I purchased a vehicle from K&C Budget Lot LLC on 8/26/24.Paid KCBL $100 to hold the car until the next day to obtain insurance under the car lot's rules.Was provided with a list of acceptable/unacceptable insurance providers&insurance could be no more than $400/month.I obtained coverage required by KCBL from *********** for $240/month&emailed the declaration page to them on 8/27/24.Paid them another $600.I signed all ppwk.I was to make semi-monthly payments of $260. 10/29/24 I received an email from *********** telling me they had cancelled my policy.I called them on 10/30/24 questioning why my policy was cancelled.Was transferred to the underwriting department,lady I spoke with said they sent me an email two weeks ago with questions regarding my policy&I had failed to respond.They refunded my remaining premium amount so I go to get a new insurance policy on 10/30/24 to not have my insurance lapse&violate my sales contract.I told KCBL the list of companies that they deemed acceptable-over half of them won't accept me based on a previous traffic violation-rest of the companies deemed acceptable had pmts over $400/month.Could find insurance under $400/month but were on the companies unacceptable list.No way I could meet the car lot's requirements-even though I could meet the coverage requirements.I contacted them asking for help-advice-anything they could to aid in me keeping my car-they chose not to respond.Get a letter in the mail stating that if I didn't provide proof of insurance within 10 days of that letter they would repossess the car.Contacted them asking why they wouldn't work with me on obtaining insurance we both could agree on-no response.Woke up to email on 11/16/24 from lot stating they had repossessed my car.I had until 230pm that day to bring them the keys&collect my personal belongings from them.I had no one to take me.I still have the keys, original title. etc. have not heard ANYTHING from them since 11/16/24, was current on pmtsBusiness Response

After review of this complaint K&C Budget Lot, LLC did lawfully repossess Mrs. Huey’s vehicle on 11/16/2024 due to default of the Retail Installment Sales Contract that **** **** signed 8/27/2024.
With respect to **** ****** complaint, we would like to address some of the comments and claims that were made. On 9/19/2024 we received a call from a special investigator with *********** insurance who was investigating a claim that was made on the Subaru that **** **** purchased from us. On or about 10-24-2024 **** **** received an insurance claim check in the amount of $2,158.12 that was made out to both K&C Budget Lot and Taylor R Huey that was cashed on or about 11-2-2024 by **** **** without our endorsement or consent and no repairs to the damage on the vehicle were performed at any time. (see attached documents) We are not sure about the legality of her actions and are consulting with council on this matter. K&C Budget Lot LLC made several attempts to rectify these issues with **** **** with no resolve. K&C Budget Lot, LLC has no intention of any refund, replacement, or trade of vehicle. During the 3 months that **** **** was in possession of the vehicle, she had paid in a total on $1,740.00(this includes down payment and all payments paid.) **** **** fraudulently cashed an insurance check in the amount of $2,158.12 that was to be used to repair that collateral but wasn’t. K&C Budget Lot, LLC has been burdened with damaged collateral, baseless allegations, and continued expenses. **** **** entered into an Agreement to Arbitrate with K&C Budget Lot LLC to resolve any claim dispute that she may choose to exercise. In conclusion, **** **** defaulted on her loan by not maintaining insurance as she agreed, withheld ins. claim funds fraudulently, and has made misleading and false accusations towards K&C Budget Lot LLC.
Repossessions are not beneficial to any party involved, be the debtor or the creditor and this could have all been avoided had **** **** just simply abided by the terms of the contract.

I am rejecting this response because:These statements will be answered respectfully to K&C Budget Lot's response to my complaint:
In regards to the call from the special investigator, with whom I spoke with two times, I thought this was due to ******* from the Finance Dept. having left messages for me on how to maximize the claim amount. Also, I had went into the *********** app and was adding on extra coverage and hit a wrong button which updated my coverage or something. I immediately called *********** and the car lot once I had seen what I had done and nothing was said about anything. Nothing was done incorrectly on my part when the initial claim was filed on the Subaru. I attached these voicemails in my original complaint. In regards to the claim check, I was harassed about this check once ******* found out that it had been mailed out. Ten calls in one day about this check and I hadn't even received it yet. I attached voicemails, recorded conversations, and screenshots of the constant contact ******* made with me from the time I filed the claim until I finally told him to stop calling me about it. Those are all attached with the original complaint. I did not feel comfortable giving ******* that check due to him never informing me on how the repairs were going to be done, only how he was going to pay down my loan. I went to a PNC Bank, the issuing bank of the *********** cIaim check and spoke with the manager of the branch and showed them the check. They allowed me to open an account and deposit that check, and therefore I purchased new parts for my Subaru and had appointments set up to get the repairs done on MY TIME, not *******'s time. I was utilizing the amount of that check to repair THE collateral even though the estimate for only one part of the car was over $3100. I did NOT need their endorsement on the check and this was after speaking with an insurance claims lawyer. As long as the repairs were going to be made with the check, which they were, then there could be nothing fraudulent occurring. I have since had to return all the parts that were in my home when the car lot repossessed the car.
The car lot made ZERO attempts to rectify anything with the claim check (except how to pay down my loan) NOR the insurance issue resulting in the repossession. Attached any communication on both of those subjects with the car lot in the original complaint. They only sent me letters and unveiled threats over voicemail. They know they had NO intention of helping to make sure I kept that car because this is what they do. If not, they would have worked with me on obtaining insurance they approved of, even if it was through them as their contract states, however, they did not.
Repossessions are beneficial when you continuously do it, it is a term I have found out from consumer attorneys is called "turning".
I am in the process of starting arbitration with this company. Before a panel of judges their business practices will not look to be in good faith, knowing I communicated the issues I was having with their insurance rules and especially knowing that the repossession of the vehicle has led to a loss of job and the host of other things that come with losing your vehicle and job. Again, when asking the company you are buying a car from for help in obtaining car insurance, in particular when they have approved and not approved insurance providers and then stipulating the cost of that monthly payment, as well as stating that if I should not be able to obtain on my own, they would help in obtaining through them based on their contract. However, with whom I carry insurance with and my monthly payment should not be dictated by them especially as long as I am meeting their coverage requirements and maintaining my fiscal responsibility.

