Signed a contract for wedding services that states we have up to around a month before wedding which is to take place sept of ****. When i asked to cancel she is refusing to give money back. Kept saying i had to sign a cancellation paper which she continued to avoid getting me. I finally received the paper and no signature was required. Keeps threatening me with words such as " if you wish to test the waters" all because i continue to demand my money back as stated on signed contract. Found out owner has multiple criminal records of fraud and writing bad checks. How is a business aloud to be operated on false contracts and stealing peoples money. Its costing innocent people more money by having to take off work and taking owner to court. This business is not a honest business and should not be aloud to operate and scam innocent people.Business response

Just to let you know and you can make your attorney/attorneys aware that my money better be in my hands by the 8th! You claimed that you were having it certified which means you have ONE day left because mail doesnt come on Sundays! After contacting my attorney and her pulling your record of theft, assault charges and and writing bad checks, we will NOT receive a check from you for my refund! We will only accept a money order or cash. Make sure you send this to your attorney like you say you keep doing! Also please be prepared to explain to the judge on all of your criminal charges and the better business bureau how your still in business for stealing from people then writing bad check to try to refund them. This has now turned into a legal matter I am not taking lightly,
This Couple has not only breached their contract and are now harassing me as well As making false accusations against me trying any way they can to ruine my livelihood because they did not reach out to me with any concerns they may have had or tried to get to the bottom of the heresay to eliminate any concerns they may have had, they would not speak to me or even tell me until the fianc spoke up and told me the reason why,
I have never been charged or convicted of any type of fraudulent behavior and have ran a successful business for several years.
I understand that you cannot please everyone and we strive to make everyone happy, not only is this couple slandering and defaming my business but also myself as a person which is causing me Mental Duress,
I do currently have legal council working on a legal remedy for their actions,toward myself and my company.
After she had signed their contract I had turned down two other possible clients due to them already booking the date,
Deposit Forfeiture is not an uncommon practice especially if the contract is breached, for example if they would cancel their venue the venue owner would keep their deposit,
The only reason I ever consider a refund is if the wedding itself has been cancelled for unforeseen circumstances, definitely not " I heard some things , or I found better pricing" at that point they are not only wasting my valuable time , but their own as well my loss of business, at this point I'm not certain I will be able to fill the date,
End result I will Not be giving any type of refund to the above parties, because of the wedding not being cancelled, dishonesty and harassment.

Good Afternoon and Thankyou for contacting us regarding this is***,
************************* had contacted me on 10/25/22
She was referred to me by a few previous clients who had worked with me.
She scheduled an appointment for my soonest availability which was 10/28/22 at 6:00pm , we met at Panera Bread in **********, we went over all services and they had made the decision to book my services for their September 7, **** wedding, I did have that date open luckily because September, October and November are our biggest wedding months in the wedding industry. As a matter of fact they had gotten the last available fall date for their ************* Venue in **.
We had gone over my contract before they signed it and gave me the 50% required deposit.
On the back page of all of my contracts,
I go over postponements and cancellations of events very clearly,
In case of a postponement any monies that are paid will automatically be applied to the next date available.
In the case of a cancellation, meaning that if your event is completely cancelled and no longer taking place the amount of your payment can be refunded up until 60 days prior to the event date with a ****** cancellation fee,
If anyone cancels for any other reason than the above the contract is canceled and vacated and their 50% deposit is forfeited.
Also if this happens less than 60 days prior to their event they are responsible for the full amount of their contract.
This was explained to them as well as any and every other client we have.
On 11/12/22 I received this message from *******************-
"Hello, we would like to cancel your services for our wedding sept 7 ****. I understand we will loose our ****** deposit."
I responded back with-
"Ok, that isn't a problem was there a reason why? Was something wrong?
Could you give me a call?
************"
I had tried to give her a call myself to find out what the details were etc. and there was no answer.
The very next day I get this response -
"I dont really have time..can you please send me the cancellation form and i will get it back to you."
I then respond with "That is fine , could I ask the reason?"
No response ,
That following day after I get the following message, now please keep in mind I had already emailed the cancellation form and confirmed her email.
"Are you sending the paper by email?"
I respond -Yes
"Well im not seeing it"
Me-Is this the email? ************************ Also check your junk folder, I'll resend it today,
I then resend the form , again,
11/15 -
I checked i didnt get anything
Try sending ********************
And I did , again and sent a screenshot for proof
We have checked both of our emails and have not received the cancellation paper. We would like to get this asap.
Week and a half went by and I hadn't heard anything and I received this message from her fianc

"hello so my fianc **** has tried to cancel your services for a few weeks now. she has yet to receive anything from u. this is starting to become a f****** joke. so send us the cancelation form. here is my email ********************* or mail it to us. im done playing games. I'll even meet u to get this s*** straightened out.

I wrote back
"I'm not quite sure what the is*** was/is but I would really be appreciative if someone would enlighten me??"

