      Brought a car from Toyota of Louisville. The air went out I have an extended warranty and they said the repair are not covered. The air went out the day after I got the car. I tried to get an appointment and when I called they said the system was down and they would call back finally got an appointment almost a month after I got the car now they want me to pay 1600 to fix it. I want my car fixed. The man called me before he even looked at my car and said when did the air start acting up. I said right after I bought it. We'll it had to happen after you left. A rock busted a line

      My **** truck has a frame rust issue and the frame will brake. Apparentlt a letter was mailed out to the previous owner of the truck not to my ***. When my *** found out and called it was after the warranry had expired and they wont honor it.. her and my brother have called and spoke to multpile people about it.. toyota refused to fix it. So she is driving an unsafe truck. The need to honor it and fix the truck free under warranty.       We at the dealership do not have the ability to make warranty repairs after expiration of Toyota manufacturing limits. We have contacted Toyota manufacturing on the customers behalf and no assistance was offered by Toyota manufacturing.

      Customer #****** Invoice ********** Date 11/2/21 Was to furnish & Inst rear wiper blade. Did not inform that work wasn't finished. Later sent mail saying part is in. This entirely unsat. I'm 86 years old, **** *** ***********; it is hardship to go to dealer for this simple task. Had terrible time contacting anyone. On 13 Dec, did talk to service person who promised to come to house and do the task next day. Failed and didn't contact to say why. Emailed, called, & wrote letter, no response except that noted on 13 Dec. Also want lug nut supplied when they inspected wheels and didn't notice that one was missing. Should finish job or refund the cost promptly. Retired civilian employee of Coast Guard and Army

      On August 31, 2021, I attempted to renew my car tags on a Buick Encore purchased a year prior from Toyota of Louisville. At the time of purchase, I traded in my Honda Accord. After negotiations were done the price including sales tax for the Buick was 17,995. I was then charged State tax, license fee, title & notary work, plus vehicle prep in excess of factory allowance, clean up, reconditioning fee all totaling about $915. I understood that the fee included state tax and registration for the Buick and since I was being charged for the Buick’s state tax, state tax and transfer fees fir the Honda would be Toyota of Louisville’s responsibility. In fact, the county clerk’s office typically does not allow a transfer without payment if the state tax. However, when I went to renew my tags on the Buick, the clerk told me I had an outstanding bill on the Honda. She noted that all notices had been mailed to Toyota of Louisville. I want a refund of the double fees I paid.

      Good morning, we sold Ms. ***** the Buick in August 2021 and paid the sales tax we charged to have the Buick titled in Ms. *****'s name. The property tax on the trade in is the responsibility of the owner as of January !st 2021. We didn't collect the property tax that she owed on the Honda.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed 

      Toyota of Louisville’s response does not include a resolution. Instead they say they did not collect the fees for the Honda. Under Kentucky law, state tax on vehicles is assessed on January 1st and is the responsibility of the property owner as of January 1st of the tax year unless the responsibility has transferred by contract. Toyota of Louisville transferred the Buick tax responsibility to me and in so doing, impliedly assumed the tax liability for the Honda. To make matters worse, Toyota of Louisville inflated its fees by an amount that would have covered the fees for both vehicles plus $500 more. Toyota of Louisville advertises a flat $498 fee but charged me over $900, yet did not pay the fees for the Honda. 

      Toyota of Louisville is in violation of  Kentucky’s fair dealings law by collecting fees, inflating fees and then not paying the required state tax generally required to transfer the title to the vehicle that Toyota of Louisville purchased from me.  I attached the original ******** advertisement found on my sales person, ***** ******’s ******** page, the sales contract, and transfer documents I obtained from the County Clerk’s office. You can clearly see where the fees had been inflated. I also included the letter I sent to Toyota of Louisville’s General Manager. I want to be refunded as outlined in the letter. It is not fair that someone at Toyota of Louisville has been allowed to pocket money that should have been used to pay state taxes and fees.

      ****** has not offered a solution and his documentation support my point. Toyota of Louisville collected collected a state fee for the Buick in the amount of $371.28, paid only $317.70. Based on the law highlighted in ******’s attachment, Toyota of Louisville was responsible for the state fee for the Buick but knowingly passed the fee to me and in so doing, assumed the responsibility for the Honda’s state fee. Yet failed to pay it. In Kentucky, state fees for automobile tag renewals are due in the automobile owner’s month of birth. I was born in August. I traded in the Honda in June. The dealership was aware that I was born in August because the dealership used my date of birth and social to run credit. The dealership is aware of both the date for which automobiles are assessed (January 1st) and the rule for when assessment fees are due (owner’s birth month).  Based on the amount of fees Toyota of Louisville charged, state fee due date, and date of trade in, any prudent car buyer would conclude that Toyota of Louisville assumed responsibility for the state fees for the car Toyota of Louisville purchased from me on trade. Again, Toyota of Louisville is in violation of Kentucky’s fair dealings law. Below, I offer a recap of how the fair dealings law has been applied, using a blogpost by ****** ********. Toyota of Louisville was deceitful in their dealings with me and need to make this right. 

      Good Faith and Fair Dealing

      In Gresh v. Waste Services of America, Inc., 738 F. Supp.2d 702, 710-11 (E.D. Ky. 2010), the court set forth the effect of the obligation of good faith and fair dealing:
      Second, under Kentucky law, parties have a duty in carrying out a contract to act in good faith, sincerely and without deceit or fraud.  Pearman v. W. Point Nat’l Bank, 887 S.W.2d 366, 368 n. 3 (Ky. Ct. App. 1994).  This is generally observed as the covenant of good faith and fair dealing implied in every contract.  Ranier v. Mount Sterling Nat’l Bank, 812 S.W.2d 154, 156 (Ky. 1991).  A breach of the implied duty of good faith and fair dealing is an impossibility where a contract has not yet been formed.  Quadrille Bus. Sys. v. Ky. Cattlemen’s Assoc., Inc., 242 S.W.3d 359, 364 (Ky. Ct. App. 2007).  “A contracting party impliedly obligates himself to cooperate in the performance of this contract and the law will not permit him to take advantage of an obstacle to performance which he has created or which lies within his power to remove.”  Ligon v. Parr, 471 S.W.2d 1, 3 (Ky. 1971) (quoting Gulf, Mobile & Ohio R.R. Co. v Ill. Cent. R.R. Co., 128 F. Supp. 311, 324 (N.D. Ala.1954)).

      I called Toyota of Louisville to resolve this issue but was denied. Next, I emailed the general manager, ****** ***** but received no response. ****** has responded to this BBB complaint but still will not make right where Toyota of Louisville was wrong. Initially, I asked only that Toyota of Louisville cover the $206.54 tax for the Honda. Their refusal has caused me to review my entire contract and obtain a copy of the transfer documents that Toyota of Louisville filed with the county clerk’s office. I discovered that New York, the state where the Buick originated, did not disclose if the car had been in any accidents before I purchased the vehicle. However, I know some type of paint job was done on the car before I purchased it because there was a hand print on the drivers side door that has never come off after a wash. I saw it when I purchased the car but assumed it would easily wash off. However, the hand print has not come off and the black trim around the windows on the driver side are starting to fade. That is odd for a gently used car that had only about 11,000 miles when I bought it. I want to be reimbursed for the money I spent on the 2020 tax for the higher of either the Buick or Honda. The Buick 2020 fees were $317.70 but I was charged $371.28. The Honda was $206.54. Receipt attached.
