Hello,I own the unit in this building since June 2010 and everything was perfectly fine until the end of 2021 It was sold to a person that is renting it out and the tenants raised h*** in my life with 3 adults and 2 children in a 2 bedroom apartment. The constant stomping was unbearable and cost me my sleep, my peace and the enjoyment of my home. Fast forward, there were 2 hearings with the condo association and the owner of that unit was told they need to carpet 80% of the unit in order to eliminate, or minimize, the noise that came through.The owner said, these tenants were leaving and he would make sure before he got new tenants he would have the unit carpeted. New tenants came in August 2022 and there has been no carpeting done and the stomping is just going on. Granted, not as bad as before due to only a 3 member family now but it is still loud enough on and off throughout the day well into after midnight.The HOA said, they will do a check to see if the carpet was laid out and let me knw but the past 3 months or so, they have ignored all of my emails regarding this matter.We had a water leakage issue from upstairs and a plumber came in to check my ceilings and their unit and when I asked if there was any carpet in the unit, he said, there wasn't.I asked these neighbors nicely a couple of times and nothing has gotten better, my HOA doesn't think they have to help me so here I am asking for help and guidance.Please, help!!Thanks, *******************Business Response

I am writing in response to the recent complaint by ****** ******. As *** ****** mentions in her complaint, she didn’t have any issues prior to the new owner purchasing the unit above and renting it out. We had sent several noise violation letters to the unit above and held multiple hearings before the Board of Directors. The owner had his previous tenant comply by placing area rugs on the floors. Their first tenant moved out last year and a new tenant moved in around August 2022. We had reminded the owner of the carpet requirement which he had notified the new tenants of.
I am not sure when the plumbing incident was that *** ****** referred to in her complaint, however, I can confirm that as of last week when the onsite maintenance person had to enter unit #** to respond to a heating complaint, he confirmed the unit was full of area rugs throughout the unit. The onsite maintenance staff, ***** *******, stated to me “their unit actually looks pretty weird because of the amount of area rugs they have everywhere”.
I have tried my best to explain to *** ****** that the association can only enforce the carpet requirements and make sure the tenants are not creating excessive noise which would be considered outside the course of normal living, such as loud music, loud parties, etc. However, I have indicated that the tenants above also have the right to the peace and enjoyment of their unit which may involve their child running and playing in their home. In older multi-family buildings such as these, there is no doubt people hear their neighbors, both above, below and to the sides. If Ms. Ulusoy can show the tenants above are causing noise which exceeds the maximum allowable decibels according to PG County, we could then bring the owner of the unit to another hearing where further fines could be assessed.
The association has done everything within its authority to enforce the governing documents and community rules.

There have been reoccurring plumbing leaks originating outside of the control of my unit resulting in ceiling damage from seven different incidents in the last two years. The response time has always been at least two weeks after the leak, including leaks that pour from the light fixtures, none of which an electrician has even investigated. For the latest leak, the initial leak was on Aug.5 resulting in the dining room flooding and the ceiling and floor being removed., A plumber was sent out on Aug 18 and was not able to recreate the leak so no repairs were completed and I was told someone would investigate the roof of the building to see if that was the origin. A request for an update was sent Aug 26 and Sept 9 with no response or acknowledgement from Abaris. A follow up request was sent Sept 19 as there is still no additional efforts to investigate or repairs scheduled. A response was received after the entire Abaris team was forwarded the chain on Sept 19 which read the origin of the leak could not be found, we will investigate the roof, we will schedule repairs, which I pointed out was the response given on Aug 18 a month prior and asked if the repairs are to be done before the investigation is complete, no response. Not only is the chain of communication significantly flawed but I have been living with an oveer 4x5 foot hole in my ceiling and no flooring with the flooring ripped up at the edges for almost two months with seemingly no effort to conclude the repairs and if efforts are being made no information being shared even following direct questions. This home is inhabited by myself and three minor children.Business Response

I am writing in response to the recent complaint by ******** *********. The unit in question, **** ********** ***** *. Unit **, which is the problem unit above ******** *********, has been causing various leaks over the years and some of them have been simple to address and others not so simple. I am very sympathetic to *** ********* and this situation. The owner of this unit claims to live in the unit, although we know for certain he does not, and he rents his unit out to multiple tenants. There have been multiple leaks from this unit, starting from water on the floor due to no shower curtain, to having faulty caulk and grout in the shower, to a faulty wax ring under the toilet, etc. This has been a recurring issue to which the Association has involved legal counsel against this owner for years to gain compliance from him to provide the association a lease of who resides in the unit as well as for access to the unit on multiple occasions due to his tenants' causing leaks into the unit in which ******** ********* resides. Every time a complaint arises, we reach out immediately to the owner and schedule a plumber to inspect the unit for leaks. A few months ago, we were able to get the owner to renovate his bathroom completely which had been the primary source of the recurring leaks.
The most recent leak that is referenced from this claim came after the bathroom renovation was complete, which was puzzling to the plumbers since everything appeared to be in good order. We scheduled for a second plumber to go in unit 11 and they found what they believed to be the problem with some shut off valves and the problem now appears to be corrected. On September 26, 2022 we had authorized ******* ********* to complete the repairs inside *** *********'s unit since no further recurrences have occurred and they had reached out to her to schedule her repairs. I am hopeful once the repairs are completed in *** *********'s unit, everything will be resolved for all parties.
