On March 14, 2023, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business engaged in fraudulent, deceptive or dishonest practices by making misrepresentations when setting up contracts, allowing representatives of the business to perform electrical and plumbing work without filing permits and contracting with Minnesota consumers while their residential building license was inactive, violations of Minn. Stat. 326B.082, subd. 11 (b)(8), 326B.84 (2)(2020) and Minn. Rule 2891.0040, subp. 1C, 1F and 1H (2021). The Order further settles allegations that the business demonstrated incompetency or financial irresponsibility by hiring unlicensed entities or individuals to perform plumbing work and electrical work on their behalf; and not filing electrical permits and circumventing the permitting requirements for plumbing and electrical work to increase profits, a violation of Minn. Stat. 326B.082, subd. 11 (b)(9) and 326B.84 (15) (2020). The business owner is further alleged to have failed to reasonably supervise employees, subcontractors and salespersons, a violation of Minn. Stat. 326B.84 (4) (2020) and failed to complete the required continuing education to maintain his qualifying builder registration between April, 1, 2020 and March 21, 2022, a violation of Minn. Stat. 326B.821 (2020). The Order also settles allegations that the business performed or offered to perform plumbing work without a plumbing contractor license, a violation of Minn. Stat. 326B.46, subd. 1(a)(b)(c), 1b, 2 and 326B.47 (2020) and to perform electrical work without an electrical contractor license, a violation of Minn. Stat. 326B.33, subds. 1,2,12,14,15 and 16 (2020) and did not apply for an electrical permit at the time or before beginning work, a violation of Minn. Stat. 326B.36 (2020). The business is also alleged to have failed to cooperate with DLI's investigation by providing false, misleading or incomplete information, a violation of Minn. Stat. 326B.082, subd. 11 (b)(2)(6) and 326B.84 (14) (2020). The business is also alleged to have failed to maintain records showing all plans, contracts, documents, receipts and disbursements of all transactions as a contractor for three years and to have the documents available for inspection by DLI, a violation of Minn. Stat. 326B.082, subd. 11 (b)(1) (2020) and Minn. Rule 2891.0020 (2021).
Under terms of the Consent Order, the business agreed to a stay of the revocation of the business's residential building contractor license and the qualifying builder license of the owner, contingent on their full compliance with the following: to cease and desist from performing electrical work in Minnesota, until the business obtains the required Minnesota electrical contractor license; to cease and desist from performing plumbing work in Minnesota until the business obtains the required Minnesota plumbing license and shall confirm that all subcontractors are properly licensed to perform electrical or plumbing work on behalf of the business and all required permits will be requested before beginning work. The business agreed to properly provide reasonable supervision to its employees, subcontractors and sales staff and maintain records of all plans, contracts, documents, receipts as required. The business agreed to ensure its designated qualifying building has an active registration and complies with continuing education requirements and all future communications with DLI are complete, accurate and truthful. The business agreed to pay $25,000.00 of a $50,000.00 fine, with the balance stayed on the condition the business fully complies with the terms of the Order.
