      Financial Management Solutions, LLC **** ********* ** Ste ** Greenbelt, MD ********** Account #: ****** I have never had Financial Management Solutions, LLC as a creditor. Per my research Financial Management Solutions, LLC is a debt collector falsely attempting to collect a debt that isn't there's. I have requested that Financial Management Solutions, LLC provide proof of alleged items. I request to be provided with specifically the original application, contract, note, or another instrument bearing my signature with Financial Management Solutions, LLC. In addition please provide the contract signed between Financial Management Solutions, LLC & THE ******* ** ***, notarized and sworn under penalty and perjury for Financial Management Solutions, LLC ability to collect this alleged debt. I request this under 15 U.S. Code § 1692g - Validation of debts. If information is not provided or the false reporting isn’t removed; as in ****** ** ***** ***** ****., No. 95-6445 (C.D.Cal. Nov. 14,1995), you may be liable for your willful non-compliance. Credit reporting laws ensure that bureaus report only 100% accurate credit information. Every step must be taken to assure the information reported is completely accurate and correct. The following information therefore needs to be reinvestigated. I further remind you that, as in ***** ** ******** *********** *********, 993 F. Supp. 2d 1154 - Dist. Court, (CD California 2014); you may be liable for violating the Fair Credit Reporting Act (“FCRA”) by recklessly failing to follow reasonable procedures to ensure the accurate reporting of debts discharged in bankruptcy and by refusing to adequately investigate consumer disputes regarding the status of discharged accounts. Please send all validating records through the BBB and certified mail to my address. I have uploaded a copy of my ID showing my mailing address.

      March 5, 2023 ****************** ********************************* Laurel, MD ********** Name of Creditor collection agency: FMS Financial Solution *****************************************Greenbelt, MD ******** RE: Acct # ****** To Whom It MAY Concern: On January 10th 2023, I wrote to you requesting validation and an investigation into items that I believed were inaccurate. To date, I have not received any such validation. In my previous request directly to you, I listed my reasons for disputing the information and requested validation. Since this is my second request, I will also be sending a copy of this letter to the Federal Trade Commission notifying them that I have signed receipts for letters sent to you and you have not complied with my request. I regret that I am being forced to take such action. Please note that on 3/20/2019 the CFPB released its Fair Debt Collection Practices Act Annual Report and it stated the following: "The Bureau notes that one or more debt collectors continued collection activity despite not properly obtaining and mailing debt verification after a consumer exercised his or her *1692g rights. Specifically the Bureau calls out the practice where “debt collectors forwarded consumer debt validation requests to the relevant clients, who mailed responses directly to the consumers. Section 809(b) of the FDCPA requires a debt collector, upon receipt of a written debt validation request from a consumer, to cease collection of the debt until IT (meaning the collection agency) obtains verification of the debt and mails it to the consumer. Examinations found that one or more debt collectors routinely failed to mail debt verifications before engaging in further collections activities. Instead, one or more debt collectors forwarded consumer debt validation requests to the relevant clients, who mailed responses directly to consumers and the debt collectors then continued collection activities on accounts in violation of section 809(b) of the FDCPA.” Failure on your behalf to provide a copy of any alleged contract or other instrument bearing my signature may result in small claims action against your company.       I have tried five times to respond to this dispute by sending a copy of the response sent to the BBB in July, 2022 - regarding the same consumer.  This office has received and responded to complaints from the consumer herself, the CFPB, and *******.   I am unable to attach the prior response as I keep receiving an error message regarding the size of the file.  As such, I would request that you refer to your prior records.   This account is now represented by the Law Office of ******* ** ********.       This company has been calling me today, September 9, 2022, every 30 minutes since 8am. So far they have called 3 times and it's only 10am. This is harassment. I am disabled, and have a hard time getting to the phone. Even though I have them blocked, they still continue to call me.

      FMS called us out of the blue saying we owed Over $700 for rent that was unpaid on a property we vacated in Spring of 2020. We were asked to pay by credit card over the phone without receiving any paperwork about the alleged debt "in order to avoid legal penalties." We were told that the charge would not be ran until we "printed, signed, and returned an authorization form." No form was ever sent or signed and our bank was charged without authorization or proof of debt being provided. We've made repeated attempts to call FMS and receive all paperwork related to the alleged debt including a confirmation of payment and satisfaction of the debt. FMS will not return voicemails and has not followed up with us. FMS Account number: ******

      Pursuant to this dispute, this office conducted an investigation of the file.  This office is a licensed third party debt collector representing ******** ****** - **** *** ********* ***.  This office received the account from ******** ******, in July, 2020, but was unable to contact the consumers until April, 2022 due to restrictions in the District of Columbia Emergency COVID orders.  As shown in the attached documents, the balance due is for the period May 1, 2020 - May 13th, 2020.   The lease requires that a thirty(30) day notice of intention to vacate be provided. The notice was provided to the rental office on April 13, 2020, and as such, the notice period extends through May 13th, 2020.  Further be advised that the consumer provided Credit/Debit Card information to a collection staff member in a conversation on June 28th, 2022.  It is not required that an authorization be signed in order to process a payment.  However, it is standard policy to request that the original receipt and/or a credit/debit authorization form be signed in the event that the consumer requests a letter of payment.  The consumer should reach out directly to the collection manager, Jim L****, at ###-###-#### or by email to ********@fmsfinancialsolutions.com in order to obtain a written notification of payment in full.

I am not saying they are reporting right or wrong. I am just saying that I am not 100 percent sure if they are. I also read something called the Fair Credit Reporting Act where it said by law, I had rights to challenge anything I am not sure is accurate. Some of the people reporting things on me, I have never heard of which made me write to you all. Are you familiar with something called 15 U.S.C. Sec. 1681i(a)? I heard that if you can’t provide proof, these accounts must be deleted. Well I want these accounts deleted if they are not 100 percent right and correct.       Please be advised that this office has documentation in support of the debt, as well identifying the consumer as the party who incurred the debt.  Please see the attached copy of the first and signatures pages of the lease, the ledger page shoeing the total owed at the time of eviction, a copy of the eviction court document, and a break down of the charges.    In addition, please find, a copy of a payroll remittance statement from DC Public schools, as well as a copy of the Maryland driver's license provided as identification at the time of rental.     This office also has in its possession, but did not include,  a copy of the bank statement provided by the consumer.    The original creditor, ******** **** at Greenbelt *******, is currently represented in this matter by the Law Office of ******* ** ********.  All further questions, including the current balance due,  should be directed to that office at the following:       ************,  ******@*****.net, or by US mail -  ** ********** ******, #***, Rockville, Maryland  *****.

      On 06/22/22 I went to look at my credit report and found a collection account tied to an address I have never lived at. A hard inquiry was also done on my credit report by the same company. I have never received any communication from this company and they have gone ahead and put this on my credit report I need this removed immediately as this has been reported in error and I do not wish to go back and forth with this company.
