The residential driveway paving project suffered from an improper pitch, leading to significant water accumulation in a shallow area. Upon bringing this issue to the companys attention, they executed a patching solution: carving a swale across half of the driveways width. This modification proved both ineffective in resolving the water pooling and aesthetically displeasing. When further clarification was sought regarding the execution of the project (as there had been no opportunity to communicate directly with the owner), the company responded by referencing the contract, stating they could not guarantee a proper pitch. They asserted that, in their opinion, the swale was the most appropriate solution to address the initial issue. If necessary, I can provide further photographic evidence illustrating how the project unfolded.

Asphalt Engineering completed an asphalt repair in front of the homeowner's garage. During such repairs, we ensure that the finished grade aligns with the height and elevation of both the existing garage floor and the surrounding asphalt. These specifications are clearly outlined in the contract prior to the commencement of any work.

In addition, we've already made efforts to improve water drainage, taking into account the property's limitations. For reference, attached is a copy of the signed contract, which explicitly states the lack of pitch in the driveway, in which the homeowner signed off on.

We feel we have gone above and beyond to try to satisfy the concerns of the homeowner, but we were clear and transparent in regards to the pitch needed to ensure proper water runoff.

Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********.

    Dear Better Business Bureau,
I am writing to follow up on concerns regarding recent driveway repaving work performed by Asphalt Engineering company. While I had already raised concerns about two original functional and aesthetic issues with the driveway, I must now report an additional issue that has developed due to the winter season, creating a potential safety hazard.
I have previously communicated these concerns to the company, and on February 2nd, 2025, I sent an email that included visual documentation outlining the problem.
On February 5th, 2025, I received a response from the company owner, but the issues remain unresolved.
I would appreciate your assistance in addressing this matter and ensuring a resolution that ensures both the safety and the quality of the work completed. I am attaching a copy of my original email and the company's response for your reference.

Thank you for your attention to this matter.

    Regards,

     Francesco

    Dear Asphalt Engineering Team,

I hope this message finds you well.

Unfortunately, the absence of a proper pitcha new issue that arose following the driveway repavinghas now escalated beyond a mere functional or aesthetic concern. The persistent pooling of water, which subsequently freezes, despite diligent efforts with manual drainage and de-icing treatments, has created a significant safety hazard. The resulting slippery surface poses a serious risk to both children and individuals employed at the residence.

Given the circumstances, I believe that applying a coating would offer only minimal improvement in appearance, while failing to address the underlying issue or mitigate the risk of water intrusion into the garage.

To ensure a proper resolution, I see two potential courses of action:
1.Repaving the driveway, this time with careful attention to the necessary pitch to prevent water accumulation.
2.A full refund, which would allow me to engage another company capable of executing the work correctly.

I would appreciate your prompt attention to this matter and look forward to your response at your earliest convenience.

    Wishing you a pleasant weekend.

    Best regards,
    ********* *******"

    Hi Francesco,

I received your previous email requesting repaving of the driveway or a full refind. Neither of these options are realistic. We are clear in our contract on what we can and cannot do. We have limited control of the pitch due to the concrete garage floor and the surrounding asphalt. As stated in our contract "No guarantees regarding puddling in the repair or surrounding areas as the pitch of surrounding asphalt determines water flow."

We have gone above and beyond to try to improve the repair area for you.

    Thank you,

We understand that the response we provided may not be what you were hoping for. However, our contract clearly outlines the expectations and terms for the project. Based on these agreed-upon terms, we will not be issuing a refund for the project cost.

Asphalt Engineering installed a driveway for **************. He has since claimed that the driveway was installed incorrectly. The President of our company has been out to the property multiple times, and we have had the makeup of the asphalt tested by a 3rd party. The core sample results came back within that proper range for both the chemical makeup and compaction rate. We have provided those results to the homeowner. Asphalt Engineering has also offered to make complimentary repairs to the driveway although the clients concerns are not covered under warranty, and the homeowner threatened to have both Asphalt Engineering and the 3rd party company arrested for being on the property.
