Government Actions
On October 21, 2024, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11(b)(6)(8)(9);; 326B.809; 326B.811, subd. 2; 326B.84 (2)(4)(14)(15)(16) (2022) and Minn. Rule 2891.0040, subp. 1D (2021). Under terms of the Order, the business agreed to ensure that customers whose work is paid by insurance are given the required Notice of Right to Cancel prior to the agreement/contract being executed; have all agreements, including contracts and change orders be in writing, per Minnesota Statute; fully comply with all parts of the agreements/contracts and to provide reasonable supervision to all employees, subcontractors and sales persons. The business also agreed to ensure all invoices are accurate and reflect the agreement/contract and change orders; to maintain complete job files for at least three years and ensure all future communications with DLI are complete and accurate.
The business will also pay $5,000.00 of a $10,500.00 fine, with the balance stayed on the condition that they fully comply with the terms of the Order and have no future violations of any laws, rules or orders under DLI authority for six years (October 2030) at which time the full penalty will be forgiven.
