The consumer doesn't indicate why he isn't liable for this debt. We don't need a contract with this consumer. Our contract is with his creditor. MERCHANTS & MEDCAL - 1387****To ensure absolute accuracy in reporting, it is imperative that the non-creditor provides only 100% accurate credit information. Every possible measure must be taken to ensure the reported information is entirely correct. Consequently, the following information urgently requires reinvestigation.I demand immediate proof of the alleged item, specifically the original application, contract, note, or any other document bearing my signature. Despite the non-creditor's claim to send the requested information by mail, I perceive this as a delay tactic, which I believe constitutes a blatant violation of the FCRA.Debt buyers, not being creditors, have inaccurately listed a collection agency as a creditor on my report. This flagrant violation of the FDCPA's creditor definitions must be rectified without delay.According to 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation G) 1006.2(g) Definitions, a creditor is defined as any person who offers or extends credit, excluding those who receive an assignment or transfer of a debt in default solely for debt collection purposes.Furthermore, 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation F) specifies that the term debt collector excludes certain individuals, including any officer or employee of a creditor while collecting debts for the creditor, and any person acting as a debt collector for another person.This account is inaccurately reported under 15 U.S.C. 1692g regarding the validation of debt. Moreover, the collector's attempt to collect a debt not mine constitutes a severe violation of 15 U.S. Code 1692k - Civil liability. I have attached the definition of the law as evidence of my rights.It is imperative that this inaccurate account be immediately removed from my credit report, as its presence is causing significant personal distress. Failure to act promptly will result in the imposition of the $1,000 fine for each violation of the law.Business response

This is the second BBB complaint from this consumer. The first complaint claimed the consumer didn't have a contract with our client. (BBB Case# ********) In the current complaint the consumer claims to want to work with us to get the debt off the consumer's credit statements. This consumer gives us no reason that he is not liable for this debt. In fact, he has made a payment on his account. We are a third-party collection agency and therefore don't need to have a contract with the consumer. The consumer has never requested verification of debt from us. We don't have a reason to remove this account from the consumer's credit report.Customer response

MERHCNATS amp MEDICAL ACCOUNT NUMBER: 1356 To ensure that the **************************** report only 100% accurate credit information. Every step must be taken to assure the information reported is completely accurate and correct. The following information therefore needs to be reinvestigated. I respectfully requested to be provided proof of this alleged item, specifically the original application, contract, note, or other instrument bearing my signature. The non-creditor stated they will send the requested information in the mail however I feel as this is a stall tactic on their behalf, and I believe it to be a blatant violation of the ***** Debt buyer are not a creditor therefore on my report where it shows collection agency as creditor it's inaccurate reporting and violation under FDCPA definitions of creditor. This is inaccurate and needs to be deleted immediately as its a violation. 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation G) 1006.2(g) Definitions. (g) Creditor means any person who offers or extends credit creating a debt or to whom a debt is owed. The term creditor does not, however, include any person to the extent that such person receives an assignment or transfer of a debt in default solely to facilitate collection of the debt for another. 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation F) (2) The term debt collector excludes: (i) Any officer or employee of a creditor while the officer or employee is collecting debts for the creditor in the creditors name;(ii) Any person while acting as a debt collector for another person This account are inaccurate under 15 U.S.C. 1692g validation of debt. In addition, while the collector attempted to collect a debt that is not mine, they broke 15 U.S. Code 1692k - Civil liability. Below I have attached the definition of the law as this is my right. Please have this inaccurate account removed from my credit as it is damaging my personal life or pay the $1,000 fine for breaking this law.Business response

We are a third-party collection agency and have permission to report this debt to the credit reporting agencies. The consumer has not given us a copy of the credit report claimed to be inaccurate. First of all, this consumer gives no indication why the consumer is not liable for this debt. We do not need to have a contract with the consumer - we are a third-party collection agency. We have never spoken to the consumer nor have we received any correspondence from the consumer. There was never a request for the original contract. This is a standard complaint without any merit.
