    Date of transaction: 1/18/24 AM Replacement cost ( $ ****** ) of damage that occurred to my vehicle, during the loading process onto their tow truck.The driver ( ********* Took a picture at the time the damage occurred. The steering stabilizer shock started leaking oil immediately after the loading chain put pressure on it.I was informed by the driver ( *** ) to file a damage report so I did that same day.Reference number # TB24-96727 The safety Cordenator ( Rich) hung up the phone on me when I tried talking to him about a resolution to the problem. I have left several messages for **** and he refuses to return my voice messages.The driver, *** admitted that there was damage done to the shock, it started leaking oil immediately and a picture needed to taken and a damage report needed to be filed.I did what I was instructed to do that same day.

    To whom it may concern,

    This is in response to a complaint you received from a *********************** about our driver damaging his stabilizer shock.  We have had several contacts with **************** about this incident and have explained to him why we are not going to cover his claim.  First, the story given by our driver does not match the story given by ****************.  The driver states he did not hook onto the stabilizer.  He did put a chain over the stabilizer, but never put any tension on the chain and moved it before he put any tension on it.  The driver said it appeared that the stabilizer had been leaking prior to him putting the chain over it but did not want to argue with the customer so just took photos of it and passed it on.  The pictures we received showed there was a buildup of dust and debris in the oil around the end of the stabilizer from where it had been leaking.  We showed this to 3 of our mechanics and all 3 said that the stabilizer had to have been leaking prior to it being put on the truck for that amount of debris to be built up in the oil on the end of the stabilizer.  The driver said he did not transport the vehicle with anything wrapped around the stabilizer.  We explained several times to **************** why we were not going to fix his stabilizer and he would not except our answer.  **************** kept calling and leaving messages and we just decided to quit dealing with him.

     I am rejecting this response because:

    This is in response to the reply from Schmidt Towing Company. Their response is not satisfactory to me. I never stated the driver hooked on the stabilizer. In fact, the chain was hooked under the stabilizer not over as you stated. it was when the driver put tension on the chain to pull the truck onto the flatbed when the stabilizer start leaking. I suggested to put a 4 x 4 wooden block under the frame to change the angle for better pulling. Then the chain would not be rubbing on the stabilizer. The driver agreed, Looked for a 4 x 4 block, could not find one, So I gave him one of mine to use. This worked well, and there was no tension of the chain on the stabilizer.

    To proceed forward for a resolution. I am willing to split the repair cost 50% of the total, responsibility to each party. 50% from Schmidt towing.

    I already paid the repair cost in full to A certified mechanic.
