      On June 6, 2024, I made a partial payment of $927.70 for a bed, chest, mattress, and box spring. On June 11, 2024, I made my full payment of $927.70, The furniture was delivered on June 29, 2024. Instead of receiving a new mattress, I received a floor sample. It also had a tag that states 50% off samples. The price I was charged for a new mattress was $999.99. I contacted the store, and they indicated someone would call me. The gentleman named *** left me a message. He attempted to tell me that the mattress was brand new. If that were the case, I would have received one without an orange sample tag stapled to the mattress. I think there was a bait and switch. I was charged the price of a new mattress and given a floor sample. I want half of the price of the mattress refunded to me.

      It was a brand new model that was meant to be a display. In the industry it is fairly common to have these set up for that use, it was never slept on before giving it over. It was intended to be a display but we ended up providing to them, that's why there is a tag. There are times when they pull for delivery they sometimes don't notice the sticker and don't remove it. So while it was intended to be a floor model, it is in fact brand brand new. We had made you aware of this in our last conversation.

      On 2-18-23, I ordered an ****** ****** sleeper sofa regular size from Midwest Clearance Center in ***** ****, Mo. I asked for experienced, trained delivery men. The delivery occurred on Wednesday, March 15, 23. The sofa arrived upwrapped, no bubble wrap from factory. The sofa was brought into my house with damage, a poke hole in the upper back rest of sofa. The delivery men promised to repair, replace or refund the damaged merchandise. I signed the delivery receipt with a personal note of damage and took a picture. I chose refund and Midwest picked up the sofa on March 16, 2023, I was refunded $867.70 of the total $1,036.79 that I originally paid. Midwest subtracted $169 for delivery charges. Midwest ********* ************* "***" said, "about 2 to 4 percent of our deliveries arrive damaged, therefore no refund on delivery charge" One hundred percent of the furniture they brought me was damaged. I have asked Midwest for the full refund, but the refuse to include the amount for the delivery charge. I am filing this complaint because I want the delivery charge of $169 refunded to me. The furniture was damaged.

      Hello, Mrs ****** ordered a sleeper sofa on 2/18/23 and we delivered it on 3/15/23.  From the manufacturer or the delivery process it ended up with damage. 

      Our policy is we reserve the right to make the product right.  Upon being notified of a warranty claim we inspect the damage.  If a repair is covered we service it in the home.  If it is not possible a replacement item may be authorized by the manufacturer.  If for some reason that item is no longer available the customer may re-select any item up to the original purchase amount.

      Upholstered items are typically easy for our service team and our senior tech will brag he builds sofas better than the factory.  All we asked for was a chance to make it right by servicing the sofa to likely better than factory specs and to the customer's satisfaction.  In this case we sent a second crew out already at no additional cost to Mrs. ****** and brought it back.

      We originally purchased a brand new mattress from them in 9/2019 that we had to return in 8/2020 because it had more than an 1 1/2 divits throughout the mattress and was less than a year old and their return policy is that if it has more than or equal to 1 1/2 inch indentions they will exchange it for a different mattress, they even have a video on their website of how to measure the indentions and what all needs to be submitted. So we did that and brought the matress back on 8/2/2020 and they exchanged it for another mattress that was a completely different make/model of a mattress. now we are two years later and are having the exact same problem with the 2nd mattress we got from them. So we submitted all the pictures and everything showing the indentions were an 1 1/2 and were requesting an exchange again. They came back saying that their mattress vendors only allow for one exchange and/or one return per purchase and since they already provided an exchange on the original purchase made in 2019, we are not eligible to claim any further exchange. So basically we are out $1000 and stuck with a mattress that neither of us can sleep on because it hurst our back so bad because of all the indentions in the bed. We are not made of money so to have to come up with that much to purchase a new mattress is just not in the cards for us.

      The ***** did purchase a mattress in in September of 2019.  In August of 2020 it did qualify for warranty and we traded it out with an equal value model at no cost.  Unfortunately the warranty only covers one exchange so we can not do a no cost exchange again.  We did offer to work with them on the price of a new mattress.

      I am rejecting this response because: we have only had this mattress for two years and there is no way it should have broke down that fast.  Mattress’s should last 10 plus years.  We are not going to purchase another $1000 mattress.  We paid good money so we could have a good mattress that lasts.  Obviously your inventory is not good and very cheaply made if we have already had to go through 2 brand new mattresses in 3 years with you.  I will not back down until we get a satisfactory resolution.

      We ordered furniture from Midwest Clearance at their Brentwood location. On 2/25/22, ordered two loveseats ($1138) and 4 dining chairs ($516), which were to arrive in April. We paid $169 for delivery. On 3/26/22, we added a table ($492) to the ordered and paid an additional $246. The table was to arrive mid-May at the latest. We chose to have all items delivered at the same time in order to only pay for one delivery fee. In early June, we were notified that the table would not be available until sometime in August. We decided to have the loveseats delivered now, and Midwest Clearance agreed to only charge $69 for the second delivery of the table once it becomes available. On June 8, 2022 we were charged an additional $400 for the remainder due on the loveseats, bringing the total amount paid to Midwest Clearance to $1506. The company agreed to deliver the loveseats on June 11, 2022. On June 10, 2022 they notified us that the loveseats would be delivered between 12-4 pm the next day. On 6/11/22 at 2:58 pm, we received a voicemail that from “****” the delivery driver that he would be here in 30-45 minutes. My mom sat on her front porch and waited for the delivery. No one ever showed up. At 4:14 pm she received a text message saying that they came and no one was there. She called the store and got the answering service. They told her to call back on 6/12.We have been trying to get Midwest Clearance to deliver the furniture. We were told we must pay and additional delivery fee if we want the loveseats delivered. We told them we expected the loveseats to be delivered at no additional charge. They were rude and lied to us repeatedly. They told us they sold the loveseats at too low of a cost to us anyway. They canceled our order and will not refund the original form of payment. They claim a check is in the mail, minus delivery fee. They told us to deal with their attorney, then refused to provide the attorney’s name. They have harassed me. #*****

      Hello,

      Mrs. ****** did order the furniture, did pay for it and we did attempt to deliver it.  Upon delivery our contract service found there was an entry code needed to enter the condominium, both us and our delivery service attempted to obtain it, were unsuccessful and we left.  We did offer re-delivery at a reduced rate and the option of cancelling the order.

      As the customer has decided we are forced to cancel the order and she will be receiving a full refund including the delivery free.

      I am rejecting this response because:
      Midwest Clearance is not being truthful in their response. First, no access key was needed since the customer was waiting outside the door for them. They never arrived. Either they went to the wrong building or didn't come at all. Secondly, they unilaterally canceled the order over our objection.  They STILL have not refunded us, making it impossible to order furniture elsewhere.  Additionally, they  told us that they sold the items to us at too low of a cost (which is probably why they cancelled the order.  We ordered the items in February. Now with inflation we cannot find replacement items for the same price - everything is significantly more expensive than it was when we placed the order.  The behavior of this company and its employees is disgraceful, and in violation of the law.