This will be our final response to this complaint as this is becoming superfluous.
We do not know why a special investigator became involved on this claim as that is something that the insurance company directs. Furthermore, it is common practice to negotiate with insurance companies on the amount of a claim to get the optimal amount to repair the collateral damage as a lot of times the amount is not enough just as complainant mentions in the complaint.
Regarding the claim check. Both parties signed a contract that stipulates any and all proceeds from insurance claims be made out to both parties and the funds be used to either repair the vehicle or applied to the balance of the loan. The check for the claim was made out to “K&C Budget Lot AND ****** ****.” A joint endorsement is required when a check is made out to two or more people. This ensures that all parties agree to cashing or depositing the check. This matter is currently being investigated as the claim check did NOT say “K&C Budget Lot OR ****** ****” and appears to have been a mistake by the bank by accepting an unendorsed check on complainant’s behalf. K&C Budget Lot allows a vehicle to be repaired by a legitimate repair facility however complainant didn’t want to go that direction and proceeded to profit from the collateral damage.
Repossessions are not beneficial as we prefer that customers just pay their payments and keep insurance during the duration of the loan. This particular situation is a perfect example of a repossession not being beneficial for K&C Budget Lot as we have a vehicle that is damaged without insurance funds to repair, and has depreciated in value due to milage and excessive wear that we are now burdened with.
K&C Budget Lot will have to repair and recondition the vehicle in order to attempt to recover losses. At that point we will dispose the collateral and apply the proceeds to complainant’s balance. A notice of surplus or deficiency will be sent to complainant at that time.
As a lien holder we are not required to provide vehicle insurance as that is the customers responsibility to do as is agreed to in the retail installment agreement that both parties signed at time of purchase.

Sold me a vehicle that they claim had had 1400 of body work done from a body shop that doesn't exist and the front end where the body work supposedly occured fell off and was dragging first time I drove on the highway. At speeds of 50 mph the kia would downshift lose power and would even stall. The tachometer would freeze them stick at zero rpm even stalling out several times and dying in traffic, I took the vehicle back and told them about the front end and they rigged it with a clip right there in the parking lot , the entire front bumper mind you it looked horrible and barely hung there sad for that much labor in body that supposedly was done and pathetic that I was to spend over 10,000 for a car that wouldn't run over 50mph and that made a horrible sound running down the highway still. They hooked the car up to ahand held tester and said I wasn't getting compression in the rear after they looked further they noticed the muffler was completly rusted aparty from tailpipe and sent me to a muffler shop for a quick 75 dollar spot weld and sent me on my way engine problem the same front end fluttering I the wind. A few days later An employee of there's came beating and pounding early morning on my door continuously when a no trespassing sign was clearly posted. He beat and beat on the door for over 5 minutes waking a small child and frighting his mom by the hard non stop pounding on the door . And woke me who works half the time overnight to give me a business card of the owner ******* and said to call him. My payment of 80 dollars was four days late. I was frustrated after being accused of me being the one causing the body damage buy there employee over and over and intimated to even call and let them know the clip didn't hold the front bumper and the spot weld did not fix the engine. They ultimately took the car from my job while I was working owing 80;dollars on it. Car seat gone and refused to give it to babies mom but she was required to be insured on the carBusiness Response

