to sign the new lease agreement a certified letter with notice to vacate in 30 days was sent with the option to sign the new lease agreement if she chose to stay. The deposit for the leased space was refunded to the complainant within 30 days of her vacating the leased space. 

    Complainant abandoned her patient's records. She moved her exam tables and clinic supplies but made no effort to transfer her patient records. Upon ending her lease agreement on July 31, 2024 her access to the shared table space was terminated. Since the complainant was set up as her own LLC only she can release her own records. I do not have the ability to release another business's records as she is her own LLC and separate from my business. She has to work with her own Electronic Health Record company and/or rebuild her patient's records. 

    The other nurse practitioner that leased space left the office in a hurry, of her own accord, after not disclosing that she was on the OIG's list for Medicare fraud. She point blank lied about the Medicare fraud.

    It is truly regrettable that the complainant is not more responsible towards her patients and patient's records.
