Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered.

Upon thorough review and in response to the information provided by ASA, I have identified unverifiable in the reported information particularly regarding the amount ASA state that they paid for the default claim on June 4,2010, and the original loan service provider as referenced in the attached copy of ASAs response to me.

In their response, ASA state in paragraph 2 of page 1 that the loan was serviced by EdFinancial and guaranteed by ASA. In my original complaint, I state that I did not have an agreement with ***** Fargo. ASAs response in paragraph 6 of page 2 is that I should contact ***** Fargo directly as they are unable to address those concerns; however, on my credit report ***** Fargo ELT Edsouth is listed as the original creditor. My concern is that during the time frames for the loan as referenced by ASA in their response, the **** had taken legal action against ***** Fargo for illegal student loan servicing practices.

Also in their response in paragraph 5 of page 1, ASA state that on June 14, 2010 they paid the default claim in the amount of $24,077.84 which became my new principle balance. On page 1 of the Previous GA Payment History Report, it shows on June 14, 2010 a principal amount of $24,077.83. This shows that the amount is not verified or validated which is required for them to do by the **** before reporting it to the consumer reporting agencies.

In compliance with 15 U.S. Code 1681s2 after notice and confirmation of errors, it is their responsibility as a furnisher of information to consumer reporting agencies to not furnish information relating to a consumer to any consumer reporting agency if they have been notified by the consumer that specific information is inaccurate; and the information is,in fact, inaccurate.

As such, I am again formally requesting the immediate deletion of this collection from my credit report.

      Thank you,

       ******

I am reaching out regarding some fraudulent accounts on my file. I was reviewing my credit report and saw that American Student Assistance has placed multiple fraudulent accounts on my file. These accounts are not mine and should be treated as such. I have no knowledge of these accounts and are demanding that these accounts are deleted from my credit report as soon as possible. Furthermore, I am requesting that because you HAVE reported yourself on my report that you submit the following information- May you please send me the original contract proving that I had a contract with you all. Being that this account has recently shown up on my file, can you all provide your chain of title and errors and omissions policy number proving that this company is even certified to collect this alleged fraudulent account. If you cannot provide the following documentation to me or support my Identity Theft report showing that these accounts are not mine, delete these accounts.

This is in response of Complaint# ********. This Response you have given me has absolutely nothing to do with at which violations are being committed here*. You keep referring this debt as "My Loan". You keep referring this debt as if I own this debt. For the past few years, I have denied and disputed the validity of this debt. And until this present date you have not shown or presented any validity of this alleged debt. You have not presented me the original loan agreement with my original wet ink signature. You have not presented me with any and/or all loan agreements that i have with American Student Assistance or any Third-Party Collectors with my original signature nor did I ever sign any agreements or contracts with American Student Assistance or any Third-Party Collectors. 15 U.S.C. code ****g (b). Again, let us not deflect the violation at hand here! This is a Closed and Charged-Off account. Therefore, I am requesting a ****-C according to the Aquisition on Abandonment of Secured Property and Cancellation of Debt. It is Illegal to reopen a closed and Charged-Off account as I have sent you the necessary documents that account# ******** is closed and charged-off since 2019. Therefore, I have nothing to do with the Cares Act and the Fresh Start Program. I am requesting the following information: 1) The Name and address of the Third-************************ that's representing this account along with proof of a Valid license to collect in ********. 2) Any and all contractual agreements I have with the Third-Party Collectors with my signature. 3) Full Payment history from original creditor including receipts.4) Please provide documented verification of the month, year and day of my first delinquency. According to 15 U.S.C. **** and 15 U.S.C. ****, I have a right as a consumer to request such information and the debt collector is Obligated to provide such information.

This is in response to the complaint you filed with the Better Business Bureau (BBB) concerning your federal consolidation loan guaranteed by American Student Assistance (ASA). ASA is a nonprofit guarantor for the Federal Family Education Loan Program (FFELP). For information about ASA visit www.asa.org. Effective January 1, 2018, Educational ***************** Corporation (ECMC) is providing services for ASA to support borrowers with their federal student loans. ECMC is an authorized agent for ASA.

ECMC has reviewed your concerns. Our research reflects you filed a complaint with the ************************************ (****) on June 4, 2020, case #******-5099697 and with the BBB, complaint #********, which were responded to timely. Please refer to those responses for details regarding your loan information, ASA credit reporting requirements and validation of the debt. Your new complaint raises two additional concerns. ASA has not provided you with a contract that has a wet ink signature, and the account was charged off in 2019.

You are requesting an original contract with a wet ink signature. Under Rule **** of the Federal Rules of Evidence, [a] duplicate is admissible to the same extent as an original unless certain criteria are met.The copy of the promissory note ECMC, on behalf of ASA, has provided you to date is sufficient to show that a valid federal student loan debt is due and owing. See ************* *****************************, 557 F.3d 285, ****** 6th Cir.2009) (rejecting argument that the original promissory notes had to be produced and noting that photocopies are allowed into evidence as if they were originals, pursuant to Fed. ******** ****.

You also mention it is illegal to reopen a closed/charged off account. As explained in the **** response, when your loan defaulted, Navient filed a claim and ASA paid the claim on June 13, 2019. After the claim was paid, Navient would reflect a zero balance as ASA became the holder of the loan. There is no evidence to support your account was charged off and you do not owe this debt.

Please contact ***************** for questions about your account or to opt-in to Fresh Start. If you have questions regarding this response, please contact ***************, ******************************** and ****************** at ************ or **************
