      Took $15k deposit for post-Hurricane Ida roof repairs and replacement, but abandoned the job and contract and kept the money. Nearly $12k of the money was for a metal roof package (6-8 week delivery) that turned out to have never been ordered. The metal company does not even have this company as a customer and never has, and their metal orders are delivered weekly, not 6-8 weeks. It is the day after the 2+ month repair (<1900sf house) completion date and still no roof, and the new plywood decking is getting wet on all 8 sides of edges, and warping. I have lost two month's time and living in a spare bedroom on a cot in my 60% gutted and not "dried-in"house. (contract says the house would be dried in by January 20 and I could begin interior repairs, but it never happened.) PLEASE LET ME KNOW IF ALL 15 DOC PAGES CAME THRU AND THREE PHOTOS OF THE CONDITION IN WHICH MY ROOF WAS LEFT. NOTE: There is no metal on my roof. Just plywood with underlayment. Mr. ****** would never giver me a materials list, a promised plan in writing on how he would repair or finish the eves nor a copy of the metal order, which I requested, in writing, multiple times. He refuses to finish the job. He has been trying to make me angry so I would fire him for weeks, but I would not let him get to me. I expect him to honor our contract. 90% of our communications is in writing (text and emails.). It should also be noted that Mr. ****** has lied repeatedly throughout these 2.5 months and even when he was still working on my roof, his crew seldom showed up...even on fair weathered days. Mr. ***** has been informed of the situation in great detail and has ignored most of my attempts to reach out to him since. He has not offered to assist in fulfillment of the contract and has no rationale for his partner's behavior. He has turned his back on me. I've only spoken to him once. Other (mostly one-sided) communications have been in email.

As you know, there were unforeseen circumstances on your roof which necessitated additional work, such as re-designing your roof framing, removing and replacing over 1300 linear feet of wooden rafters, and over 2500 square feet of plywood; some of which can be seen here: ***************************** When you were asking me to fabricate a fraudulent estimate for a shed that you stated you had no intentions of building, using numbers that you came up with, you belittled my offer to use Xactimate to estimate the fair cost. You indicated that Xactimate estimates are too low and that experienced contractors would charge more. You stated that you "want to be sure they your insurance company get hit hard on the shed to make up for the loss of your fence, which they denied coverage for" and so Xactimate pricing would be too low for your means. Using conservative numbers, Xactimate estimates the services that we actually provided on your home to be worth over $24,735. Our out of pocket cost to date for your project is well over the amount of your $15,000 deposit, and all of the services and materials provided were quite necessary. It seems to me that your attacks on my character and reputation must be a ploy to get out of paying for the work that we did. I would like to note that the first date of this complaint is 3/23/2022 and that your desired resolution is "Finish the job." However, as early as March 2nd, you were publicly calling me a thief and a liar and warning residents in your area not to do business with me. Why would you want a liar and a thief to do work on your home, especially when he's as incompetent as you say that I am? Furthermore, what self-respecting contractor would even consider doing work on your home after you publicly accused him of these things, and especially when you already owe him over $8,000? These are some more examples of discrepancies in your communications to add to the list that you already received. I don't know what "metal roofing company" you refer to, but if you're talking about the manufacturer of the Image II panels, that would be Metal Sales - the nation's largest manufacturer of metal building supplies. They do not serve small roofing companies who order one roof at a time; and the definitely do not produce custom green metal roofing panels in a week. That concept is unheard of and laughable. No, we are not clients of Metal Sales Inc, but have relationships with roofing suppliers who provide our supplies acting as the "middle man" in the industry. We got bids from 3 different suppliers and then modified the order with 2 of them as the dimensions of your roof changed, which has already been explained to you. You say that I and my crew "seldom showed up," yet over 385 labor hours were logged on your roof, around rain days and delays and including a respectable helping of unforeseen circumstances. I did not abandon your project; I explained to you that we must be able to communicate in order for me to do the work. You stated your refusal to talk to me, stating that I am "impossible" but didn't explain why except to say that I "threatened to record our phone calls." I enacted the phone call recording policy due to your verbal abuse, contradicting statements, and threats against me and my company. I am not the one who built