Greetings, Barkan has been managing our condo community for *************************************************************************************** June of 2022, and was assessed a late fee, which was paid at that time. Since then, they have assessed additional late fees despite the fact that I've paid all my HOA fees ON TIME, and they won't respond to my inquiries about fees and interest they have been assessing ever since then even though I've made payments on time this past year, and I NEVER had any issues with any other company paying HOA's for 14 year at this community or at my other condo which I've owned for 20 + years. I've sent them multiple emails and have spoken with the on site manager and they still won't address my issue. Please REMOVE all the extra fees from my account ASAP. They have been assessed in error, and I need you to stop charging me. Thank you.Business Response

The business did not address my complaint at all. They did reach out to me, however never provided a resolution and never removed the late charges made in error.
Businesses and Customers should be civil, courteous and polite in their responses to complaints. It is important to remain professional and productive when participating in the BBB complaint process.

It should be noted that late fees, collection costs and interest are assessed in accordance with the Associations Collection Policy (attached). In reviewing the information above, it appears the charges were appropriately assessed; however, as an accommodation, $154.83 was waived on your account and you paid the remaining $82.89. Barkan is not authorized to waive, or refund, the $82.89 you paid in May. In accordance with the Collection Policy, you can make a formal request to the ***** to waive the charges. We will present any such request to the ***** once received.
Please understand that Barkan has an obligation to enforce the Associations Governing Documentswith includes the assessments of late fees and other related collections costs. In reviewing your ledger, you will find that your payments were received, on several occasions, after the 15th of the month. As such, late fees were assessed. Please not that a late fee was not assessed in every instance (i.e., May 2022) and the vast majority of these late fees and collection charges have been removed.

The business did not provide me with a written statement based on the April ***** Meeting on April 4, where the ***** waived my late fees, therefore I had no knowledge of what my balance was and additional interest was charged on TOP of that amount. If they had sent me an official notice with the waiver I would have been able to avoid the extra fees and interest added, therefore I request that the extra charges and interest be refunded to me ASAP. Thank you.
