The company is refusing to honor its one year worksmanship warranty that was promised and is its business practice. I have a ***** issue with a shift in one section of deck rail. When i asked for this repair on 10/5 (two months after project completion), the owner said to send pictures and then responded that he forgot to charge me some labor and I paid less than was owed, both of which are not true, and he wouldn’t honor the warranty unless I gave him another $400. This is a breach of contract to not honor the warranty and claim I still owe money because I asked for a warranty repair. I was never notified of anything outstanding and the owner had stated the amount for me to pay. This business should honor the warranty for the one year period from date of completion (until 8/23/23) and repair the issue.

There is no warranty whatsoever for ****** ***** because she never paid for the project contract amount. She also didn’t pay the total for the ad on post sleeves on her job that she agreed to
She also contacted a credit card company and lied to them and said the post sleeves were defective and tried to cancel the entire cost of the post sleeves
As you can see by my 85+5 star reviews of satisfied customers on ****** and zero negative comments on my ****** page I try to make every customer happy unfortunately you do come across people that try to take advantage of you and that’s what’s happened with this particular customer
She is complaining about expansion of a deck board that is less than 1/2 inch out of alignment which wouldn’t be covered under any warranty by any manufacturer or contractor.  For 99.9% of my customers we would address this minor issue but we were cheated financially by ****** *****
I can provide documentation if needed

    Thank you

    Customer Answer

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[The response from the business is rejected and false. ***** ***** has a pattern of attacking anyone who disagrees with him—look at the one dispute on your website and any other negative reviews. ***** asked for payment in full before he left our property. It was given by check. The project had no oversight and there were damages to our property that he did not want to take responsibility for—this included our patio being broken and cut into, our house siding being broken, and damage to the new deck boards by his crew -they cut into the boards with a saw and they are grooved and scratched. There are other damages. We also received all No. 2 6 x 6 posts when we paid for No. 1 lumber and were told it would be all No. 1. That is fraud.

I have impeccable credit and have never not paid a bill in full or on time. This is no different. Mr. ***** called after we paid in full that he forgot a charge. He told me to call his store and pay it—when I did, the partner at the store gave me a ***** discount (200 on an over 30k job) for goodwill for some of the damages. He ran my credit card—I had no control over the amount charged. Mr. ******* issue that I owe him money is over that discount, which his partner gave me. He should take that up with his partner and stop saying I owe him money.  I am paid in full (twice).

This company does not stand behind its work or its word. When he left with our check, he said call any time if you have a problem. His justification for damages were “you have cracks in your driveway and I know you won’t fix the patio anyway”. We had no damage to the patio before his crew was here. They did not talk to us about damage and did an awful patch in one very visible spot without talking to us. He needs to learn that things happen, and how you treat your customers when things go wrong can go a long way in making things right. Instead he tried to attack me, make false claims about owing money, and smear my name. In reality,  they cheated us with inferior lumber relative to what we paid for and were promised. He is also dishonest about what he says I stated to the credit card company—that is documented and was due to the unwillingness to honor the warranty and the No.2 lumber when we discovered that.

He is also incorrect about the shift in the deck railing-it is more than 1/2”. His crew also built railing that is not to code in some spots and other mistakes were caught by me. He complained that we cost him money when it was the sloppiness of his crew that cost him money. He needs to be responsible for his company’s mistakes and not deflect blame when things go wrong.

I am attaching a few pictures for examples of the  No.2 lumber and a little bit of the damage, especially to the patio.

    Thank you,
    ****** *****

    Regards,