K&C Budget Lot has reviewed this complaint. It appears that there are 5 components to the complaint and are explained/responded below.
#1. Complaint of body work. At time of sale, customer and dealer rep did a walk around vehicle and there was not any damage on vehicle and customer signed a form acknowledging this. Also, K&C Budget Lot, LLC provided customer with documentation that repairs had been completed. ********* **** **** *** is in-fact a registered business in Smithville Mo that does auto body painting and repairs********************************************************** Furthermore, customer brought the vehicle to us after he purchased the vehicle and the work that had been repaired appeared to be damaged again and we don’t know if customer did this, but we offered to have it fixed and customer never brought vehicle back to us to try to help.#2. Complaint of mechanical issues. Two days after purchase, customer called and said that the vehicle was not running right and was very loud. K&C Budget Lot, LLC had this repaired at no cost to the customer and never received any further complaints in regard to mechanical issues.
#3. Complaint of contact by lienholder. K&C Budget Lot, LLC attempted to contact the customer via phone, e-mail, and texting with no response in regard to payments and insurance that was not being paid. We did send a lienholder agent to contact customer at the home address with no response and did leave our business card for customer to contact us for which never happened until customer defaulted on the “Retail Installment Sale Contract” which resulted in the vehicle being repossessed.
#4. Complaint of personal belongings in repossessed vehicle. K&C Budget Lot LLC told customer that he may have any and all of the personal belongings and that we can release them to only the owner of the repossessed vehicle and will need the keys to the vehicle returned to the lienholder to which the customer has yet to do and still may if chooses to do so.
#5. Request of refund. We have it clearly posted that “All sales are final. No exchanges, returns, or refunds. Due to company policy, K&C Budget Lot, LLC is NOT refunding any money to customer.
Repossessions are unfortunate for not just the customer and the finance company/dealer but can and do happen when there is a default.Feel free to contact us if any questions. ************

I am rejecting this response because: it is full of lies and incorrect information . But mostly my complaint is about the 1000s of dollars of body work they sold me on and the first time I drove the vehicle over 50 mph the fender and bumper came unattached. It's obvious the play on words you see ******* never says the body work on that kia was done by ******* he just says there in Smithville and the do.body work. I' work in the body shop at Ford and have for 9 years . I know 100,% that no body shop would be able to pass that off on aanybody..HOW ABOUT CONTACT INFO OF ******** OWNER TO VERIFY THE WORK DONE ON THAT KIA ALONG WITH A PAID INVOICE ..YOU GUYS LIED AND SAID THAT THOUSANDS OF DOLLARS OF BODY WORK WAS DONE BY A BODY SHOP ********.. I KNOW THATS A LIE ..NO ONE IN THERE RUGHT MIND WOULD PAY FOR BODY WORK THAT COMES OFF THE CAR GOING DOWN THE HIGHWAY..YOU EXSPECT ME AND BBB to believe you when you say I must have mysterious ly wrecked the car in the same spots it was wrecked before and I did that and brought it back . Come on that's a bit far fetched..let's talk to the owners of ******** and verify all the work they supposedly did and why it was so horrible. You guys never said you would fix it ..your salesman said I must have wrecked it and asked the porter " if he had one of those clips' then the porter slid under the car and attempted to rig it up again right there in the parking lot. We all know the parts where put on by your porters and it was told to me it was done professionally. The truth will be revealed sooner or later. For now if I can verify the work was done by ******** ..the amount worked performed and the dates. We can figure this out because I know body work and no shop did what you claim.theres also several other lies ..there was no card left because no one was home ..the dude beat and beat and beat on the door over 8o bucks and handed me the cards I have witnessed ..but we can discuss all those things later .I want to speak to the man who supposedly did this body work ..and see invoice and signed completion invoice..

After further review of this complaint, K&C Budget Lot LLC completely disclosed all body work performed on purchased vehicle. Dealer explained at time of sale all work performed and customer signed three (3) separate forms that verifies this that are attached with this response.
#1 Acknowledgement of Disclosure by Dealer of Damage to Motor Vehicle (1 of 2): Details the repairs and costs that both dealer and customer signed at time of sale.#2 Acknowledgement of Disclosure by Dealer of Damage to Motor Vehicle (2 of 2): Vehicle inspected by both dealer and customer stating that no damage on purchased vehicle signed at time of sale.
#3 Delivery Confirmation – We Owe: Form stating that customer had an opportunity to not just test drive the vehicle but to inspect it for any problems, damage, or any other concerns regarding the purchased vehicle signed by both dealer and customer at time of sale.
All other complaints by customer have already been addressed in the previous response.
K&C Budget Lot, LLC is not refunding any money to customer as is company policy.

I am rejecting this response because******* the owner of KandC obviously thinks the BBB and I are incompetent as he refuses to answer the question,,, Was the 1538.24 of Body work performed by ******** Body Shop on the 2013 kia vin ***************** as indicated by the Acknowledgement of Disclosure that I've attached to this email..And if so it should be very simple to produce evidence of such work that can be verified. Very simple request yet you keep skipping around the question because you and I both know that it in fact was not done by a Professional Body shop and I was lied to in order to build value in the car and for you to turn a profit..As for the walk around and test drive . I was lied to about the body work and told I could take the car around the block..It wasn't till I drove at highway speeds that the front bumper and fender came loose. Something that never ever would happen after 2538.24 worth of body work had been performed. So let's see proof. And rest assured my team will be verifying any false statements or documents showing that that work was done on that kia. You shouldn't have to be shady to turn a profit that's sad sir.
