      On October 7,2022 I purchased a 2011 Jeep Wrangler Rubicon. Driving to work on following Monday during to work the check engine light came on and low tire also. After leaving work I took the Jeep to have the codes read. It was throwing six different codes, the mostly costly was catalytic converter replacement ($1700), the other repairs were $370. When talking to salesman he kept stressing there no lights on the dash. The Jeep was an “as is” and I was told they do not check anything but major stuff when the get them in on trade. But I’m out $2170 for repairs that should have been checked. I honestly and truly believe, no matter what *** ******* says, they knew those light were on and knew what was wrong but ignored it and turned the lights off. They knew they would come back eventually at a certain mileage. I called them and all I heard was it was bought “as is” and how transparent they were. I was contacted by somebody there telling me they wanted to help but no help yet? I felt like I had been duped and was disappointed after hearing how great the dealership was to buy and trade with. So much for that BS. I will never believe anything but they knew and turned the lights out just get it sold and off the lot. It’s all about money and greed. I can’t believe Mr ******* would allow his business to be ran like that even it was “as is”.

I would be happy to speak to you about a working resolution. I do feel the need however to bring up two points, the vehicle in question was sold "AS-TRADED" not AS-IS. The difference being that it had NEVER been in our shop for maintenance at any point. When sold we explain this to our customers verbally, and in writing for the customer to read and sign.       I, ***** ********, purchased a 2010 Nissan Pathfinder from Dan Cummins Paris Ky on 3/28/22 sold AS-IS won’t repair for $7900 (financed for $7,010 – interest rate 24.53 % after $2,000 down paymt.). After paid in full totals to $11,760.12. Before purchasing, the Check Engine light was on. A Hand-held computer test (like Auto Zone’s) was done while there which indicated an Evap code ONLY for possible loose fuel cap. I replaced fuel cap. Check Engine Light stayed on. Nothing wrong with the engine. Since the positive side battery terminal was disconnected, I was not able to see & experience the stuff going on now. Effective May 2nd at 11:15 p.m. driving from my night job, my SUV shut off at Stop Light. I was able to turn it back on. I figured maybe it’s my air condition & radio running. I stopped using my radio & air condition. After 3 weeks, my SUV stops again at a stop light. I took it to Auto Zone for Computer Check. Results: oxygen sensor. I ordered right & left oxygen sensor from Amazon & took to a Mechanic on May 31 with intensions of him putting my oxygen sensors on. The mechanic wanted to look my SUV over 1st. When he opened the hood, he told me to come here so he can show me something. He showed me my Positive Side terminal to the battery was disconnected. He said this is part of your problem. I watched him try to put the positive side terminal back on & tighten it. It wouldn’t tighten. It broke off while trying to tighten it. He purchased a replacement piece and connected the positive side terminal. He said this should help for now. He told me he will get with me the following week possibly to do the oxygen sensors. I went back to riding Wheels Handicap Van for my transportation because of that and also gasoline running out fast (related to Oxygen Sensor). That night 5/31, after I came home from work on Wheels at 11:30 p.m., I went to pick up pizza in my SUV. After getting out of SUV at Sir Pizza, I noticed the Parking lights on for 1st time since I had SUV. They were STUCK ON – not going off! Manually turning headlights off (no auto shut off) didn’t turn Parking Lights off. Since the Mechanic connected the positive terminal, now they come on. However, they wouldn’t turn off. I figured they have their own button shutoff. I couldn’t find it at that time of night. After research finding where shut-off is (same as headlamps), I realized there is a problem with them shutting off. After returning home from Pizza Place, the Parking Lights would not go off. After 10 minutes, they were still on. I didn’t know how to get them to go off. So, they drained my good battery (dated 12/2021). I just had my battery and alternator checked by AutoZone b4 this. Both good. Some1 jump my SUV in order for me to take to AutoZone for full battery recharge. After 45 minutes of 1 hour, AutoZone told me my battery is not charging. It only charged 11 percent. I had to replace my battery (at KOI, seller) after the Parking Lights drained it. They gave me a new battery for free -- still on warranty.  After replacing the battery at KOI, I started to drive out of their parking lot in route to Exhaust Pro to have them check my SUV. My SUV cut off. I started it back up and tried to drive it. It dragged slowly trying to drive it like the transmission was going out. It cut off 2x & I restarted it on way to Exhaust Pro. After arriving to Exhaust Pro, I told them about the Parking Lights not going off draining my battery & please keep Parking Lights from draining this battery. They kept my SUV over night & called me the next morning telling me Transmission codes are popping up. They also got my Parking Lights to go off – now only go off automatically after 10 minutes. Something is still draining my battery. The SUV is dead the next morning I can’t drive it now.  Exhaust Pro’s report reads the following codes: SP1731, P0731, P0732, P0733, P0734, P0735, C1735. More codes: P0717-Turbine Reverse Sensor; P0603-ECM Backup & Oxygen Sensor Codes. Exhaust Pro said I need new Transmission and the Transmission Place said it’s an electrical problem. If the positive side terminal was connected when I test drove the SUV, I would have experienced all this and not have purchased this vehicle. Disconnecting the positive terminal side for codes not to show up & SUV not to malfunction by a RESET clearance makes a buyer think the SUV is ok for now until the battery is connected! FRAUD!!!!!!!!!

