On October 31st of 2022, I signed a contract with *******, at Do All Construction to repave driveway and pave a new 372 Sq ft area off of existing driveway. The contract says the new area had a 3 year, 100 percent guarantee. Work was started sometime in November 2022. On April 4th of 2023 weeds began to break through new asphalt. I text pictures to ******* explaining the situation, he text back and said "we can fix that, just send me your contract to see if you have a free sealcoat, Im going to fix it, but we got to wait until May until the Sealcoat place is open". I sent the contract, his response "Yes, it's included, we will take care of it". "Call me in the middle of May, 2 week and we will set something up". On May 10th, I called, left voice message. On May 15, I called, left voice message. On May 16th, I called, left voice message. On May 24th, I text *******, letting him know I had called several times, with no return phone call. On May 26th I called, "Mailbox Full" could not leave voice message, I text *******, asking him to please call to schedule sealcoat. On May 30th, I called and spoke to *******, he asked that I text my address and he would take care of everything. I text him my address. His response to my text " OK, I got the text and I will take care of this, call you in a couple of days". On June 20th I text *******, asking if anyone is going to put me on the schedule to fix the holes now building up on my driveway. On June 20th, his response "With the rain a.m. behind it's been raining every day, give me a couple weeks, and I'll get it done". On July 17th I text again, asking if he can please put me on the schedule, his response "Yes, I will do the driveway, but we had a lot of rain its gonna be about two weeks". On September 6th, 7th, and 8th, I text *******, with NO response. This is NOT FAIR and definetly not the way to run a business. I spent $3000.00 in good faith to a company that does not stand behind their guaranteed work.

Please read last years complaint, this years complaint is the exact same issue since nothing was done to take care of the problem.  BBB was in contact with ******* from Do All Construction last year, ******* said "He would take care of the weeds poking through Asphalt, but because  of all the wet weather, I had to wait until this year before he could reseal driveway and apply seal coat. He asked that I get in touch with him in May, 2024.  Please know, I accepted this in good faith, I waited until May of this year to contact him again concerning the remedy of fixing my driveway.  I have reached out to him twice, with no response. I signed a contract with Do All Construction, which came with a warranty. ******* is not standing behind this warranty, plus I was suppose to receive a free seal coating which they never applied.  If he is not answering my text, I feel he should refund money since I have to hire someone new to fix his poor work.   Thank you

Roberto and Do All Construction presented a quote and we paid a deposit for a new driveway in May. after the old asphalt was removed, they demanded $500 more than the initial quote. The work completed was not the agreed upon pitch or thickness, contract stated 3 rolled and areas are less than 2, and has caused structural damage. Dozens of phone calls, emails and texts have been unanswered, and Roberto has not come to assess the damage done.

      Business Response

      Date: 07/13/2023

WE HAVE BEEN THERE 4 TIMES TO LOOK AT THIS SITUATION.

AFTER INSTALLATION DRIVEWAY IS WATERED DOWN AND THERE WAS NO ISSUES AT THAT TIME.

AS FAR AS EXTRA COST THE CONTRACT HE SIGNED CLEARLY STATES " IF DRIVEWAY IS OVER THE STANDARD 2 LAYERS(BASE AND TOP COAT) OR OVER 4" THICK ,THERE IS AN ADDITIONAL COST PER TON". WE CAN NOT TELL HOW THICK A DRIVEWAY IS UNTIL WE DIG INTO IT, WE ARE CHARGED TO DISPOSE OF ALL MATTERIALS AND THE INTIAL QUOTE INCLUDES THE COST OF DISPOSAL OF THE STANDARD 2 LAYER DRIVEWAY.

WE HAVE SPOKEN TO THIS CUSTOMER TO RECTIFY THE ISSUE OF THE THICKNESS BUT HE HAS NOT AGREED TO THIS AS OF YET

      Customer Answer

      Complaint: *************

I am rejecting this response because:

      1) documentation: I have months of call logs and texts of this business not showing up to remedy this situation. Yesterday, Roberto did not show up to the situation after giving his word that he would. He ignored dozens of calls, and gave his word he would come look at the driveway. He never did.

      2) Thickness - the driveway measures 2 thick in parts, not 4.

      3) craftsmanship: there is standing water puddles after rain 3/4 deep. After this installation, rain that falls on the majority of the driveway now is pitched into the foundation, causing water damage to the home. Multiple independent contractors have confirmed this.

      Sincerely,

      ***********************

      Business Response

WE WOULD LIKE TO KNOW THE INDEPEND CONTRACTORS THAT HAVE CONFIRMED THIS IS THE ISSUE IN WRITTING. ALSO THIS PERSON IS ALWAYS UNDER THE INFLUENCE OF ALCOHOL WHEN HE CALLS US. YOU CAN NOT DETERMINE THE THICKNESS OF A DRIVEWAY UNLESS YOU DO CORE CUTS. THE FOREMAN HAS GONE SEVERAL TIMES TO LOOK AT THIS PROJECT INCLUDING WHEN RAINING. THE FOUNDATION WAS WATER SEALED BY US WHICH THE CUSTOMER PROVIED US WITH THE PRODUCT, HE STATED HE HAD THE PRODUDT IT DUE TO THE FACT THAT THE FOUNDATION WAS LEAKING BEFORE AND WE INSTALLED A BERM TO DETER WATER AWAY FROM THE FOUNDATION.

      WE REJECT HIS COMPLAINT.

