I purchased my used 2019 *** X5 40i on 2-14-23 through McGee Automotive, which was *** certified. The sales manager *** ****** knew that I was worried about only having a 1 yr warranty & getting cold feet, when he was trying to sell me this vehicle, so he told me that on top of the 1 yr warranty that *** gives me he would give me an additional 2yr warranty- so 3yrs of a warranty in total. I have him saying this to me in text. Now that the *** 1 yr warranty is up I saw that I had no warranty left at all so I called *** & spoke w/ ***** Cedar that strung me along for 2wks & when he didnt call me back after 2wks I called ******** told me at this time that he tried but its not his department?! I tried speaking w/ ***** the service dept manager when I brought my car in for an oil change, he didnt have much to say but sure wasnt going to help me either. I asked for the owners phone # at this ************ chuckled & told me in the few yrs since the new owner took over hes only been in there garage once or twice & that Id never get a hold of him. This past wk my car wouldnt start & come to find out I already had to replace my starter! I called & left a message w/ **** **** explaining that I was calling about my warranty again & I actually got a call back but it wasnt from **** it was from ***** that I had talked to months ago that had told me that it wasnt his ***** This time ***** told me that he promised he would try to get this resolved & that he would call a meeting with himself, ********** & would get back to me by the end of the day or the following day at the very latest! That was a wk ago today & of course no one has called me back! All they keep doing is pacifying me for the moment they have me on the phone and no one ever calls me back. Ive offered to come back in w/ the proof of what was promised from *** that I have in text messages on my phone! They say theyll take care of it.Business Response

We have reviewed the guest's information on multiple occasions. I have done so again, and the documents clearly point out that she was offered a extended mechanical coverage , and she turned it down. Further to that , the start and end dates for the mechanical coverage were clearly marked. At this time she can still purchase some coverage at a discount if she desires.Initial Complaint

I purchased a certified pre-owned VW Tiguan from the business in late August. After a couple weeks, I noticed a mildew smell in the car. I took it to another dealership and they found a leak in the sun roof, which collected water in the interior of the car leading to significant mold and mildew growth. I did several at-home mold test kits, which indicated airborne mold in the vehicle. The other dealership fixed the leak from the sunroof. Because the issue was addressed, all I asked from Berkshire VW +BMW was $200 to get the car detailed to rid the mildew smell. They refused and refused to accept responsibility for the faulty car. Ultimately, I want to flag this to the BBB as this business is dishonest and does not accept responsibility for selling damaged goods (namely mold, a health hazard) to its customers.Customer Answer

I am rejecting this response because:Yes, the dealership sent me an initial $200 in September, when I initially bought the car, because they DID NOT initially detail my car when I got it. I drove off the lot, day of, in August with a dirty car. Indeed, they sent me $200 in September to address it, and I cashed the check.
However, when I learned later (at another VW dealership in Medord, MA) that my car had MOLD in it, I requested with the dealership another $200, around early/mid November. ***, the sales manager, accepted this with the understanding that after I received this additional $200, we would consider the matter closed. I have a voicemail from him on 10/14 confirming this.
However, *** went back on his word, and did not send another $200, claiming that the original $200 (which I was entitled to for getting sent a dirty, undetailed car home with home me) addressed it. This was a classic bait and switch; he did this to discourage me from calling, then lied about it when I followed up so he didn't send the additional $200.
All I am asking for is an additional $200 to detail my car, then I will consider this case closed. I appreciate the consideration from both the BBB and VW of Pittsfield to make this issue right.

i bought a bmw x1 with 124859 miles and paid about 13000. my first time driving the car i heard and felt very loud noises and didnt feel safe driving it. got it tow to my local mechanic. he also does work for the dealership where i bough my car from. mechanic said it was a very dangerous and unsafe care to drive that I should bring it back by tow to the dealer and tell them about it. when brought the car back an extremelly rude tall men said theres nothing they could do. the car he said is an old car and his mechanic said nothing was wrong with it and accused my mechanic to be a lier. my mechanic called him a few times but the manager would not return the calls. the x1 is still in my mechanic shop and the total amount to fix the vehicle is over 3 thousand dollars. i inform them that i would be okay with them just taking the car back or fixing the safety issue the car has they said i was on my own and nothing they can do for an old car. i felt humiliated by this whole thing and now i have not had a vehicle for over a month...had to make payments on a car that is not able to leave the shop since i bought it . i woud like them to either pay the mechanic shop where the car is to fix the car or take this car back as is.Business Response

We were unaware of the situation. The customer took the car to ******************** Performance on ************ St in **********. They told me that there was some play in the front differential and we agreed with Berkshire Performance to cover the cost of the repair.

I Purchased a 2014 BMW 335i with 70,495 miles on April 26,2023 from Berkshire BMW at ***********************************************, from sales rep Karissa F, for $22,000. On Saturday May 20, 2023 car stated to run rough, I open the hood and found a pipe broken off the engine. I tied the pipe back to the engine and drove it home. The same day I called Berkshire but it was Saturday left a message and did receive a call back Monday to bring it in. I had the vehicle towed in on Tuesday May 23. The shop called and said that someone mess with the engine, NO one touched any part or that car. They wanted $900 to fix the problem, we argue and if you ****** that's a common problem with n55 engine. I needed the car so i called back on Thursday and we agreed splitting the cost of repair. When I towed the car in it had 72,328 miles and only owned 3 weeks. I thought the car had a mass warranty 2 months or 2500 miles I did not exceed neither. On Friday I picked the car up the general manager LEO either pay $456 or get lawyer. I believe they scam me, telling me when I was buying the car I had a mass warranty for used cars. I think I should have not paid anything to fix this also they should have to pay my towing bill.Customer Answer

Good morning.
Thank you for your letter. We did inform Mr. ******** at the time that the damage to the part on his car was from a mishandling by somebody, an external influence, perhaps his son who drives the car, we do not know, but it was physical damage and not a part failure.
Afterall, this was a month after he took delivery. If the car had been in that condition at delivery, it would not have run.
But to try and appease the customer and as a gesture of goodwill, we offered to pay half and Mr. ******** agreed that was fair. He instructed us to repair the vehicle. When Mr. ********* came to pick up the car, he and a lady who accompanied him caused a bit of a scene in the showroom raising their voices. At this point Mr. ********* said he would only pay $250 to close the matter my Sales Manager Leo then accepted $250.
We received the same complaint via Berkshire ******** Services Program who closed the matter. We also consider this matter closed.

I am rejecting this response because: No one touched the cars Engine, (That's Berkshire BMW way out) Blame the new owner, It is under mass warranty, 2 Months or 2500 miles. I was told by their service manager to have the vehicle towed in. It was Memorial Day weekend and I needed the car, Leo said, and I do have a witness, either pay us the $459 which I have a receipt or our attorneys can handle it. Also i'm 63 years old i do let my son use the car, If you go to ****** You'll find that part of the engine is the first problem that this model has.