      The vehicle sold was an "AS-Traded" advertised that it had not and will not be put into our service shop for inspection. Which would explain why wouldn't be aware of a loose terminal. Should also mention that Ms. ******** has been in possession of the Pathfinder for 4 months and this the first I have heard of her troubles, I would have been happy to try and be of assistance had I been made aware of any. I would be happy to reach out to Ms. ******** and see if there is anyway that Dan Cummins can be of assistance in this matter.  Our intention when selling a high mileage vehicle is to be very transparent about it's AS-IS status.  As you can see from the attached documents Ms. ******** signed multiple times that this was the vehicle status.

      I am rejecting this response because: 

      I expect Dan Cummins Paris Ky to let me replace this vehicle for another SUV of my choice or give me my money back (I put $2,000 down) to seek another SUV and take this vehicle back after being tricked (FRAUD) into making me to believe this vehicle runs fine. Currently, the 2nd new battery is dead. WHY? Now, the positive side battery terminal is connected, the parking lights come on that didn't and drain the battery dead -- not chargeable and causes transmission codes to show up on computer test which are many as well as Oxygen Scensor codes. This also caused SUV to hardly drive leading to poor operation once positive terminal was connected. I am paying $217 monthly for $7900 I can't drive. With high interest charged, Dan Cummins will have collected $11,000 from me. See following steps to why I am just reporting problem. These are the steps (1-7) that explain why I am just reporting this problem. After Fayette County Schools let out 5/25/22 – 2 weeks later coming from night job at 11:15 p.m., my Nissan Pathfinder stops at stop light. I was able to restart.  (1) I had cd music playing & air conditioner running. I turned both off.  I decided to not run ac & play music any more to see if that helps. (2) I went to Auto Zone on Lane Allen Rd to have them do Computer test on SUV. The results: Needs Oxygen Sensor. My SUV has a Left & Right side Oxygen scensor. The results don’t mention which side. AutoZone recommended I get both sides. The Oxygen Sensor need will help solve why I keep losing fuel quick, having to refuel to full every other day using the half full mark of fuel gage as my empty. The price of Left oxygen sensor is $80 and Right Side runs from $80 - $125 plus mechanic. I cannot afford. I make enough just to pay my house bills, SUV & Car Insurance. I have to save money til I am able to afford parts & repair. (3) I was finally able to get oxygen sensor & purchased spark plugs too. I contacted a mechanic to see if he can do the repair. I went to the mechanic so that he could look at my SUV 1st. He couldn’t install sensors & spark plugs that day. He lifted the hood and saw the positive battery terminal disconnected. He told me to come here so he can show me. I saw. He said, this is part of your problem. He connected the positive terminal trying to tighten it. It wouldn’t tighten. He had to purchase & replace the positive terminal. I drove SUV home. (4) I returned to riding WHEELS handicap van to work & all other places since this is inconveniencing me. Wheels is always late – no matter how early I schedule. I am trying to find new job. Wheels will make me loose my job being late. (5) I get home from night job on Wheels and drove SUV to get pizza. I get out of SUV. The Parking Lights are on & will not go off with other lights. (6) When I checked lights before purchase, all lights worked except parking lights. Now, the parking lights work since positive battery terminal is connected and replaced. Parking lights keep draining my GOOD BATTERY!!!  The battery that came with SUV was dated 12/2021. After having SUV jumped and taken to AutoZone for recharging battery, the battery would not recharge even after 45 minutes of 1 hour to charge back. I had to get a new battery. KOI sold that battery – still on warranty. I was able to replace free. (7) Exhaust Pro does diagnoses. Results of many bad Transmission codes & oxygen sensors. Transmission Tech told me also there is a wiring electrical problem. Now, this new battery is ruin because of Parking Lights draining new battery. I can’t keep replacing battery. Refer to Exhaust Pro’s diagnosis. Exhaust Pro’s diagnosis was attached to complaint & I also emailed **** ***** at Dan Cummins, Paris Ky.  If the positive side battery terminal was connected, this SUV would not have been able to be test driven from Dan Cummins’ lot. The battery would have been dead and OF COURSE, I wouldn’t bought it. It would be JUNK!!! TRICKING A customer like this is FRAUD!!!  I am requiring a replacement SUV. With the wiring electrical problem, it may never work right and I can’t afford $3000 - $6,000 transmission. That is close to what this SUV cost me.

