    I paid a deposit for masonry work. The contractor promised to schedule the work by a certain date. After numerous followups they still had not scheduled the work. I asked for a schedule or my deposit back. They agreed to send the deposit back. They did not send the deposit back, and then stopped responding to my messages for weeks.

    I am the owner of RF Masonry & Builders. We have a contract that states when a client decides to terminate a job, they receive their refund minus 20% for work we had completed up to that point, materials bought and travel required to drive to and from the job. We have sent out the check that was required via money order in the mail on 8/6/24 and should be at his house within ***** hours.

    Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered. 

    There is no signed contract that stipulates any cancelation fee. If one existed, the business should upload it here. Even if one did exist, which it does not, the communications show a consistent attempt on my part to schedule the work, and an inability to schedule the work on the part of the business. One might even suggest that the business canceled the work because I only asked them to refund the deposit if they could not provide a start date. I have attached the scope of work document, and further discussion took place in text threads that were already uploaded. I received the check for the incomplete deposit. I will not cash the check because I do not accept this as settlement, and I am awaiting a litigation process that will begin August 19th if I do not receive the full deposit.

    Businesses and Customers should be civil, courteous and polite in their responses to complaints. It is important to remain professional and productive when participating in the BBB complaint process.

    We are prepared to bring this to court as we can justify the amount of time, money and materials spent up to the point on client terminating the contract.

    We reviewed everything a second time and still find that we have returned back a fair amount within the scope of work completed already, materials purchased and travel costs. 

    We are happy to discuss this further with client in litigation if they so choose, however we stand by our refund policy and business structure. 

    Client has continued to create and post defamation against my business via social media and therefore we will be seeking our own rights to this matter legally.
