I am submitting this complaint to report Orbit Leasing for ongoing false reporting on my credit file, in violation of the Fair Credit Reporting Act (FCRA).Summary of the Issue:I had an account with ******************** that was closed and charged off in February 2021. However:1.Illegal Late Payment Reporting: Late payments have been continuously reported on this account for the past four years, despite the account being charged off. Under the ****, creditors are not permitted to report new late payments on charged-off *********************** Reopening of the Account: On November 19, 2024, Orbit Leasing reopened the account without my knowledge or consent, removed the original charge-off, added new late payments, and then closed and charged off the account *************** to Respond to My Attempts to Resolve the Issue: I have made multiple attempts to contact Orbit Leasing through phone calls and voicemails. I was hung up on, transferred to voicemail with no response, and repeatedly transferred to representatives who refused to address the issue.Request for Resolution:I request the BBB to investigate Orbit Leasing for violations of the ***** specifically:15 U.S. Code 1681s-2(a): Obligation of furnishers to provide accurate information.15 U.S. Code 1681e(b): Requirement for maximum accuracy in credit reporting.I am also asking for the immediate deletion of this account from my ********** and Equifax credit reports and for Orbit Leasing to be held accountable for their deceptive practices.Attachments:I am including:1.Copies of my credit reports showing the false and inaccurate reporting. Thank you for addressing this matter. Please let me know if further information is needed.

Thank you for reaching out.  At Orbit Leasing, we work hard to make sure that we provide a top-notch customer service experience to all our customers.

******************** conducted a thorough and in-depth investigation of our reporting of the customers account to the consumer reporting agencies, and we verify that the information we are reporting is consistent with our records.

The customers account was charged-off, but the account was not sent to a collections agency. We have never reported that the customers account was sent to a collections agency. Orbit Leasing has consistently reported the account as charged-off, and we have not been reporting late payments.

Orbit Leasing has never reported the account as closed, and, therefore, has never reported the account as reopened nor has it reversed the charge-off.

Orbit Leasing reports identical information about the customers account to both ********** and Equifax (we do not report to Experian). While we report the same information to each credit reporting agency, we have no control or influence over the ways the credit reporting agencies display that information. We understand that this can be confusing; but please know that we have no control over this.

Because the customer disputes the information we are reporting, we have marked the account as disputed with the consumer reporting agencies.

The customer has requested multiple good-will adjustments to their account. While we understand the customers predicament and respect their requests, we must furnish information to consumer reporting agencies with accuracy and integrity.

Also, Orbit Leasing has responded to the customers numerous communications with us. It appears that the customer would like this account removed from their credit report and is peppering Orbit Leasing with disputes about its correct reporting of their charged-off account in the hopes that we will simple delete our reporting of the account.

******************** has mailed the customer copies of their signed lease agreement and account payment history to the address provided in this dispute.

We invite the customer to call our office at ************** to discuss their concerns.  We are here to help!

    Thank you

I am rejecting this response because:
That is an automated message that does nothing but repeat the same thing over and over. In there response they said that they never reported the account as closed so when were they going to inform me that the account was still open?? Also when I contacted the credit bureaus they were the ones that told me that orbit leasing send them the information and reported the late payments. Im not sure why they are refusing to remove this 6+ year old account off my credit report that they have been reporting late payments on for the past 4-5 years but if they claim they havent then I would like them to contact the credit bureaus and have them tell me who has been reporting the late payments and who is responsible for closing the account since ******************** is claiming they never closed it
    Sincerely,

I got the car 2 weeks ago I make 1100A week. I was approved for a crappy car. I'm having major issues with the car. They will not let me speak to anybody higher up corporate or nothing. They've been sending me in circles, and I just want a better reliable car or terminate my lease. They will not help me. They were quick to put me in the deal, but not resolve my issue. I haven't even paid my first payment. In all I have 4 lights on, including the check engine.

I have been attempting to do a voluntary repossession of my 2017 **** I am not able to make the payments and have purchased a new vehicle. It has been weeks and multiple calls and texts. I have been told various reasons why the vehicle has not been picked up yet. I was told it takes AT LEAST 45 days(they are able then to add yet another payment to my bill in addition to the remainder). I have been told they can not tell me the tow company. I have been told the legal team has to look at it, I was told the manager will need to be made awareand so on. This car can not remain where it is for any more time. It has been a few weeks. The car is about to be towed from its current placewhich they are well aware of by myself and the owner of the property. I have given them multiple times and days to pick up the car. They are well aware the car will be towed. There is zero urgency for the matter of this voluntary repossession of THEIR PROPERTY!!! I am at a loss as to what steps to do next. I have tried to let them know all information. I have recently asked for any and all paperwork regarding this as I was told they have started the process weeks ago. I have yet to see a response. Thank you

