On September 22, 2024, I ordered a full matching suit that appears in the suit section of Nic and ***** website. I work as an attorney and am expected to dress in a professional manner. I ordered the suit to wear for that purpose. The jacket and pants to suits are sold separately by Nic and *** which is usually helpful to the consumer to facilitate fit. After I gave the company my credit card information and my order for the suit in the "***** grid" pattern, I got the attached order confirmation. After I received that, I got an email that the company was unable to fill the order for the pants part of my suit. Then I got an email that both items were on the way. I got an email that both items had been delivered. I checked and had a package. I opened the package and separate bag with the item in it, hoping for the suit I'd ordered. It was only the jacket. I reached out and received the attached email that all they'd shipped was the jacket and information on returning the jacket - at the cost to me, the innocent consumer, of $10. I responded that I'd contracted for the purchase of a suit. it's not my fault their algorithm oversold their stock. I should be made whole and restored to the position I was in prior to their error. They could either 1) ship me the promised and contracted for suit pants or 2) accept the return of the useless suit jacket without charging me a fee for their error in overselling stock. Nic and *** failed to respond my reasonable compromise to their breach of contract no doubt relying on the trouble of a suit outweighing the ten dollar charge. That's just unacceptable. They oversold. They made the error. They should make it right. If company A contracts with company B for widgets and thingies and company A needs the thingies for the widgets to be useful, and company B only delivers company A the widgets but no thingies then company B is in breach. *** and *** breached the terms of our contract and want to charge me to correct it.Business Response

We apologize for the confusing and frustrating communications to the customer. We are pleased to accept the return and refund the customer's delivery fee.
NIC+ZOE did send the customer information on how to proceed with the return, but we have not heard back from that customer as of Sunday. A member of our Care Team will be reaching out to the customer to assist in processing the return transaction.

I ordered a blouse on line based on the photo. The blouse I received did not look like the product photo. The colors of the blouse were much paler than the photo on the website and the fabric was stiff and dull, not shimmery or relaxed. I was told this was a final sale. I was not aware as the sale price was in red but the "final sale" verbiage was in black. Regardless, I did not receive the product that was pictured and should receive a refund.Thank you.****Business Response

order placed online March 25, 2023 using paypal. company placed authorization on paypal which removed funds from account. order cancelled and multiple attempts to contact for the pending authorization to drop. ****** advised the merchant needed to cancel in their paypal system and last email to company on April 6 was someone is looking into it and I never heard back.Business Response

Hello,
Thank you for this opportunity to respond to our customer's complaint.
When our customers place an order, the amount of the purchase is authorized to the dollar amount of the sale. No monies are collected by NIC+ZOE until items are shipped. In this instance, our customer cancelled the order, no shipment was made nor did we receive funds from Paypal. When cancelling, we perform an internal process that includes communication to Paypal that we will not collect the authorized amount, and funds can be released back to the customer.
As of this date, our records indicate that Paypal was informed of the cancellation and the funds have been released to the customer. I apologize to our customer that our internal process delayed her ability to access funds, however I am not aware of how long Paypal then takes to send funds back to the customer.
We hope that this customer will continue to shop with NIC+ZOE.

On/around 2/26/22 I purchased a pair of pants. I paid $147.66. The pants are defective and I do not like the quality of their clothing and would not want anything else in exchange. I want a refund in the original form of payment. The business committed to provide quality clothing and they did not meet those standards. This is not a "normal" return. The pants are defective. I finally had a chance to wear them and they are horrible. The front of the pants are not the same size as the back and if there is supposed to be a slight difference in measurement it is obvious that it is extremely off. You dont notice until you sit down and the side seams are practically on your front thighs and it makes them uncomfortable to wear, restrictive and just odd looking with the seam practically on the front of your legs.Business Response

NIC+ZOE management did make efforts to contact ***************************** twice. Our ability to contact her was compromised based on the fact that she provided us with her office number. When we attempted to call this office number, unfortunately, no one answered the phone and there was no directory.
As for the return, the item was purchased in February 2022 and we do, in fact, have a 30 day return policy. We provide customers 30 days to try on their purchase and determine if they are happy, for any reason, with their selection. We were sorry to learn that Ms. ******** was unhappy with her selection. While we do have a 30 day return policy, in this case we made a reasonable accommodation, allowing her to return the item for a merchandise credit. If you have any additional questions, please let us know.

I informed the Nic and Zoe *** over the phone to call my CELL PHONE as well as in email correspondence (attached). It is evident this corporation dodges issues as my cell phone is plastered throughout the correspondence. The merchandise was defective and again does not fall under "normal" returns. ************ does not take accountability! I do not like their clothing or practices and don't find a credit useful! I again request a refund.
