    Dumpster Rental from 7-3-24 to 7-11-24. Whole experience was online. The total of all invoice line items: $574.32 Disputed dollar amount is regarding a "dry run fee" of $155.25. I remember checking a box to proceed, but apparently that check box was agreeing to a whole host of terms & conditions that I was not aware of. It was not clear to me that I was signing a contract, and it was not clear to me that that checkbox may have given them permission to store and retain my credit card information for future billing. On the original pick-up day of July 10th, the business operator drove to my home (the dumpster pick up location) before the start of his posted business hours. As I have a partial electric vehicle and a one car driveway, the dumpster was blocked by my charging vehicle. No one was awake due to the early hours, and the operator was not able to reach me or anyone in the home to move the car and was therefore unable to pick-up the dumpster. Later that morning, I noticed that I missed his phone call and called back. He quickly stated the $150 dry run fee. I complained that he came too early. He replied that he was within the listed operating hours on google and on the contract terms. Things quickly escalated to verbal abuse from him to me. He used many expletives. He threatened to call the cops. He threatened to maliciously damage my property. He threatened to involve a lawyer and place a lien on my house. This caused much emotional distress. Note: according to the google maps listed hours for his business he was outside that time window. I do not know the operating hours listed in the terms of the rental agreement. After the rental was complete, I reached out to request documentation of the terms of the agreement/contract. He again was very confrontational. I still do not have the documented terms of the agreement/contract. He threatened a lawyer/lien again. And has threatened to charge me $2.50 per minute that I occupy his time requesting assistance.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of why I am rejecting this response appear below:

    In the business's reply, they stated that they deny the verbal abuse and expletives. The phone call was on speakerphone, and there was a witness present to the verbal abuse. Denial is unacceptable. I would like to amend my requested resolution to include an acknowledgement of mistreatment and apology from the operator. 

    Additionally, the business stated the following: "Once all account matters are resolved, we will process his request for deletion and confirm completion." As I am not requesting a refund thru BBB, it is my understanding that 'all account matters' are closed. There is no further reason for the business to retain my credit card information. 

    Additionally, the business stated that the operating hours are listed in the agreement. The only agreement that was provided was a link in an email, despite my request for a pdf attachment. As the link today appears expired, I was not able to verify that the operating hours were listed in the agreement, nor that the disputed instance occurred within or outside of those hours.

    Dear Ms. ******,
    We are writing to address the recent communication from Mr. **** ******* concerning his complaint against United Dumpster Rental Services, LLC. While we have previously provided a comprehensive response to his claims, it has come to our attention that Mr. ******* may be disseminating false and defamatory statements about our company beyond this complaint.
    Allegations of Defamation:
    We have reason to believe that Mr. ******* is engaging in activities that malign our company's reputation through the spread of false information. Such actions constitute defamation, which is actionable under Michigan law. According to Michigan Compiled Laws § 600.2911, defamation involves the communication of a false statement to a third party, resulting in harm to the subject's reputation.
    Cease and Desist Demand:
    We hereby formally demand that Mr. ******* immediately cease and desist from making any further false or defamatory statements about United Dumpster Rental Services, LLC. Continued dissemination of such statements will compel us to pursue all available legal remedies to protect our company's reputation, including but not limited to filing a lawsuit for defamation.
    Legal Implications:
    Under Michigan law, defamation can lead to significant legal consequences. Should Mr. ******* persist in this conduct, we will seek all appropriate damages, including compensatory and punitive damages, as well as recovery of legal fees incurred in the process.
    We trust that this matter can be resolved amicably and without further escalation. However, we are prepared to take the necessary legal actions to protect our business interests and reputation.

    In my opinion, during our interactions (before and within BBB), the owner of this business has continued to use intimidation tactics, such as threatening legal action against me for baselessly alleged defamation, rather than responding to the issues at hand. I believe this is because his behavior was inappropriate, and I believe he has no remorse for his abusive actions. I warn others away from patronizing this business.
