      Business Response

      Date: 05/31/2023

In response to ************** initial complaint and his subsequent one (# ********) filed on 5/29/2023, my team and I have reviewed ************** file and that of his estranged wife ******************* (f.k.a. *****************************).

************** aunt is employed by our agency and secured two auto insurance policies for Mr. and *************** within the past year.   Mr. and *************** are going through a bitter divorce presently.  *************** has an active restraining order against ***************  ************** has filed an identity theft charge against *************** with the ****** Police.  ************** has asked ** to remove his name from the auto insurance he shares with ****************  We have told ************** that we cannot remove him because he financed a vehicle with ****************  Because of ************** financial interest in the vehicle, we cannot remove him off the policy without the loan and subsequently the vehicles registration and title being amended to reflect *************** name only.

Below is a brief a summary of our findings:

****** was fully aware of a new insurance policy issued effective 6/24/2022 as he personally signed the application in front of his aunt and ****************

In August of 2022, ****** purchased a 2015 Lexus NX with ***************. I attached the dealerships contract and registration application to this email.

On November 29, 2022, ****** cancelled the plates for the Lexus without *************** permission, and requested we remove him from the policy as a named insured.

Effective January 17 2023, the insurance company allowed rewriting of the policy as the illegally cancelled plates were reinstated.

************** became upset with his estranged wife again and illegally cancelled the vehicles license plates on May 3, 2023.  The Registry of Motor Vehicles reinstated the plates again.  The Registry has put a hold on these license plates so that they cannot be cancelled without Registry involvement.

On May 8, 2023, ************** sent an email advising that he filed a police report against *************** alleging that she committed insurance fraud by signing his name to an application.   He also stated that Kaplansky insurance committed fraud for being a part of this.

On May 10, 2023, ************** emailed one of our representatives demanding that his policy be cancelled as ************** believed that it was made illegally without my permission/consent. I am a victim of identity theft and fraud.there is conflict of interest.  The representative advised ************** numerous times that he needed to deal with his aunt or her manager.  ************** continued to email this representative to point where she blocked his emails.

We have advised ************** numerous times and through various mediums that we cannot remove him as a named insured until the vehicle is re-titled and re-registered solely in *************** name.

As you can see, we have had quite a history with ***************  We feel that ************** bitterness towards *************** should not be a reflection of the service we have provided nor the type of business that we operate.  ************** has been a willing participant in any transactions that we have had with him and *************** during the year that they have been insured with **.  All of ************** dealings with ** have been document in our agency management system.

We are requesting that this complaint be stricken from our records.

Should you need further information or documents regarding this matter, please feel free to contact me either by email or telephone at ************.

      Sincerely,
