    According to BBB Code of Advertising,“Despite anadvertiser’s best efforts to ascertain competitive prices, the rapidity withwhich prices fluctuate and the difficulty of determining prices of all sellersat all times preclude an absolute knowledge of the truth of unqualifiedunderselling/lowest price claims. Advertisers can lessen the potential forconsumer confusion by appropriate qualifications to any underselling/lowestprice claim such as by stating, if truthful, that the advertiser will meet orbeat a lower price.”

     

    BBB Code of Advertising also states, “Superlative statements inadvertisements about the tangible qualities and performance values of a productor service are objective claims for which the advertiser must possesssubstantiation as they can be based upon accepted standards or tests. Asstatements of fact, such claims, like “#1 in new car sales in the city,” can beproved or disproved.”

    Inaddition, the BBB Code of Advertising states, “When using the term “warranty” or“guarantee” in product advertising, the advertiser must clearly andconspicuously include a statement that the complete details of the warranty canbe seen prior to sale at the advertiser's location, viewed on the advertiser’swebsite or, in the case of mail or telephone order sales, made available freeon written request. Advertisers should only use “satisfaction guarantee,”“money back guarantee,” “free trial offer,” or similar representations inadvertising if the seller or manufacturer refunds the full purchase price ofthe advertised product or service at the consumer's request. When “satisfactionguarantee” or similar representations are used in advertising, any materiallimitations or conditions that apply to the guarantee must be clearly andconspicuously disclosed."
