Was told this company was going to sell my timeshare then I found out through the BBB that they were graded a F, and had 12 complants.

      Business response

      02/06/2024

We do not sell timeshares nor was client told that we do. Our grade with the BBB has no baring on our ability to complete the process of terminating their timeshare. We do have 12 complaints and are actually pleased with that number.  That shows a 99.1% satisfaction rate and although we strive for 100% satisfaction we know that it is not possible to make some people happy and with the length of processing time some clients get scared that they have been taken advantage of.   What you will not find in our complaints are people complaining that they cooperated with process and we did complete the process.  Client simply needs return requested documents and we will do exactly as promised.

On 02/20/2021 my 86 year old mother payed the company $8,995.00. For the company to help her get rid of her time share. The than ask her to pay an extra 1,600. She did not have any more money to pay them, she told them she could not do it for that reason. Money was never return to my elderly mother, and she still paying that credit card. So I am guessing they are going to keep her money, and act like nothing can be done. That is stealing from a poor elderly woman, no shame at all.

This complaint was addressed 06/16/2021 through the BBB.   There has been no change in our position.  There is no additional monies owed toward this contract.   We are waiting on documents not dollars.

      Customer response

      08/08/2023

The business wants paperwork, not sure what they need everything was given to them the day my mother payed. When I reach out to them I was told she needed to pay 1,600 for closing. I've told them the 9,000 she payed was all she had. Their response was oh well I guess your case goes to the back burner,  the exact words I was given.  My mother needs her money back, but I am guessing that will never happen.

On May 27, 2023 my husband and I went to a hotel in Watertown Ma. It was a seminar for cancellation of our timeshare. The name of the company is Nationwide Settlement Solutions. They are located at **** ** ********** **** ***** * ************ ** *****., phone number ###-###-####. The company seemed believable! The speaker was very fast talking. The contract should be null and void! Why I say that! it was never mentioned during the presentation that a power of attorney would be in the equation. Financial Recovery Advocates were never mentioned. The paperwork that was certified and delivered on July 6, 2023 states that it was mentioned in the contract, we would have to pay $1,300. ***** ******** the person that worked with us most definitely said that fee would be cancelled. Bits and pieces should not be mentioned after the fact and we pd. Nationwide Settlement Solutions a sum of $7,145.00 dollars. We want our deposit back because this company is a fraud in my eyes.

You will see on the attached contract that clients signed a clearly written addendum explaining the additional and that they both initialed signed line 13 of contract of the contract which again clearly explains this fee.  As client has not reached out to us to discuss their concerns we will call them to go over their contracts and address any concerns they have and to explain the difference in Limited Power of Attorney and a Power of Attorney.

They came to CA and have a seminar regarding a timeshare and we went to the presentation and I decided I would like them to execute the timeshare and in doing so while we were talking to the presenter. I told them that I would not give a limited power of attorney. They said nothing about it so I assumed they understood my position on that. We paid and signed to start the contract on Jan 8. Around the 1st of Feb they sent documents stating that I had to give them a limited power of attorney but I already told them I wouldn't do that when we negotiated the contract. I asked them to refund the retainer. They said that I had to agree to anything they said to end the contract. I told them they didn't disclose that before I signed the contract. Now they have refused to send back the retainer fee.  I have done research of the contract laws in Missouri and found that they are in violation of the procedures for executing a signed contract.  They did not disclose all the necessary information in the documents we signed so the contract is not valid.

***** does not seem to understand the difference in an LPOA and a POA.  We have tried to explain several different times that the LPOA only relates to his timeshare contract.  He is under the impression we can do something more with an LPOA other that what is outlined.   Although I was not at the seminar and can not attest to exactly what my representatives said I do know that they all know that an LPOA is required in order for anyone to preform this type of work for any person.  We are happy to complete the process and terminate his contracts.   He simply needs to return both the requested and required documents.   His misinformation does not constitute a breach in contact nor an omission of information.

      Customer response

      04/19/2023

I do understand the difference between an LPOA and a POA.  I would not give anyone the Power, limited or not, to unconditionally negotiate a binding agreement, unless I had complete trust in them, to represent my best interests.  Nationwide Settlement Solutions clearly, in my opinion, only represents their interests.  Reading the contract carefully reveals this.  Instance #1: The contract cancellation fee 15% is very high considering it is to cover processing a credit card payment.  Instance #2: NSS states that I must agree to any agreement negotiated whether I think it is good for me or not. This is the possible result of an LPOA.  Instance #3: NSS comes to California conducts business and requires that all conditions be governed by Missouri law clearly not in me best interest. Instance #4: I looked up Missouri Supreme Court rulings regarding contract disclosures.  In Missouri Supreme Court ruling 4-1.8 it states that contracts must specifically disclose all terms not express terms of the contract with generalities.  The NSS contract does not specifically disclose terms of the contract. If NSS had disclosed the requirement for an LPOA when explaining the contract I would not have signed.  Concluding, in my opinion, that it is NSS who does not understand an LPOA.

