A wet ink signed contract between me (********* **** *******) and Transfinancial does not exist to obligate me to pay them anything. According to Privity of Contract, a contract cannot confer rights or impose obligations on anyone who is not part of the original contract. HIPAA (Health Insurance Portability and Accountability Act of 1996) also grants me the right to prevent third parties from accessing my medical records or privacy information. I do not recall giving ***** ***** ******* ******* ****** permission to release my medical information to a third party (Transfinancial Companies). I ********* **** ******* prepared this form. I am rejecting this response because: I never received a contract between me, ********* **** ******* and Transfinancial companies that I owe them and wet signed by me. Privity of Contract, a contract cannot confer rights or impose obligations upon anyone who is not a party to that contract.
Only the original parties to the contract are directly bound by it.

I am writing in response to ******** ******** ******** ** ********** **************************** regarding my complaint (ID 21922982) against Transfinancial Companies. I am filing a complaint against Transfinancial Companies for reporting a debt on my credit report that I do not recognize and for which I have not been provided adequate documentation to verify. Despite my request for verification through a certified letter, I have not received any original contract or proper documentation from Transfinancial Companies to substantiate this debt. Instead, I received a Health Insurance Claim Form from ********** ********** ******** ** *** ***** ******* ** **********. This document does not demonstrate that I owe any debt to Transfinancial Companies. As such, the reporting of this debt on my credit report is inaccurate and has negatively impacted my credit score. Under the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA), the burden of proof lies with the debt collection agency to validate the debt, not with the consumer. I request that Transfinancial Companies provide proper validation of this debt or remove it from my credit report, as per my rights outlined in FCRA section 623(a)(1)(A). Additionally, I requested verification of Transfinancial Companies’ authority to collect this debt under the FDCPA. They have only provided validation of the debt without addressing my request for verification. This discrepancy raises questions about their legal standing to pursue collection on behalf of the original creditor. I am hopeful that we can resolve this issue swiftly and fairly. However, if it is not addressed satisfactorily, I will escalate my concerns to the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). Please find attached the Health Insurance Claim Form that I received, which further supports my position.Business response

It says it was opened on 3/24/2023 for $746 with account number starting in C1OHC1************ that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. It says it was opened on 4/28/2020 for $1,191 with account number starting in C1PEM1************ that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. I have been disputing a collection with TransFinancial Companies and have sent 2 certified mail letters thus far and am sending a 3rd letter today. The first letter I mailed was on September 7th, 2023, followed by a response after 30 days on the date of October 26, 2023. I have attempted getting on the phone multiple times with them to discuss and have not have any lead way. They claim they can't find me in the system they have but somehow can report to my credit that I owe a supposed amount and also send a response including the account number along with a bill. I sent an additional letter on 12/1/2023 in which I have not received a response. TransFinancial Companies has violated HIPPA laws. The collection agency mailed proof that they have violated HIPPA laws which I will attach to this complaint. They have violated 1681e(B)Business response

However, it seems that email address has some flaws and technical difficulties. I am committed to resolving this issue as soon as possible. I do not bear any responsibility for the debt you are trying to collect. You and your company are unknown to me, and I have not opened an account with Trans Financial Companies, LLC. Does this alleged debt have any purchase receipts, payment transactions, or agreements between the parties listed above? In accordance with the Fair Debt Collection Practice Act, you are harassing me, trespassing on my property, and violating my rights. Please cease all communication with me including the address listed above.