The fianc wrote back
I was trying be nice but since we talked with u and hired u. We have heard stories from family and friends of people that had is***s with u. Like showing up late, stained linens, being rude to guests at wedding and reception. Dj speakers sounding like s*** After hearing this my fianc just worried about a day thats a year in a half away. So I made the call to change. Told her I dont want her stressed. Weddings are stressful enough to have to worry about someone messing up the whole day. So we would like to cancel and get are money back.
We never had any is***s with are emails so no clue why it didn't go through but I checked it everyday. In all folders. So mail the form to us so we have one less thing to worry about
I was completely blindsided by this because I thought at this point that the reason she wasn't talking was because the wedding had truly been cancelled, but as you can see it was definitely not the case,
This does not happen to me, or my
Company if someone cancels which is very few it's for the stated reason,
I was a bit thrown back and I wrote back the following while sending samples and reviews of our work from SEVERAL happy clients , some of which are law enforcement and very high end clientele , but everyone we work with no matter what are very grateful and appreciative of the work we do and we usually do not have to deal with such drama and is***s.
I can tell you that none of what you heard is true! I had an ex employee who started some rumors a few years back and ironically she is now dead from an overdose
I can prove otherwise and give you TONS of references that you can call and talk to personally, if you would like to sit down and talk or discuss this, I can assure you that this is definitely not the case,

Ironically I work at the Venue they have on a regular basis and even rented linens and a few other things to the owner for her own daughters wedding .

A few days later I get an email from the fianc-
Well im still waiting for this form in the mail here is my email because apparently u can't send it in email. I'll send u this message so u can just reply with cancelation form.
Not really sure why you are making this difficult but this whole thing is pushing my last nerve. So send this form now or I'll be contacting my attorney!
I then send this back along with the cancellation form for the now 4th time
Definitely not Making this difficult, I've emailed it 3 times , this is the 4th!!
If you don't receive it this time there is something definitely wrong.please scan and send back."
They scanned and emailed back the form
The cancellation form states,

DATE BOOKED 9/7/24
VENUE: ************* ************ AMOUNT OF DEPOSIT: 1,380.00
I HEREBY HAVE GIVEN NOTICE THAT MY EVENT STATED ABOVE HAS BEEN CANCELLED AND IS NO LONGER TAKING PLACE FOR THE FOLLOWING REASON:
(IE: ILLNESS OR FAMILY ISSUE,BREAKUP ETC PLEASE STATE BELOW)
On this line she wrote" really none of your business"
She then stated she wanted her money back 30 days from November 15, 2022 and and then complained and stated that the cancellation form was not legal because there was no signature line,
At this point she not only cancelled for hear say reasons but has lied on an official business document that her wedding has been cancelled, which again is the only stipulation that constitutes a refund with a cancellation fee"
I then start receiving these texts to my phone,
Her- Im not sure who you are trying to play games with but i can assure you im not the one. I have nicely asked for my money back. You have lied and said i had to sign a paper to cancel which was untrue. Ive gave you plenty of time to get my money back. If my money is not refunded by the end of today i will be seeing you in court per you not following the contract that we both signed, as i see according to court records that we are not the only one you have done this to. I will make sure i do everything i can to make sure nobody else falls into your con-artist trap. Im done playing your games and am assuring you im not the one to mess with and i WILL get my money back but its your choice on if you are gonna do this the easy way or the hard way.
Me-I'm not playing games , I have actually already spoken to my attorney/attorneys I am in no way a con artist, I have plenty of great reviews and if you say or do anything damaging to my business, I will in fact *** for slander or libel and will also *** for any moneys that were lost including your own event!, because you cancelled over "here say"you did not come to me and address your concerns, also you did not cancel your event, you cancelled services again over here say and "making accusations " of something im not!! which I can and will also *** for along with the evidence of proof of the nasty texts, emails and responses from you and in the service cancellation
I had sent the cancellation for 3 times to both emails!
And have dates and time stamps that have also gone to my attorney/attorneys
Also the " while give me the money back or else I'm going to make sure etc... we'll that is a little thing called extortion"
Also I did not "lie" and in no where in our conversations did I say you had to sign, it's usually etiquette to sign and date something, please see screen shots of every conversation which again has gone to my attorney/Attorneys.
And one more thing,
The document you did sign clearly states 30 days from which the cancellation form is received which would be 1/8/23
You WILL be required to sign for any refund either via Certified mail or at my attorneys office in which im going to let them make that call,
Please know that threats will get you no where but in court and your rudeness and failure to reach out regarding shy concerns would hold ** in court because that would be the first thing the judge will ask, why didn't you reach out *** to your concerns?
Also please know I have TONS of people who are previous clients who will testify and back me on my behalf ,
Once again , I never lied about ANYTHING, I run a legitimate business and also if this does go to court you will be required to disclose your sources of such heresay,
Once again the 30 days is 1/8/23 I or my attorney will be jn touch by then.

I have every right to cancel. I tried to be nice but clearly you are holding my money which there is no reason for, so now im not gonna be nice. No judge will be okay with how you are doing things. Trust me my family is in and has been law enforcement so i know my rights. I have looked you up on court records which clearly state you have done similar things to others. I will not owe you for anything once court is over because clearly you are stealing our money and you try to make it seem like you dont have to give our money back because we dont want ur services. No where in your contract does it state you decide if you like our reason or not to cancel and that determines if we get our money back or not. Maybe you should get your " attorney" to write that in your contract that you dont hold up to. I will be waiting to hear from your attorney. Who is this attorney so i can call to move along the case a little faster.
