    I hired this contractor to dig out an area to place a 27 foot above ground pool, deliver a quality sand, place the concrete blocks that support the pool. We have had a lot of rain before he came out, and I talked with him a few days before he planned on coming out and let him know there was a lot of wet areas at the site, and maybe we should wait until Monday or Tuesday. He said it should be ok, and he had another job. I told him ok, I will leave it up to him when he arrived. He arrived around 3PM Saturday the 14th of May and we marked out the area. I had to leave the site to pick up some blocks for him. When I returned my yard near the site was torn up. He said it could not be helped since it was so wet. He also said he could not complete the job because of the wet soil. He laid down a sub par sand that is not recommended for a pool. I made that very clear in our conversations that the sand could not have pebbles. While we were looking at the area just before he was going to leave, he said "I won't Charge You Today For What I Did" He then said he would need another $800 to come back and fix the yard and complete project. I went to talk to my GF and he walked over asking to be paid $1500 in CASH! I reminded him of what he just said and he got extremely angry accusing me of "Ripping Him Off" I went into my house, gave him $500 CASH and a $1000 check. He said he would be back. The next day my GF and I went to pool site, say large pebbles in the sane and a broken bottle and other glass, I told **** and he said no problem, we will just cover it! I then called my pool vendor and they said the glass couled work it's way back up. I stopped payment on his check and sent him an e-mail asking he come out, remove the sand he placed. Put ***** sand down, and repair damage to my yard. I later get an e-mil from him telling me I ripped him off, and he would file a lien and file a complaint if I bothered him again!

    I received a call from ******************* on May 9th 2022.**** was reaching out because he had a 30' pool that he needed a pad graded for. He was located in **** **. **** is further out than my normal working area, but because I would be in ****** on May 11th I could stop by and give him an estimate.

    I met with **** and he told us how frustrated he was with local companies. He was in a hurry because of the short ** summer to get his pool set up.We determined behind his house and garage was the best place because of the high ground. We agreed on $1500.00,this included me grading with laser precision, I would supply 6 yards of sand for a base, and I would keep the spoils on site. **** asked if he could pay us more to help set "blocks" for the uprights of the pool. We agreed on $300.00 for us to help him with the blocks once the pad was graded out. We agreed on this being a cash job. I explained to **** that I am starting a large job on the St. Croix on the 16th and that it would take me at least a week. As we were there it was raining, we have had a very wet May. **** insisted I do it the 14th because he had his girlfriend and her son to help set up the pool and the forecast looked good. I explained to him it would not be until the afternoon because I was helping a friend Saturday am. **** and I texted through out the week which I have all the texts saved. **** lives right next to a wetland. His property is very low and he is in all ***** As a matter of fact, the gravel road in front of his house has 2" river rock the city laid down because of the road being flooded. If you look on ****** Maps with Bill's address you will see this. **** was very impatient to get this pool done. I asked **** in writing if everything was dry and expressed my concern of the wet area. He responded "it should be ok."

    I picked up 6 yards of washed sand from a local landscape supply store on Saturday. I met with my laborer/friend and we drove up to Bill's in ****. We got to Bill's. **** knew we were coming in the afternoon, which I also have in text message from earlier that week. He was going to have the "blocks" on site for us to help him once we graded out the pool pad. **** did not have the blocks, he said he had to leave to go get them. He then showed us the new location for the pool. It was not where he first wanted it (which was also the best place for it),but it was 100 feet closer to the wetland, and also 18" lower in elevation. We drove up there to get the job done. I am flexible and I work with people of all sorts. I get people change their minds, not a big deal. The new location was on a slight hill. We **** out a 30' diameter pool pad. We set grade at the lowest elevation under the organic layer. This is untouched virgin ground as **** wanted for his pool pad. **** and his girlfriend were with me for all of this. **** and ***** wanted me to dump the fill I accumulated about 100 yards away along their grass line and the wetland. I explained to them that my bobcat has tracks and that it will make a mess.

    **** left to get the blocks, he made it seem like he was going to be gone for a short period of time. As I started the work I was bringing the fill across the low area towards the swamp, and water was literally bubbling up as I drove. It was making a muddy mess. Bill's girlfriend and her son, both grown adults, were right there with us. We all agreed that keeping the piles close to the pool area would be best for now. We accumulated around 30 yards of fill. I kept the piles about 30 ft. away from the pool area. We laser graded the pool area, it was level. We used the sand for a base.

    As **** explained, the pool area was graded, that is what I was there for. We waited for ****, and as we waited the pool pad was getting saturated from ground water. The water table was so high from all the rain, and Bill's property being so low and next to the wetland made for a bad combination, not to mention his change in location. He wanted to get his pool set up the same day and it was just not going to happen until it dried out. I explained to **** that I am more than willing to come back out once it made sense, and at that time, we can help him with the pool set up. I told him I would not charge him for the block portion of the job ($300),however, I did want to be paid for the sand and the grading. **** was upset that he couldn't set up the pool and that his girlfriend's son came up from ********.

    I said to ****, there's nothing I can do. I did my job, I want to be paid for it. I take no money down. I paid for the sand. I have to pay my worker. **** and I came up with a plan for me to come back out to help him when it dried up. I would help with the blocks AND set the pool up. He gave me $500 cash and a $1000.00 check, a total of $1500 that was for my grading work and sand. I received text messages from **** that night stating that he had referred me to his neighbor for driveway work. I also received a message from **** stating that " I apologize for acting like an ***, just totally stressed." He wrote the next day how things really dried up out there, everything was good. Then 2 days goes by and I receive a long email from **** and he cancelled the check. He totally ripped me off. I gave you the exact story of what happened. When I was at his place, his girlfriend and son both stated that **** gets his "wires crossed" once in awhile. I did my part. I will stand up for myself here and say that **** is impossible. I did everything on my end to please ****. I made no money. I was also charged a fee for the cancelled check from my bank. I do grading work every day. I was in contact with ****. I was willing to help ****. I truely believe that this is a routine of Bill's. I have all the messages to share. I could honestly press charges for theft of services, however, I choose to take the high road. I totally disagree with this complaint.

    I had to hire ****************** to clean up the mess in my yard. The new landscaper informed me All Saints dug down the pool area too low in the low and had to be completely re done. At this point I just want it on record I had to spend $2000 to repair damage All Saints did to my property. I had two other landscapers tell me they would have never left a customer's yard torn up like ********************** did.
