I signed a contract with ****'s Superior Construction and put down a deposit. I backed out of the contract due to a stroke that I had last year. I notified **** via text on July 14, 2024, that I was backing out of the contract. **** acknowledged on July 20, 2024, that he'd pay me the deposit back "Don't worry I'll get it to you next week and we'll take care of the back too (missing a hardy board that still isn't installed). I need to get that dumpster out of there too. I'm still waiting for the hardy board to be installed, a gutter leak fixed and my deposit. The contract states that the company (****'s Superior Construction) has 10 days and can keep up to 20% of the deposit. Well, we're 10 months and I still haven't received a *****.Customer response

****'s Superior Construction installed a new flat roof on my home in January of 2019. I have done business with **** several times and was always pleased with his work. On September 26, 2023 I called and spoke with **** and told him there were three leaks in my ceiling - one in the living/dining room, one in my bedroom and one in the entrance hall. He said he would come out that afternoon to take a look. (We had had a very bad rainstorm a couple of days prior.) He did not come to my home or call. I called him again on September 28 or 29 and left a message. I called again on October 3, 2023 and left a message to return my call. I called again on October 9, 2023 and left a long message, this time about what I believe is going on here. My contract states that I have a five year warranty on workmanship and ten year warranty on material. Evidently, **** does not want to honor the warranty. I told him that he was being unprofessional and dishonorable. I did not expect this from him.Customer response

***************************The business claimed to have gotten in touch with me to come repair the leaks on 12/2/2023. The business DID NOT get in touch with me and DID NOT do any leak repair work on my home. The business' response was a lie.

After Hurricane ***, I contracted ****'s Superior Construction based on my prior experience with them. The job replacing the roof has been satisfactory. They were also replacing the deck covering due to the storm. After a rain, we reported that the deck covering had a small leak. The Company came out and re-caulked. After the next rain, we reported it again and they re-caulked. After several more rain storms we reported that the deck cover was still leaking and worse than before. The company came out and watched the video to show the leaking. We were told it could be fixed and the white cover, which is not what we wanted, could be fixed and painted to help with the sun exposure. We did not hear anything else. I contacted the company, with no response. We had a rain storm a couple of weeks ago and I reported how badly the leak was. No response at all from the company. Yesterday December 14, we had another bad rain event. I called during the storm and expressed my displeasure with the company. I said I did not want to talk to the owner because I had enough with him avoiding my calls. He could have called to previous complaints and said he could not fix the problem. My request is to refund the $887. I paid for this portion of the job or recommend someone that can repair it properly and the company pay for it since he can't. I have videos, but don't know how to attach them.Business response

I am writing on behalf of my Mother who is retired and widowed. She hired this company to repair her roof and vinyl siding in September of 2021 to repair hurricane damage. The roof was repaired to satisfaction. The vinyl siding work was never done. Per the company owner, ***************************, he was unable to locate a supplier for the vinyl siding that matched the color already on the home - Totally understandable given the supply chain issues. However, after this delay went on for several months and the communications broke off, we wanted our deposit of $2,475 refunded. I specifically made this request via email on June 14, 2022 and I then followed up via certified mail that I can confirm the company received on July 12, 2022. The communication attempts and the check deposited by this company are all documented / attached. Bottom line, we paid for repair work 11 months ago that has not been done - We want our money back. ******************** is not responding. We are hopeful you can assist us so we can avoid having to pursue civil litigation. 12/2/2021 - Paid ****'s Superior Construction (DSC) $1,440 for repairs to my home; Paid half on 12/02/2021 and the remaining balance on 02/01/2022; of which $425 to replace missing shingles on the roof 01/27/2022 - roof work was completed;04/29/2022 - contacted DSC to inform of watermarks in ceiling of my home due to shingle not being secured properly. I spoke with **** and he said that he'd send someone out to repair; 05/05/2022 - I sent pictures via text of inside ceiling and roof and requested that my ceiling needed to be painted as well;05/09/2022 - I called DSC again to see when someone would be coming; I was told "in a few days"05/10/2022 - text **** to alert of upcoming storm happening on weekend;05/16/2022 - called DSC again; no communication, but I left a message;05/19/2022 - called DSC twice this day and left messages; not returning my phone calls or responding to my text;I just want the work repaired PROPERLY and ceiling painted or my $425 back plus $200 to get my ceiling painted.Business response