your house using inappropriate mismatched materials, did not drop a tree on it, and did not write the building codes that require properly addressing those defects. It is disheartening that attacking me publicly is the route you chose to take when it came time to pay for the necessary work that was done on your home. I noted your pessimistic, rude demeanor before we even had a contract, when you felt that I should have produced your estimate during the holidays instead of spending time with my family, despite me telling you that I did not have figures from my suppliers yet. Then once a contract was produced and you continued to insult me and my company, I questioned whether it was a good idea to move forward, consulting some of my peers about it. Believing that you were unhappy because of the condition of your home, I thought that by taking this job and your abuse with it, I might be able to affect positive change for you in the long run. I still think fondly of the notion that you might have your home back soon and finally be at ease, and I hope that it happens. For months you belittled and berated me, sometimes past midnight, while I continued to respond as professionally and positively as possible to your sarcasm and inconsolable discontent. Now, nearly half a year later, $9,000 in the hole, reputation and character under attack, and having to spend my time dealing with your accusations, I must thank you for providing me opportunities to exercise patience and grow in character. I wish the highest quality of life experience for you, and thank you again for the very unique opportunities you have provided for my personal growth. There was never any suggestion of contractor fraud. My insurance DID pay for my downed fence but I chose to use the insurance monies for the destroyed shed to add fence to the opposite side of my property instead of building another shed, which I no longer wanted. This is perfectly legal and I only asked Mr. ******, who was promising me a bid on my shed but not following through, typical, to please just do a quick bid without wasting more time with his "program." I didn't care if the bid was on toilet paper. He knew I was in contact with a supervisor after months of struggling with insurance, and while I had this man's willingness to help move my claim along, I needed to get the bid in. We did used a price based on the size of the little shed, making sure to consider the high cost of materials these days, and both quickly agreed on a fair number. Mr. ****** produced the simple, short bid and the supervisor signed off on it immediately. Somehow, this man doesn't seem to understand that there was nothing illegal about this and my beautiful fence on the opposite side of the property was built from those insurance funds and is even fully insured by my insurance company. He keeps trying to attack MY CHARACTER with this lie and claims of verbal abuse, and such. NONE OF THIS IS TRUE. Mr. ****** took my $15k deposit, under the premise of immediately ordering the 6-week metal (yes, I explained to the company rep exactly what metal I was getting and they said that's ridiculous, there is no such thing as a 6-week delivery as they deliver their orders weekly. They were emphatic about never having to wait more than one week tops for a metal order.) Notice ****** never states where he ordered the metal if not from this company. That's because he misapplied my funds (breaking the law of R.S. XX:XXX.1 of contractor fraud.) I'm not even going to dignify each and every one of his allegations and statements other than to say he has lied through his entire statement, even promising me to send me his bid on Christmas Eve, the very next day, after coming to my home. That was not my choosing and I said although I've already waited four months for a roof, I expressed I understood it was Christmas Eve the next day. I, in fact, gave him extra time to put the bid together, but then he kept dragging his feet thru New Year's Day. I paid ****** electronically (multiple attempts with many problems, on his end, but he didn't want the check I'd already written, because it would take too long for his bank to clear it) and he told me weeks later, he was late getting started because it took 8 days for the electronic payment into his quickbooks program to reach his bank. The contract reads that I was to make payment, which I did on January 5, and then a materials list would be submitted and approved by me on January 8. I never received a materials list. On January 10, the contract states the special materials order would be placed and paid for. On January 12, phase 1 of the work was to commence. This would be the carpentry side of the work while waiting for the metal package to arrive. This was a custom cut, special color, standing seam complete metal package.On January 20, I was promised that the roof would be dried in and ready for interior work, such as sheet rock, could begin. Although this is how the contract reads, the roof was never dried in, as Mr. deed or abandoned the job before even finishing phase one, which was weeks behind schedule. Mr. Dieter expressed some unexpected issues he would have to address and would get with someone more knowledgeable