BBB has heard from the consumer and they indicated they have not heard from the business to take care of the issues that were promised to be rectified in May.  The consumer would like to reopen this complaint as the promised resolution has not come to fruition.

      Business Response

      Date: 09/01/2023

BBB spoke to the business owner, he stated that the excessive rain we have been experiencing this Summer, has caused delays in his being able to complete seal coating. Explained that rain washes seal coating away, and that due to this, he has already had to repeat seal coating on several other driveways. He intends to schedule this seal coating with the customer when there are dryer conditions.

I hired DoAll Construction to replace the front steps and railings on my house as well as doing some landscaping in my yard in April 2022. The stairs were replaced, but no railings were installed. I contacted Roberto to find out when the railings would be installed. Roberto promised that the railings would be installed soon. ( He apparently has a sub-contractor that does this work for him.) I contacted Roberto, via telephone, over and over again trying to get a commitment from him about installing the railings. There was always an excuse regarding the delay in getting the work done. His employees had Covid; he couldn't get in touch with the installer; the installer wasn't answering his telephone calls or texts. Several times during my calls to him, he gave me a day when the work would be done, only to have the day come and go with no one ever showing up. Finally he offered to refund $1,000.00 of the money I had paid him since he was unable to get the railings installed. Once again, promises to send a check for the refund - all to no avail. I've never received a refund. I've been dealing with this for almost a year now and need help in getting the refund I am owed.

      Complaint: ********

I am rejecting this response because:

This is a new filing of my complaint about DoAll Construction, LLC. My original complaint which was filed on February 17, 2023 was responded to on March 7, 2023 with a message that the company would try to get my $1,000.00 refund out as soon as possible and an apology about the delay in sending the refund. I did respond that the company's answer was satisfactory to me at the time as I presumed that they would follow through and forward the refund promptly. It has now been almost two weeks and I have not received a refund and relying on my past experience with Roberto and this company I feel that the this response was just another delaying tactic. I would like a date certain when my refund will be sent and I would like the company to honor their promise and that date. Absent that, I will file a claim in small claims court and request triple damages or have my lawyer handle this and request that Do All Construction absorb the cost of my lawyer's fees.

      Sincerely,

I am seeking refund for $1,500 paid on 7/18/2022 in advance for work to be done following week while I was out of town. I paid Do All $8,100 (driveway repair/resurfacing) and $3,500 (stone wall powerwashed/repointed) earlier in July as the work was done and completed. The $1,500 additional was for a drainage grate to be installed in driveway in front of my two garage doors. That work was never done. I have repeatedly contacted *******, who always says "We've had crew problems, people have had COVID" and always "I'll do it next week." I have had four verbal guarantees that the work "will be done next week" but he has failed to show up ever. I want my $1,500 refunded.

I hired Do All Construction to sealcoat my driveway. They came out to give me an estimate and said that it would cost $400. They told me that they required a $75 deposit, so I wrote them a check. I was told that they would be out in a few weeks to sealcoat. A few days later, they cashed the check. After a week or so passed, I called them to see when they will come out to service my property, only to be told that he would be out "soon". I called again the following the week and received the same answer. He is giving me the run around and basically took off with my $75 deposit, despite signing the contract. I want my $75 deposit since he failed to provide me a service.

Driveway was installed June 6, 2022. The asphalt used is very rough, looking more like what would be a base coat. The Driveway we looked at for the referral was nice and smooth. The driveway seen for a referral is considerably thicker than what we received. Also the asphalt was to be 4 inches. Once rolled we see places where the thickness is between 1 to 2 inches. After rolling it out it should be about 3 inches. The owners of the referral driveway had the same contract other than the size and shape. We would like this asphalt removed and replaced with the correct smoothness and thickness. Please see the attachments which include a picture of the the referral driveway.

On 6/17/2022, I and the business owner signed an agreement for the sum of $2500 plus ****% sales tax - $15**** to "rip out and replace old stairs with new pre-cast concrete steps and railings - get all old materials out. Also install 2 railings on side stairs." To date, we have paid $265**** (split over three payments). The side railings are installed. The front steps have been constructed, but have not been finished with paint or sealant, nor have railings been installed on the front steps. The contractor now says the costs of the supplies and labor have increased to the point where he needs and additional $2872.62 to complete the job (more than twice the original price). I understand that costs can increase, so I have offered an additional $550 (20% - at job completion) above the original price, but I can offer no more. He is adamant that this is not sufficient and has only offered a payment plan that would have us paying the entire additional $2872.62 - and amount of money that we can not afford and certainly would not have agreed to if quoted said amount before we signed the agreement.

The prices on material have gone up because of a recent pandemic which i was unaware of until i had gone to purchase material needed for the project  . They where given prices higher by other companies. I tried to give them the best price & was under bidded. I called & spoke to the wife which agreed to give more at the time & at such time ******** asked me for a break down of material & cost which was provided to him & it wasnt something that they could afford . This might of been a misunderstanding. I needed to adjust my price because of such reasons provided .

Unfortunately, the contractor's assertion that my wife (or I) agreed to pay the $2800 in additional costs is not correct.  Indeed, after considering the request at that time, we concluded that we could not afford more than the $550 we have offered.  If the original price for the job was $2500 + $2800 ($5300), we would have thanked him for his time, told him we could not afford it, and not agreed to the work in the first place.  I understand that costs may (and indeed, did) increase after the job began, and in consideration of that have offered and continue to offer $550 (20%+) above and beyond the original cost (already paid in full).

      Sincerely,
