    I hired this law firm to handle my bankruptcy filing. I completed a credit counseling course before filing and a second after. Both certificates were emailed to my case manager. 1 on 07/28/24 and the other on 08/16/24. I received a letter in the mail on 09/25/24 and that stated I had not completed the second course. I reached out to my case manager and was told I needed to complete the second course and I told her that I already completed it and I have not received any form of communication since that email on 09/25/24. I have now received 2 emails from a creditor on my file today 11/06/24 that I have not heard from since 07/28/24

    We paid them to file bankruptcy. I have worked with 4 paralegal and 2 attorneys. The paralegal are not uploading documents needed in court. Our case was dismissed after 6 hearings and all 6 hearings not having proper paperwork. I have emails from paralegals stating that the documents are received and uploaded. The attorneys never know what is going on.

    This is simply not an accurate depiction of the clients' Chapter 13 case. The clients' case was diligently prosecuted by our firm since it was filed. The clients failed to make any of their Chapter 13 payments whatsoever. They communicated with their attorney and paralegals throughout their case regarding the needs for them to make their Chapter 13 plan payments and provide documents the bankruptcy Trustee was requesting. They failed to do both. They made zero chapter 13 payments. They incorrectly allege that they produced the documents that were requested of them as they only produced some of the documents which were not the correct documents requested. Our firm consistently and diligently followed up with them for the needs of their case. They also had several consultations with their attorney regarding the possibility of converting their case to a Chapter 7 and were fully informed of their ineligibility and consequences of doing so. They have decided to dismiss their Chapter 13 case and file again at a later time when they are in a better position to do so. It is important to note that our firm has not been paid a dollar in attorney fees for the clients' case. The only money paid by the clients was their Court Filing fee that was paid to the Court. We did our best to represent the clients and wish them the best of luck if they decide to file their next case with another law firm.

    Fairmax law was hired to file a chapter 13 for me, my case got dismissed in June 26th of this year, they new I had some pressing issues at hand and told me it would be refile yesterday by end on business. Than I received a call from my Attorney ******************************* telling me that they are not going to file anymore because they don't think it would benefit as well as an attorney in the western district. They have put me in a terrible position and I need to to file for me this week and honor a repayment plan that we already agreed upon of $47 a week.

    I used this law firm to file my chapter 13 bankruptcy, after going through the process I was not aware that this filing would impact my status with receiving financial aid for school because that was not explained from the attorney. I have been contacting the attorney, setting up meetings with no response to date. I am concerned about the fact of professionalism by not responding to my demands to call me back.

    Fairmax has taken roughly ******* dollars from me, and never correctly filed my paperwork for my bankruptcy. This all started in October of22 when I first filed. The office was/is so badly ran that they screwed up my documents, this should have been a 3 month process, come march of 23 they tell me I have to refile and pay another ****** filing fee, I did, and then the process starts all over again, I showed up to court when I was suppose to, and my lawyer didnt even have all my documents I sent over, which postponed it again, and then again, and then in Nov of 23 they tell me everything was set, and that I should receive my paper in the mail. So I wait, and wait a little more, come ******* of 24 I contact them to let them know that I hadnt received any documents, other than one from the trustee saying they waived my filing fee (odd because I never got that back). Lo and behold no bankruptcy was completed and filed as dismissed, now sits on my credit report as a derogatory ******* I cant rent a house because of it, in ******** a lot of landlords run credit, and see this, and it looks bad, plus there is 2 dismissed bankruptcys. It took my score down. I have opened a dispute with trans union to have it removed. When I asked for them to just refund me my money, ******** says we will offer you a 300 dollar refund, all the while her kid is in the background screaming. Real professional. I feel taken advantage of. I was trying to do better, but I should have just counted on myself, and not this law firm.

    Our records indicate that we made numerous attempts to reach the client for essential information and documents necessary to progress her bankruptcy case. Unfortunately, there were multiple instances where the client did not respond or was unavailable, which significantly delayed the process. We emphasize that our ability to provide effective legal assistance heavily relies on timely cooperation and communication from our clients.

    We deeply regret that the client feels dissatisfied with our services. We understand the stress and frustration that comes with legal proceedings, especially bankruptcy filings. However, the delays and complications mentioned in the complaint arose primarily due to a lack of response and cooperation from the client, despite our repeated efforts to engage and assist her.

    Regarding the concerns about the impact on her credit report, we want to clarify that any such impact is unrelated to our services. The negative **** on her credit report is purely a result of actions taken by her creditors, over which we have no control.

    I filed chapter 13 bankruptcy with Fairmax law back in February 2022. In April 2022, I found out I was pregnant which to have many complications. Im high risk. My pregnancy caused me to reduce my hours drastically at work which lead to loss of income. I communicated this with my attorney back in July or August. I told him I would be going on leave in December to have my baby and I wont have any income to make my bankruptcy payments. He told me to call him around that time so we can file a motion to delay my payments for 3 months. I ended up going on leave much sooner because of my complications. My doctor put me on medical leave. *** been trying to contact him so that he can file the motion sooner but they wont return my calls. On top of that, my car finance company filed a motion to repossess my car and sell it. My attorney never answered the motion so the courts ruled in the finance company favor now they have the option to repossess the car whenever they want unless my attorney file a motion to affirm the car. The finance company sad the car **************** status yet so I still have time. Its been over a month. *** made 3-4 appointments to speak with my attorney and hasnt return any of my calls. My case is in danger of being dismissed and car is in danger of being taken. My attorney fees are $3,000. I shouldnt have no issue with contacting my attorney at all.

We have tried to reach her for weeks. we only heard back from her yesterday. we are working through the issues with her.

    I went with fairmax law to file bankruptcy and had to go down to the office in indepence 4 times in august because the person didn't show up twice to make copies of paperwork I have. I also paid the full amount required for the case of $1995 on August 12 2022. On September 7 the lawyer called me said for me to get another lawyer because I took money out of my bank and told me not allowed to have much. The lawyer name was ***************** told me to fax attention **** I want a refund. So I faxed the paper to the person they call ****. Haven't heard from them. I called twice since to see the status of my money and told me has to go through main lawyer first to ok the refund of $1995 and will call me.

    The information given in this complaint is very inaccurate. We have decided to cancel our relationship with this client for reasons that must remain confidential. We are prohibited (as attorneys) to disclose them. But what **************** said in his complaint is totally inaccurate. Having said that, we have issued a $400 partial refund to the client. We have earned our fee, but the partial refund is merely a courtesy.
