    After several attempts to resolve a warranty claim regarding my concrete patio pooling water due to incorrect installation, I am seeking the assistance of BBB to get this issue resolved. I first reported the issue within the warranty window and began working with someone in the warranty department. A few other items were fixed, but this matter was not. After several calls and attempts to reach this person, to no avail, I let the matter rest for some time. About 3 months ago I began again trying to get TK to replace the concrete patio. I got ahold of a new contact and began getting some traction after first being question on why I had waited so long to contact them. He then admitted that it was their fault and he saw my prior attempts, but the individual previously handling warranty work was no longer there. He agreed to send someone out to inspect the issue. That individual inspected it, took photos, and agreed there was an issue with how it was installed. That was in early October. Since that time I have left multiple voicemail with the warranty department, along with the main office receptionist, with no return calls. This is the second time my matter has reached an inconclusive end with TK. Their inspector that came out verbally agreed their was an issue, but I have yet to recieve any communication as to how they intend to resolve it. My request is that TK contact me to explain how and when they will replace the concrete patio. If this is denied, then I will proceed with small claims court or seeking legal services.

    We did an inspection of the patio on October 10, 2024.  They took pictures and reported back to us that the exterior concrete patio slab was well within industry standards and that no further action is warranted.  It was our understanding that this message was relayed to *** ***** at the time of inspection.

    I am rejecting this response because:

    If they thought this had been disclosed to me, then returning any of the numerous voicemail left would not have been an issue. See attached screenshot from the gentleman from TK that did the inspection, he clearly didn't know that TK thought this was an acceptable patio install. If TK is going by the opinion of the gentleman taking the photos, he agreed there was an issue with water pooling and the slope was not allowing water to runoff away from the home. He also admitted this was dropped by TK with multiple changes to staffing in the warranty department. I disagree with this being acceptable construction standards. Please have them cite those standards for my review. 

    If this matter cannot be resolved by TK, my next steps will be to utilize online reviews including photos, file a small claim court application, and then seek attorney representation if needed.

    We built a 4 Bedroom 3 bath house and since completion our 3 toilets haven't worked. The first time one was used it didn't flush anything down and clogged with just urine and toilet paper in it. All 3 toilets are having problems with clogging due to toilet paper. We tried other toilet papers and nothing works. They clog and fill to the top, so we have to ensure any smells or orders until the toilet has a little less water so we are able to take a plunger to it, its disgusting. We are unable to put toilet paper in the toilets, we have to put toilet paper in trash cans, which is absolutely barbaric and unsanitary. We have called and spoke with numerous people with no resolution. They just brush us off or say they will send someone out and no one ever comes.

    TK Constructors built my house in 2019. Immediately following the home being built, I contacted the HVAC installer due to concerns for the HVAC system constantly running. They came out twice within the first year of living in the home. Both times, they minimized the concern and once replaced my thermostat. I knew something was wrong with the system but trusted them and didn't pursue further. In August 2022, the AC completely stopped blowing cool air. After contacting a more reputable company, it was determined our compressor needed replaced. Despite the part being under warranty, this cost us over $1800. In April 2023, our heat stopped blowing hot air. This time, it was determined our defrost board and temp sensor needed replaced. This cost around $800 despite parts warranty. Now, June 2023, our air is again not blowing cool air. This time, our inside coil needs replaced. Despite part warranty, this will cost over $2000 to repair. The HVAC company we are working with suggests a new system due to concerns for the unit not being properly installed.

    Tk Constructors was not made aware of any issues with the HVAC unit installed by Airtron in the home we built for ******* ******* until we received this complaint on Monday June 12th, 2023.  We contacted *** ******* and learned that she had contacted another company to do the work on her HVAC unit.  If we had been made aware of the issues with Airton earlier, we would have been more than willing to help her through the process and hold Airtron accountable.   Because we were not given the option to participate in diagnosing the problem or holding Airtron accountable, we will not participate in paying for the solution.

    We signed a contract with TK constructors to build us a house, we were verbally told that TK would start August 1st 2021 but then were given a Sept. 13th 2021 start date at the final details meeting on July 2nd 2021. TK broke their contractual obligation to start Sept. 13th 2021 and never even attempted to start on or around that date. No one at TK even bothered to schedule a custom concrete company to start our house, until after we reached out on Sept. 13th asking why no one had shown up at the job site. **** ********* then lied to us claiming that their basement guy had quit, even though no prep work had been done either. **** ***** later confirmed that they had lied to us about the basement guy quitting and confirmed that they had not scheduled the job to start. They didn't start until Oct 18th costing us 5 additional weeks and delaying the completion by at least as much since it put us into winter months. They knowingly used a trim carpenter that had been screwing up other peoples houses, he screwed up our trim multiple times, and damaged our cabinets. Both **** ********* and ***** **** told me that they were already having trouble with the trim carpenter before using him to work on our house. **** ********* ignored us and allowed painters to paint and caulk the screwed up trim to the wall causing the walls to be damaged when the trim was finally replaced by a different trim carpenter. Making the trim which should have taken 1 week to take over 6 weeks and forcing us to wait for replacement cabinets for over 10 weeks. We had 2 walkthroughs during the trim work disaster, during the first walkthrough **** ********* mocked disabled people and during the second walkthrough **** ********* became agitated and started yelling at my wife, she told him to stop but he kept yelling and acted like he was going to fight her, I stepped between them and told him to leave multiple times but he wouldn't until *** **** told him to leave.

    I have added the contract as requested along with a few change orders, the first change order is the most important it is the one where we renewed the contract in February of 2021 at an increased price.

    TK Constructors, Inc. is building a home for ******* * ***** ********. ***** **** our ******** ******** in our Louisville region and *** *********'s direct supervisor gave me the following information. 

    After the Pre-Construction meeting with the **********, ***** **** filled out the lineup sheet for the project, listing ******** ******** as the basement contractor. A purchase order was created for ******** ******** and a blueprint was sent to ******** ********. Prior to our final details meeting with the ********** ***** **** contact ******** Builder to inquire about a start date. He was it informed it would be the week of September 13th, which was passed along to Mr. And Mrs. ********. *** ********* reached out to ******** ******** just before the start date to confirm the date, as TK had to install a temporary drive and schedule an excavator to dig the basement hole. At that time *** ********* was informed that ******** would not be available for two months. After reaching out to several basement contractors, TK chose Custom Concrete (located in Westfield, IN) because they could start in five weeks. Had ******** ******** informed TK of the delay sooner we could have possibly contracted with Custom Concrete sooner. Unfortunately, due to supply chain issues and more importantly the extreme labor shortage in the housing industry these types of delays are common. This is the reason TK quit giving customers a completion date. The completion date on final details meeting check list signed by Mr. & Mrs. ********, was intentionally left blank. 

    On the line up sheet, ***** **** has listed **** ******* to do the trim work task. **** was in the process of taking over his father's business, who had trimmed houses for TK for over 20 years. The cabinets were installed and upon closer inspection, it was noticed that they had a factory defect. New cabinets were ordered from ***** ****** and the order would take 8-10 weeks for the new cabinets to arrive. 
    The cabinets were not damaged by ****. A few mistakes were made along the way, but **** was always willing to come back and fix them. These repairs were not acceptable to the **********, so a different trim carpenter was hired to finish the work. In order to keep production moving forward while waiting on the cabinets and the damaged trim pieces TK decided to keep the painter on schedule since if would not affect the trim repairs. 

    It is my understanding that all repairs have been made and the ********** will be moving into their new home has soon as the bank processes the final draw request.
