We agreed to a contract on 06/26/22 with JDA. On 11/26/23 we still don't have a certificate of occupancy because builder walked off the job after failing the final inspection and did not complete while still owing us money. JDA never supplied sub contractor invoices for work done or materials charged to us as we have asked for months. No proof of what subs and vendors billed JDA, only what JDA invoiced us. We had 2 liens on our house which we paid on one (HVAC) and **** refuses to pay on the other. **** would draw funds from our loan and then not pay the contractors in a timely manner (months in some cases) or his checks would bounce. Several contractors then refused to work on our home or would only work directly through us. Some subcontractors were subpar and didn't complete the work according to code. **** was hardly ever on the jobsite so we had to have family member show up to inspect work done as we live across the country. We had to hire several of our own contractors to finish the job as we lost all confidence with ***** *****s estimates were not even accurate, some were under budget by thousands ,and still have issues pertaining to Electrical overloads, broken tile, cracked brick and interior walls and doors that will not close. Several items on list not done all together like a build out for dining room- ignored. Grids on windows- received no grids, the list goes on. Too top it off we were on **** for over 6 months to address grading issues and constant crawl space flooding that resulted in MOLD. **** still refused to remedy the situation correctly so we had to hire our own contractor to remove the mold. His attention to detail and accounting is horrendous. We are 1 customer of many we have talked to that have had and still do have issues unresolved w JDA. Do not use JDA builders to build your outhouse- You will regret it. 5 houses in Poplar Grove alone have legitimate complaints. Read complaints at licensing board. **** has excuses, DO NOT USE JDA.Business Response

Home owner breached this contract many times by negotiations directly with subs for service and scheduling. In addition to this, the brother caused several issues in communication with subcontractors as well as JDA. He was guilty of threatening subs, cussing at subs and sending late night harassing text messages and emails to JDA and family members. Initially the buyers apologized for his attitude and messages. Once they became personal including family, home and school did JDA decide to finish up what was agreed to on the items to finish on the house and then drop the permit. The certificate of occupancy is the responsibility of the new permit holder which is the same individual who sent the harassing messages. When JDA dropped the permit there were no liens on the home and all obligations with subs were settled with the exception of the topsoil delivery bill which the homeowner refused to pay. Same happened for work performed by concrete sub which JDA paid to keep the peace. JDA wants for every homeowner to be happy with the process but is aware this will not always be the case.Customer Answer

I signed a contract on 2/22/2022 with JDA to build a home in ****** ********* ************ JDA would build the house and I would purchase it once complete. We closed on April 21, 2022. A lien was filed on 5/18/23 by the HVAC company due to non-payment. I paid JDA the full amount stated in our contract. JDA is responsible for paying the subcontractors he hired.Business Response

This issue has been resolved. Payment was made to the HVAC contractor once this was known. Somehow this bill was lost and JDA Construction did not know there was a due balance. The check for this invoice was originally left for the subcontractor at the house shortly after service was completed. It was never picked up and must have been lost or moved by other subcontractors working in the home.Customer Answer

I have reviewed the response made by the business in reference to complaint ID ********* and find that this resolution is satisfactory to me. However, his explanation is a lie. I spoke with the HVAC company several times. My house is just one property that a lien was filed against.

On April 21 we met with this builder to discuss building a residence. We were shown homes and designs in our price range. We Indicated some specifics that were important to us and we were assured the lot and build was max $500k. Similar homes to our specs are between $400 & $500k. We were persuaded that we had to give a deposit on our lot, which we did in good faith. The builder then required us to have his engineer draw the plans. We took out cost and added cost that offset and the builder was involved in the planning phase. After we paid the engineer $573.54, the builder then provided a draft contract to build which was $603k. This is not a $600k home and we respectfully requested our money back. The builder and his cohorts, ********** Real Estate and ********* *********** are refusing to return our deposit. We were misled and fraudulently scammed by these people and we are seeking a return of our deposit of $14,180.Business Response

In response to Complaint ID: ******** filed against JDA Construction by ***** *******
I believe **** ****** misunderstood the role of JDA Construction in the process. Our role was to discuss with the client the needs and wants in a new home they were considering to build. In the meeting it was explained that the minimum sqft allowed in the subdivision was 2400 soft and that typically that falls in line with the budget they wanted to be near at that time. JDA connected the client with the engineer to have their plan drawn custom to them. The plan came back at over 2600+ sqft. I use the plans to gather quotes from suppliers and subs. Once this was done, the larger home and the increase in market pricing for materials and labor landed at a cost of $603,000. This also included certain features in the home which are not standard build features per their request (encapsulated crawlspace, screen porch, two sump pumps, etc). This is where my role ended with them at that time.
As for the deposit they placed on the lot with the investor, who was set to finance the build for them, that was never held by JDA Construction. No contracts were in place with JDA Construction and the ********. That was all between the investor and the ********. JDA did not receive any portion of the deposit as it all went to the investor who owned the lot and was prepared to finance the build. Whether JDA feels the deposit should be returned or not is irrelevant.
I do wish this had turned out differently but it was ultimately out of the control of JDA. I can only base pricing on current market for materials and labor and at this time both were at unprecedented levels.
I do wish the ******** the best and hope that they understand that any attempt to keep their deposit was not due to JDA Construction.

I am rejecting this response because: At the time that we met with JDA, it was presented to us that JDA, the realtor, and the lot owner (referred to as investor), were one team working together, not individuals. We specifically asked about their inter-relationship and there was no question as to their answer that they were all involved as a team.We included everyone on our engineering specs as changes were made. As we did add things that were important to us, we also took out cost to bring more balance, but we were prepared to pay up to $500K with a base model price quoted around $460K. In addition, we very specifically stated that we were not interested in getting into a transaction that would end up costing another $100K. Ironically, even though we were assured that was not how they worked, that is exactly what they did to us. Since they were involved in every step of creating the plans and they never interjected that our changes were $100K over our agreed upon price. In fact, we had to pay an engineer to draw up the plans and everyone who was included said nothing. We communicated frequently and return communication was slow, at times we had to contact them for answers.
We expect this team of people return the deposit we gave them. They have built another home on the lot which we made a deposit. Therefore, we are due a complete refund.

We are all separate entities and JDA never held any portion of the deposit and JDA was not owner of the lot. JDA was responsible for giving best information possible at the time and only when final drawings are completed can they be quoted. JDA priced the home according to the drawings provided. It is the responsibility of the investor/lot owner to whom the deposit was made to consider any refund that is due.
I request that the ******** provide a copy of the deposit contract/agreement to the BBB for consideration as it will show that JDA is not listed.
As mentioned previously, my role was to price and build the home. It was explained that a 2400 sqft house on that lot would be reasonable budget of $500k. However, it was decided by homeowner to go 200 sqft larger and add many extras. I understand that once you received your price that you did not want to proceed. Completely your choice. However, at that point, I was no longer involved. Any refund or further negotiation was to be between buyer and investor who the contract was with.
Also, JDA is no longer working with the investor and was not part of any build on that lot.
