I am filing this complaint regarding a dispute with **** *********************** Owner of MSF Landscapes for incomplete landscaping services and overpayment. Below are the key details:Date of Transaction: The landscaping agreement was initiated on September 1, 2023.Amount Paid: I was invoiced a total of $54,552.22 for multiple landscaping projects and materials for stone patio, sidewalks, irrigation system, fire pit and outdoor kitchen. The fire pit and outdoor kitchen were NEVER completed.Nature of the Dispute:The first three projects took months instead of the promised weeks. My Certificate of Occupancy for the new home I was building was delayed 2 months because of MSF, so I had to pay for temporary housing. Due to delays and lack or responsiveness from **** *********************** I terminated the agreement for remaining projects and provided notice to MSF Landscapes on November 1, 2024.The termination notice included a breakdown of payments made versus the value of services completed and materials paid for that were never used, showing an overpayment on my part of $12,837.00.Resolution Attempts:I reached out to both **** Forge personally and his business after the termination notice, but they failed to respond or engage in any communication to resolve the issue.Resolution Requested:I am requesting a refund of $12,837.00 for the overpayment. I hope the BBB can assist in facilitating a resolution without the need for legal action. Our contract, dated 5/22/2024, #**** was for landscaping our yard:Clearing, topdressing and reseeding our lawn. Repairs to sprinkler system.Clearing and mulching flower beds. Furnish and install new granite front steps Grub treat the entire *********** plow damage to flower beds and walkways The contract totaled $15,815.31 of which 50% ($7,908.00) was paid up front so the company could purchase materials. The day we signed the contract was the last weve seen of **** Forges of MSF Landscapes, Inc. We have called and texted many times looking for a date for the work to begin. Eventually, we asked **** to cancel the contract and return our money. **** has texted back the work will start in next week, sometime in August, be there tomorrow. **** never addressed the request to cancel our contract. It is clear MSF Landscapes has no intention of fulfilling the contract or returning our deposit.Initial Complaint

May 2 received a quote from MSL Landscaping, after a few edits we signed a contract late may with a verbal agreement to begin work in early June. After our contact postponed, was out sick, out of the area etc we agreed on August 15 for a start date. There has been no call, to email or txt as of August 28th. I therefore sent him an email and a txt asking that he return our $10,000.00 deposit as I have no faith that the work will actually get done.I simply want to get my deposit returned.Initial Complaint

****, the owner, came out and provided us with a patio quote. We obtained a few more quotes and finally accepted ****'s quote. He came out to collect a 50% deposit for the work. He then ghosted us for the past month. Will not return phone calls or emails. We are or were told that patio would be installed this week but no one was showed up.Business response

we have dug out the area, installed stone, and formed the new patio.
weather has held us up from pouring the concrete due to high temps and and of the threat of rain.
we are having the same conditions this week.
We need three good weather days together to finish .

I am rejecting this response because: we had numerous days with no rain and good weather. He lies and changes his story over and over. I want a refund for unused monies. Further, I have learned that **** is not a licensed contractor in the ***************************** although he presented himself as such. Again, another lie from ****.

I entered into a contract with MSF Landscaping in Feb 2021 for a comprehensive landscaping job including driveway extension, irrigation system instillation, stairway modification and additional stairway placement, and light landscaping. Our initial agreement was signed in Feb 2021, and on Feb 16, 2021 a deposit of $13,700 was paid. Since that time, there has been little to no work completed on the project, except removal of iron stair railings, undesired stairway embellishment, and placement of irrigation pipes (notably incorrect placement). These actions have left my lawn in disarray for the last two years. I have attempted multiple emails and phone calls to Mark F**** without response. When a rare response was received, excuses were always furnished relating to weather, worker illness, and material delays. I have therefore lost confidence in this company's ability to complete the project and have sought outside services from another company.Initial Complaint

We signed an agreement on September 16, 2022 to remove and rebuild our front walkway, remove and reset our front granite steps and furnish and install new rock face granite steps. We were told the work would begin in a couple of weeks and take about 1 week. We gave a deposit of half the total cost: $5552.00.Work has not been started. I have been unable to speak to owner Mark F., he will not return my call. I emailed on Oct 10, he responds Oct 14, telling us he would begin the next week. On November 8, following voice mails, I asked for an update. He responded Nov 10, telling us he would begin the next week. I texted Nov 14, he responded on Nov 15 telling us he planned to be there the next day. I texted Nov 17 asking for a straightforward completion date. No response until I emailed on December 3rd cancelling contract and asking for return of deposit. He responded by text stating 'they just want to do the work'. I repeated that we lost confidence and wanted funds returned. I asked for return of deposit again on Dec 9, 13, 19, 23. He responded by email Dec 21 and 23 that 'they just want to do the work'. I asked on Dec 28 that he call me by text and email, no response. I called again on Jan 12 and left a voice message. No response. I sent an email again this morning Jan 16 asking for the return of funds. I feel I have exhausted all my options short of court.Business response

We ran into material delays and worker illness which has resulted in delays. We have obtained the granite steps which are bedded to begin work. With the currant mild weather we can begin right away and would like to proceed.