I have been an Orbit Leasing customer for approx. 4 years, and my second car with them. I have payed my payments through out these years and taken exceptional care of the vehicle. I have had an extremely hard time the past 6 month financially and emotionally. I have a disability, PTSD,( worked as a Paramedic for 20 years) and many mental issues that I deal with daily. I am a Paraprofessional at a local school currently. I had a mental breakdown in June and issues working and I became a little behind. I owe $777 and they have had my vehicle shut off for a month now. And they will not work with me. ******** is rude and makes threats of shutting off the car if I dont pay this or that. I know that I owe, I start work back up next week and they will not turn my car on.THE PROBLEM: -I have missed a lot of important medical appointments.-My mental health is teetering becuase HOW AM I GOING TO GET TO WORK? How will I get my son to and from school? -I have unable to due laundry in 3 weeks -I just put the a new battery in a few month ago, now car is dead and they wont even turn it on so I can start it and charge it.-Rear brakes are shot -This is ruining the vehicle the longer it sits.-I am a single mom with no help or resources available,HOW DO I GO TO WORK TO MAKE MONEY TO PAY THIS CAR OFF?????? My mental health is not well all becuase I have had no vehicle. What a horrible summer for my 13 year old. Do you know how embarrassing it is to ask for help everyday, and not get any. I feel that this company takes enough advantage of me and so many others because we are struggling, they are making a killing off of me. Why cant they at least let me get to work, get my kid to school. Orbit leasing employees are rude and treat me like a child, they threaten me, they have turned my vehicle off and left me stranded. If I do not make it to work next week, I will loose my job, that is what Orbit wants so they can repossess my vehicle so they make money. 2013 vehicle, I owe 11K

They are reporting voluntary repo on my credit report and that is false information. Not even 30 days in and the truck had to go to a repair shop they referred me too and the manager of that shop stated HOW did this vehicle pass inspection needing this much work. I asked them to service it and instead I got a offer letter to purchase the vehicle for $3995. The amount they are reporting when originally it was around $22,000. HOW can they report that when I asked during a test drive if the vehicle had been inspected and they assured me it had been. SMH. I called to ask WHY this was being reported as such and their legal department did not even care to explain WHY. I had +****** in green on my report the 1st time I disputed this and now it's back for whatever reason but I do NOT owe them that amount! Why would you all not service it? But the audacity to confirm it had been serviced prior and it was good. It's really sad people have to go thru things as such and have their credit affected. I had my kids that day as well and it's sick you all were that willing and still until this day tried selling a lemon as such and reporting FALSE information is beyond me

Thank you for reaching out. At Orbit Leasing, we work hard to make sure that we provide a top-notch customer service experience for all our customers.

According to our records, the customer leased their vehicle on July 2, 2021.
In August 2021, the vehicle required repairs. All of the repairs would have been covered by the customers warranty, requiring only that the customer pay a $100 deductible. The customer refused to do so. During the time the customers vehicle was at the repair facility, the consumer was provided a courtesy vehicle to meet their transportation needs.
After defaulting on their lease for nonpayment, the vehicle was voluntarily surrendered in September 2021. After the surrender and auction sale of the vehicle, a deficiency balance remained of $3995.
If the customer has any further questions, they may call our office at ************. We are here to help!

I am rejecting this response because:

The information you all are reading in your system notes made by multiple customer service agents, I'm sure, are definitely invalid.

Are you seeing the multiple requests for help as to why I was put in a vehicle that needed that much work? *****-whom is no longer with the company, was the person I was advised to have to contact with the various of issues experienced and unfortunately ***** was not so responsive nor willing to assist. I spoke with Orbit leasing last week and curious as to how it is being stated I had warranty here but when I spoke to the legal department they stated I did not have warranty. I should of not of had to pay anything due to this vehicle passing inspection at Car city's lot needing well over $5500 worth of work. I did NOT surrender the vehicle, it was brought back to be serviced and I just never received a call to pick it up but instead, you all are reporting false repo information. I asked the salesman beforehand had the vehicle been serviced and he assured me it had been. Please remove the false information

    Sincerely,

Hello- Is there a way to edit the complaint and add that I am disputing the amount of the $3995?

    Thanks so much

    Business Response

    Date: 08/01/2024

    August 1, 2024

We reiterate the following: according to our records, the customer leased their vehicle on July 2, 2021.

We conducted an investigation of our reporting of the customers account to the consumer reporting agencies, and we verify that the information we are reporting is consistent with our records.  Because we must continue to report the account information to the consumer reporting agencies with accuracy and integrity, we are unable to make a goodwill adjustment to the information in the credit report.  Because the customer disputes the information we are reporting, we have marked the account as disputed with the consumer reporting agencies.

    Sincerely,

I voluntarily let a vehicle go. The 1st month I had the vehicle I had to put it in the shop to have the transmission replaced. Went without it for 2 months. Things kept breaking on the vehicle, nickel and diming me to death on top of the 500$ monthly payment and it being during the pandemic. I was displaced and thought I would do the right thing and give the vehicle back.Orbit sold it at a auction for PENNIES BUT are trying to suit me for over 8500$. I am just trying to survive and do right by people!