Date of transaction was 12/30/2022. We paid $30.00 up front to attend a session explaining how to get out of our timeshare. While there, they use good solid information as to why Timeshare Companies are milking the customers of their money. After the hour presentation, in come individual representatives to talk you into investing thousands of dollars with them will get you out of your timeshare. They tell you it’s important to send them all documents related to said timeshare and then they will be in touch, after of course you pay them around $8000.00. They told us they, nationwide settlement solutions would take care of the timeshare exit process. Then about a month later, we hear from another company. This company is honest, hardworking and very knowledgeable about the exit process. In fact, you can avoid Nationwide altogether. Just go straight I these other companies who charge very little, and they work on your behalf to get you out of the timeshare money drain circle. No need to pay nationwide thousands of dollars at all! Beware, the Nationwide company is uses practices very similar to the timeshare people. They don’t tell you about this other company that does all the work, they lie saying it is all them getting you out, they swindle your money by making it seem like a great deal by lowering the original $10,000.00 fee so that you will sign that day. You can’t go home and think about it, you have to do it that day or the specials go away. Save your money and frustration. Just look for the companies who work directly with the times share companies on your behalf for a LOT less money. I talked with Nationwide today and they stated that their job is to follow up on everything this other company is doing. Really??? I am following up with that company. Your company should be more than ashamed of its business practices and should not be taking hard working folks little money. I agree to pay a small amount for their help. Just not $8,000.00!

Client did pay a refundable deposit to attend our seminar which she was refunded in cash upon arrival.  Copies of her signed acknowledgement that she received the $30 deposit can be provided if the client would like. We do offer a service and there is a fee involved with said service and this client agreed to the service and the fee.  Each situation and each resort is different therefore there is a fluctuation in the cost of our services. When this client called our affiliate she was told that it is possible to hire them directly however they do not market their services to individuals and rely on referrals from exit companies such as us. We do work hand in hand with each of our affiliates to ensure a timely and successful termination and we take great pride in our service and our near 100% success rate.  We do offer a 3 business day recission period so that clients can go home and think about their decision and if they so choose change their mind. I would like to point out that although it saddens us that she unhappy with the cost of service we are overjoyed that she is pleased with the service that is being provided to her.   We love hearing that the affiliate we have chosen for a particular case is doing a great job.

      Complaint: ********

I am rejecting this response because:

We knew and accepted the $30.00 charge and accepted the refund.  The problem is $8,000.00 in charges paid for services not received.  The only company doing the work of getting us out of our TimeShare is the third party company.  Nationwide Settlement Solutions did nothing except take an over excessive amount of money from us, which others did NOT have to pay, and then let the third party do all the work.  This is no more legitimate than the timeshare sell itself.  They talk people into "contracts" which are not really contracts, and then take absorbent amounts of money when they can.  I want to be the person that only paid $2500.00.  To say that each situation is different, therefore, there are different charges is absurd.  The process is the same, take clients money, then turn it all over to a third party to do all the rest of the work.  I want my money back to fall in line with the cheapest sale you have made.  That is what you deserve.  You can't just arbitrarily be charging people different amounts of money for the exact same service.  i am fairly certain that when I contact the Attorney General's office they will agree.  This is a total scam, anyone considering following this course of action to get out of a Timeshare should be warned.  Do not agree to any money paid to Nationwide Settlement Services, and instead locate the third party that they work with and just pay them a small fee and they do all the work.  Easy to work with third party who is honest and hard working on your behalf.  I cannot believe the law hasn't come down on this business, Nationwide Settlement Solutions yet.  I hope to change that.

      Sincerely,

      ******** ****

On November 22, 2019, my wife and I attendended a presentation by representatives of Nationwide. The presentation was about cancelling our timeshare ownership. It was said in the prsentation that if Nationwide did not get our timeshare cancelled within 180 days , our money would be refunded. I was surprised when in the spring of 2020, I received a request for 1200 dollars from Timeshares For Less for transfer of deeds court costs filing fees and miscellaneous. I sent the 1200 to them but did not understand why Nationwide was not doing the cancellation themself. Actually, Nationwide assigned Timeshares For Less to resedll the property. Now when I sent a sales contract to Westgate in May of this year, they exercised right of first refussal and requested all papers I had concerning the sale of theproperty including any third party contract. I complied with Westgates request. I didnt hear from Westgate until October I calle them and a person named ****** saidthey would accept the sale. I still didnt hear anything until I called again on the first part of November, at which time the representative said they sent papers in October but I never received them. To my surprise, I received right of refusal dated October 6 that Westgate is taking back the property themselves and to remit 4010 dollars. In summary I have asked Nationwide for a refund. Timeshares For Less said that I would not get a refund because they told me not to tell Westgate that I was working with a third party. Person called dawn told me this after I told them I sent requested papers to Westgate. I talked to a lady? called ******* today and she said that she talked to me in January 2020 and May 2020. I explicitly deny this. In closing I feel that Nationwide and Timeshares For Less are working underhanded inasking clients to lie to their timeshare company. I woul really like to see Nationwide barred from doing business in Texas.

We will not negotiate refunds nor complaints through the BBB unless the client has reached out to us in attempt to first resolve their issue.  We will reach out to the client directly to resolve this complaint.   I would like to point out that this complaint in its majority is not about Nationwide yet one of Nationwide's affiliates.   We pride ourselves on our customer service and our ability to advocate for our clients.   I can assure you that if this client had ever reached out to us with his concerns there would have been no need for a complaint to filed against either Nationwide or our affiliate.