I am rejecting this response because: I have lost confidence in this company to do the work in a timely manner and well. The business owner Mark has not initiated any communication since we signed an agreement in September. Responses to my texts, phone calls or emails have been short and vague. I have asked to be called by phone and I was not called ever. When I applied to BBB for help, Mark also has not reached out to me in any manner to resolve this.Again, I have lost confidence in this company and want our deposit refunded by end of month.

Provided Mark *********************** owner of MSF Landscapes a 50% deposit for $5400 on May 26th, 2022 to contract his company to build a masonry stone wall. Mr ********************** verbally and via email agreed to starting this project in late July but never showed on time. Several attempts via email, voicemails and text messages went unanswered to have Mr ********************** provide me with firm dates and timelines to complete this wall project. Mr ********************** additionally made separate contradictory statements on securing stone material for this project, he claimed the stone was ordered before we provided the deposit, then said the stone needed to be ordered and finally claiming he had to still secure stone for a wall from a farm.His crew worked for a total of two days from August 29th to dig a trench and a total of 5 days from September 26th to September 30th. Since September 30th, he has not come to my home to work and has not returned any of my emails or texts providing me with a timeline of when he will finish the job. Due to winter setting in, Im forced to bring in a new contractor and take legal action for any cost overruns and recoup our deposit.Mr Forge also has a reputation of taking peoples money and disappearing per complaints on yelp and BBB.Business response

Complaint: 18394471If the contractor wanted to complete the wall then why has there been ZERO communication from them?? It's been three months since the contractor has done any work. He's stolen our money. Provide a refund or we will see them in court. Response is rejected.

Landscape contract signed on 9/2/22, deposit of $10,610 paid to **** ****** of MSF Landscapes, with verbal expected start date of project 9/14/22. Repeated emails/voicemails with no response. Crew finally came on 10/ 6 and 7 to start the job by removing back yard deck and front walkway. They did not return for a couple of weeks, leaving us with no secondary egress from our back porch. To this day we have no egress from the porch. Crew has returned a couple of times. Our front yard is all torn up, walk way is all dirt. There are mountains of dirt in front and back yard, along with a mountain of gravel in our back yard. There are holes in the ground from where walking stones have been removed and not replaced in the back yard. There are trenches along the front sidewalk where a wall will be going, posing a safety hazard as the crew goes weeks between working. Our oil man will not have access to our pipe for delivery unless he steps onto neighboring property. Safety issues pointed out to ****, no reply. His crew has reported to us that " he lies all the time. He has 3 other jobs open and sends us to whoever is squeaking the loudest, so you must have squeaked loud". **** came to our address, and took off as soon as he saw me. Crew member said "he saw you and ran off". He was driving away as my husband was going to talk to him. At last crew visit they stated that "**** just opened another job in Ashby". ****'s most recent reply to email was that he was waiting on order for blocks. He had over two months to come up with that excuse as he got a big check in September to get products ordered and start the job. Winter is coming. Our yard can not be used. Our yard is a very dangerous place with all these holes, trenches, lack of egress and no access for oil deliveries. **** has NOT gotten back to us and I believe he has destroyed our yard, stolen our money and abandoned the project.Business response

I gave a deposit of $6,100.00 dated 09/19/2022. This is 50% of the total contracted price of $12,200.00.Description Furnish and install concrete pad 10 x 30 x 4 crushed stone mesh and pad Concrete pad at pool house 12 x 16Concrete sidewalk from pool gate to driveway 4 x 44Remove pavement in garage pour new concrete 10 x 20I have contacted **** ***** ************** and emailed him, and have no response or a clear date for the work to be done. I was last told we were next and that was two weeks ago. No replies from this company. Also on the signed document it states quote is valid for 30 days. Thirty days is in 7 days and I have no cement poured, no projects completed, no responses to my several inquires and no timeline set.I would just like to get my full deposit back of $6100.00.Business response
