      In short, this situation should have never gotten to this point. My realtor submitted the allocation of funds to Security 1st Title, and it was not followed by Security 1st Title. This is due to the unethical actions taken by the buyers’ agents, Jake ***** and Rachel *****. After my realtor submitted the allocation of funds Jake ***** submitted his own allocation of funds without the knowledge or acceptance of the sellers or the seller’s agent. During the signing my wife and I both asked the Security 1st Title “stand in” representative about the percentages and the response was that the numbers came from our (sellers’) agent. This was untrue and we felt obligated to sign due to the statement made by the Security 1st Title “stand in” representative and the trust we put in our agent. After the signing we reached out to our agent for clarification, and she stated that the percentages were in fact “wrong”. The buyer’s agent was only to receive ***% and the seller’s agent was to receive ***% which is stated on the MLS and every website that listed our home. This was changed to these percentages’ way before Jake & Rachel ******* buyers ever submitted an offer. To Security 1st Title, your office made a clerical error and should have immediately corrected the issue knowing we (the sellers and the seller’s agent and broker) reached out to you to inform you of the error timely. The number of emails and calls that have taken place to try and correct the error should have put your office on high alert. You should have a responsibility to the clients and ensure the documents you are drafting are 100% accurate. You should have, as all title companies should, follow the seller’s agent’s allocation of funds. Remember that this was our home and not yours or the buyer’s agent.
