Mr. ***** was contracted to inspect the above location on 05.21.21. (See attachment A) Mr. ***** completed the inspections and sent email of results accordingly. (See attachments: B, B1-B5) Invoiced and paid the same day (See attachment C) We purchased the home on 06.25.21. Company movers scheduled 07.06.21 to deliver 07.10.21 *** arrived 07.06.21 with our dogs. Due to a situation outside of this event my 96 year young mother and myself could not move in. We moved into the residence on 08.03.21. After getting my mom set up and my doctors/treatments the end of the month was here. In going down into the basement I noticed a stench/smell. It concerned me so much I called a restoration company to find out what it was. Basement is riddled with mold. (See attachment D) An Air Quality check is also recommended (See attachment E) I reached out to Mr. ***** via email requesting reimbursement for the mold not being caught or mentioned. (See attachment F) His last correspondence to me was so he is choosing not to help me because of this in his contract that I did not follow. If I may point out some topics contained in his own contract: Paragraph 4: “A copy of this amendment will be included as Appendix A with inspection binder.” • There is no “binder”. • There was no Appendix A included anywhere. Paragraph 7: “INSPECTOR will provide CLIENT at INSPECTOR’S expense a 90 day Buyer’s Limited Warranty as issued by the American Home Warranty Company.” ”A copy of this amendment will be included with inspection binder as Appendix B.” • There is no “binder”. • There was no Buyer’s Limited Warranty provided to us. • There was no Appendix B included anywhere. Paragraph 10: “In the event of a grievance against INSPECTOR, CLIENT agrees to supply INSPECTOR with the following: 1) Written notification of adverse conditions, and (2) Access to the premises. I agree and understand that I will attempt to resolve any dispute informally. Should such an attempt fail, I agree to having the dispute submitted to binding arbitration under the rules and procedures of the Better Business Bureau posted at *********************************************************************************************************************************************************************************************************************************************************************************************************************************************************************************************************************** whether it be a breach of contract and/or tort and that the decision of the appointed arbitrator shall be honored and binding on the parties. A copy of this amendment will be included with inspection binder as Appendix C.” • There is no “binder”. • There was no Appendix C included anywhere. • I have emailed about the adverse conditions. • I have granted him access before this Thursday to come and see for himself. • I can not submit to binding arbitration (by his own words/authored contract) because he is not accredited with the BBB. Therefore I am submitting this dispute.