and would let me know what that game plan would be for addressing this issue which involved the eaves and he expressed A need for 20 more sheets of plywood. Mr. ****** never asked me for any further funds at this point nor gave me a cost. It was not time for me to make a next installment on this project because the work had never reached the level of the next installment. Nor did Mr. Dieter ever ask me to make another installment. I began to notice a pattern mid Feb whereby Mr. ****** was seemingly on a precise mission to make me so angry that I would fire him or give him legit cause to walk away from the job, as he realized he wasn't qualified to do the job (two flat metal roofs, no gable). I stayed on the straight and narrow, before and after this, recognizing what he was up to. I was in no way EVER ONCE abusive towards this man and only communicated with him via phone/text/email, most of which, by far, was in text. Therefore, I have proof of at least 90% of our communications after his first visit to my home the evening before Christmas Eve. Mr. ****** comes off as very charming and honest and concerned about your situation but, all the while, stabbing you in the back with his fraudulent actions. I feel sorry for this man, because I sense that he lives in his own little world and believes his own lies. To reiterate, Mr. ****** never finished the carpentry work on my roof, left my roof leaking and without any metal order on the roof or on the property at all, and his quality of work was so poor and so confusing that roofing companies would refuse to come behind him to complete the work he started. It took months to finally find a company that would work behind him and still warrantee the work and complete it within four days with their own metal order that arrived in less than a week, and I finally had a roof 7 months post Hurricane Ida. Of course, I had to pay the second roofing company all over. Because of the metal package having never arrived, and Mr. **** are not fulfilling his contract of a nearly $29,000 job, I was unable to get the higher grade "special order" metal and my r-panel roof and repairs ended up costing over $40k, and my house has only 1800ish sf of living area. I almost have to laugh when I think about how Mr. ****** says I was so rude or difficult or whatever he said that he wondered if he even wanted to take the job. If that were the case, why would he take the job? What reason would I have to be rude to him before he's even given me an estimate.Wouldn't I want to be very nice and kind because I want him to be fair on his bid and be interested in taking my job I so desperately need done? Why also with the man contact me to ask if I drink coffee, after the job was started. (I thought this was an odd question because it sounded like he was asking me out for coffee. Or, why would he reach out to me to ask if I liked King Cake because he wanted to buy me one, which I kindly declined, as I did not need a whole King Cake for one person. I thanked him very much, both times. (Perhaps he got his feelings hurt because I didn't take him up on his offers, that struck me as odd, since I didn't know this man.) To summarize, Mr. ****** has broken the law and is trying to justify his actions and his breaking of the contract by doing anything and everything he can, regardless of how many lies it takes. Yes, I did give my honest opinion in reviews and on Fb to warn others. No, I wasn't crazy about having to further communicate with Mr. ****** and deal with his lies (he even got lost in his own lies about when the crew was/wasn't on the job and got caught doing so), but I had no choice. I respected the contract, plus the law required I wait 45 days of "no-show" by his crew before I could bring in another company to finish the job, or I would lose my right to criminal charges. I'm reminded that Mr. ****** texted me that his crew had made huge mistakes on my roof and he claimed he was firing them. (I have every communication in text that we ever had.) I got to where in the end, I would drive by and see if anybody was working. . There were days when I was told by ***** the crew would be working but they were not and it wasn't because of rain. I never stopped and spoke with the crew Because I did not want to disrupt their work and ***** is such a chatterbox that I knew if I stopped I would be stuck there for an hour or two as I was in my driveway the first evening he ever came to my house. But, I communicated regularly with him on the status. I just hung up with the district attorney, ***** *********** as we discussed the criminal aspect of this investigation. As I expressed to him, it would seem on a criminal level, Mr. ****** would have long ago proven that he placed and "paid for" my metal order on 1/10/22, as required in his contract. The fact that no metal order invoice has been presented, further shows this man broke the law by never applying the nearly $12k to the metal order purchase. This is in violation of La. R.S. XX:XXX.1. Pretending he spent money on other things (exaggerating numbers, adding unnecessary work because he actually didn't know what he was doing, and lying that I was rude or verbally abusive to him, does not negate this fact.)