      After speaking  with Ms. ********, I feel for her plight, however the vehicle was sold AS-Traded. There were forms showing that she purchased a vehicle that had never been in our shop , it was also declared very openly that way online that way, we try to be very transparent on these vehicles. I do remember she had looked at more than few vehicles whiles selecting which she was presented with a form in bold  print declaring what we knew and didn't know about her pathfinder. I would however be willing to contribute half the repair bill for her vehicle, to try and help her.

      When I purchased my Chevy Sonic I agreed to also get the LIfetime PowerTrain warranty that would cover cost of certain items if they need maintenance/replacement. In turn, I agreed to receive all my minor auto service and oil changes as Dan Cummins. For the past 5 years I have upheld my end of the agreement. When I took my car in several weeks ago for repair replacement of parts listed on the warranty, (water pump, transmission and motor mounts), I was told only on the water pump was covered and I would need to pay almost $3,000 for repairs. I sent a copy of my warrant with the items covered underlined in red. The mechanic still insisted that they were not covered. It was a service clerk named ****** would worked to get my final charge down to $100. However, my car is still vibrating the same as when I took it in for service. I have left voicemails with Dan Cummins; sent an email via their website; filled out a service survey explaining my issues and requesting that someone phone me. I have not heard from anyone. My car is due for another oil change soon but I am very reluctant to take time off from work and drive and hour to Paris, Ky....trust has been broken.

      We apologize we do not see an estimate that we provided for the 3000.00 repair mentioned, we do see one for 1113.49 which we have attached. We do recall the conversation on that day with ****** and just above the oil pan that was underlined in the customers attached copy you will see it says (if damaged as a result of a mechanical failure of an internally lubricated part) the following items after that oil pan, engine mount etc..would have be covered however they were not damaged as a result of a covered component and we do not see that those items were quoted. We do see that a 200. deductible was paid and repairs made on covered components plus 99.12 for a non covered component and the store covered the labor for that.       and now its having issues going into gear and a noise in the front end so we call and schedule to have it looked at again. they said nothing was wrong so we pick it back up and had it maybe a week or so and had to schedule another check for same reason this time we are told that a lefter is bad in the car and that they also found that the rack and pinion was bad as well, this was on December the 19th for 2021; and our car is still setting at the car lot because it is dangerous to drive. we have tried to do a even trade for another car but no luck for some reason they do not want to lower cars to fix their mistake. they are telling us that the car is worth less then we paid for it but yet they have had it on their lot more then we have had it at our home or driving it, and all of the other products we purchased on top of the car price like gap and a scratch and dent warranty through them we will lose and they are not willing to even cover them on the new car free of charge or even pay tax, title and transfer for us as well. so we a stuck paying for a car that we cant even drive. and have no ideal when the vehicle will be fixed because the part arrival date keeps changing. they vehicles they did show us for trade each one of them had something wrong one wouldn't even start and had rusted paint on it another one had the dash board/ stereo messed up; then we founded a car that we liked that wasn't much of a price difference and they cant make it work seems like whatever they want to offer is the only option, not the customers wants.

      In March of 2021 My wife and I purchased a vehicle from Dan Cummins of Paris. The vehicle was financed through UK Federal Credit Union and we purchased the GAP coverage along with the warranty. March 2022 we traded the vehicle in and attempted to cancel the GAP coverage on 3/15/2022 as we had done before and received a refund for the GAP payments which we were charged for in the final price of the vehicle but no longer using due to the vehicle trade in. UK and Dan Cummins Finance team both advise us that we signed a paper stating that we could only cancel and get a refund if the GAP was canceled within the first 60 days after purchasing the vehicle that we had financed through them. The vehicle was financed for 72 months so not sure why I would cancel the GAP within the first 60 days of purchase. When we were walked through the purchase and signing of the paperwork we were not informed nor shown anywhere where it stated it had a 60 day clause. It would not make sense to cancel GAP 60 days after we financed the vehicle through them. I'm not sure why this isn't explained by the financing staff with Dan Cummins or the Credit Union.

Credit unions in general usually have their own gap policies, and UkFCU is one of those credit unions. We unfortunately don't have an option to write other gap policies at UK. They require their own policy, and because the deal had specific characteristics we were limited on the finance sources. UK was the best lending source by a large margin in terms of what is best for Mr. and Mrs. ***** in the situation. With that said, because credit unions have their own gap policies, we don't have any control on their cancellation policies. We rely on the language in their contracts and questions from our customers on something as specific as whether a gap policy can be cancelled in the future. The Response does not address why the GAP coverage from UKFCU was not explained more by the finance manager. You should dispose all information as such before any paperwork is signed.       On 7/3/20 I purchased a 2012 mustang GT everything seemed fine until 9/13/20 when my car started to have a problem so I took it to Dan cummins to have it diagnosed and fixed considering they sold me a extended car warranty, to find out my valve decided to punch a hole through one of my pistons and they say it's not covered under the warranty and I have been told it because of the exhaust that's on it which was on there when I bought the car, so they sold me a warranty that would cover my car to begin with and now the are trying to trade me out of it into 1 of 2 2021 Malibus they have with monthly payments exceeding 500, I'm just upset that this large of a dealership is considering doing false practices just to make a profit and won't help out considering how long I had the car, and they can't say it is as is because once they sold me that warranty that covered my powertrain there was a implied warranty of merchantability, basically that means that the because they sold me my warranty it basically states that my engine was in healthy condition, and another thing is false advertisement because I was under the impression that my car was a GT premium which is what I was told at the dealership and what was put on my papers I had to sign and it is not a GT premium it doesn't have the leather seats, the 8 in subs that come in the doors of the premiums, and the digital dash that is post to be in there at this point my car has been on the shop for 4 months and I just want my money back because I'm not going to trade into a car that I don't want

I spoke with you and offered to pay a portion of the repairs. When that appeared to be too much, I offered to trade you out into a new vehicle and was willing to put considerably more value into your trade in than it would be worth normally only because we value you as a customer, I might entertain giving more to help you switch, that would however require more communication.       September 15, 2021 took my vehicle to Dan Cummins for an oil change and was told it was leaking around the oil plug, the time before that I was told they lost my oil plug and had to wait 3 hours in there lobby, was told it was fixed. I am now being told its not there fault and it was normal wear and tear on the vehicle. I just want them to fix there mistakes.

The customer contacted us approximately 5,000 and 3 months later due to an oil leak concern. Upon diagnostic the technician indicated the vehicle needs a new oil pan, a $1141.82 repair including parts and labor. The customer declined the repair and stated the oil pan replacement was caused by the previous oil change in September. Upon review the dealership agreed to reduce the cost of the repair out of goodwill to the customer. The customer declined the repair and declined the one time cost assistance offer. It shouldn't matter how many miles or how old or how many changes on the vehicle, there was never an issue with the oil pan before. Dan cummins is the only place I have had oil changes. I sat in the waiting room 3 hours while they "tried" to fix there problem then sent me home. I can't crawl under my vehicle to see the problem so no I didn't take it back until I needed another oil change and then they tell me about the problem with the oil pan. The only reason they lowered the cost to replace the oil pan is because they know that the service department caused this issue, I dont think I should have had to pay anything to fix there mistakes. I will never take my vehicle back or do any business with Dan Cummins.

      This is a professional complaint. In April 2019 I purchased a 2015 jeep from Dan Cummins, Paris KY. It was my THIRD, yes THIRD vehicle that I have purchased from them. I have had to take it back for repairs too many times to count, some of which I had to take back a SECOND, yes SECOND time: I put $6,000 down on this car Now I may not be the sharpest tool in the shed but I do believe that a certain percentage of business is from repeat customers. A customer who would return to any business is a satisfied one. That is no longer true in my case. What has occurred is UNACEPTABLE! Even more so that **** ******* made a very unprofessional comment to me " Good thing you bought an extended warranty", almost laughing about it. Don't they do a 21 or whatever no. point inspection. I been telling them from the beginning that this car has been under water. If it had been checked they would have known. They sold me a vehicle that they KNEW was a junk. Unacceptable! I may have purchased 3 cars from them but no more. I did a professional review but the owner wont respond. Enough said.
