Hello! Just following up on things still not fixed from May of 2023. Since we still have not had a LICENSED roofer come to inspect why outside elements are entering my attic, I did my own inspection. Im a second grade teacher, not a roof inspector, but was quickly able to locate multiple areas of HUGE concern. In this video can you see my HAND sticking out my roof. That is a PROBLEM! If one place wasnt enough of a problem, there are multiple areas where my hand goes out my roof. Im beyond upset and disappointed and disgusted at the lack of craftsmanship and customer service through ******* **********************. I would not recommend anyone buying one of your homes. Every part of me wants ******* to purchase my home and get me out of this contract. The amount of issues we have had in one year are horrifying: a leak under my slab, garage door has broken at least 4 times, the house was not completed before closing, 5 windows leaked for months before you finally had all 5 windows replaced, a compressor already went out on my AC unit, my posts are splitting, Ive had 4 lifetime lights go out, I have holes and cracks in my concrete and sidewalks and yesterday my cabinet door fell on my head! This isnt even all of it. Every day we wonder what is going to go wrong and fall apart next! I am DONE! Either buy this house and get me out of contract with enough closing costs for my next purchase, fix this house with licensed contractors, or my lawyer will be in touch! I have stacks of printed emails going back to right after we closed, home inspection report with same issues noted, and walk thru papers signed. If we go with a lawyer, Ill be suing your pants off for all the stress this has caused in the last 17 months living here! You have until November 1st or my lawyer will be in touch. Early in the construction process, a framing inspection was done by the city and this house passed which means the inspector found no issues with the structural quality of the home. Then, once the home was completed,a final inspection was done by the DeSoto County Building Department for a Certificate of Occupancy to be received and the home to close. After these inspections, the homes structure and quality met or exceeded the required expectations of home construction. The buyer had a home inspection done and all required actions that needed to be addressed were corrected.
Regarding the roof, the home inspection report from May 18, 2023 noted that there was a gap between the decking and the trim due to no drip edge. According to the DeSoto County Building Department, no drip edge is required if gutters are installed, which they were as they are on all of our homes in every subdivision.
The new concerns included in the Statement of the Problem are cedar posts splitting and cracks in the concrete.
Unfortunately, due to weather elements and the make-up of concrete, splits and cracks are bound to happen. The cedar posts may have split where the wood has expanded and contracted, but ***** is an approved type of wood for use as posts for the outside a home, and the house remains structurally sound.
The same effect happens with concrete. Crack concerns were reported and inspected. Cracks in the concrete are not a hazard or a concern unless it is raised in such a way that it could cause someone harm, such as tripping. The cracks reported in May of 2024 do not affect the structural soundness of the house nor does it cause a safety risk.
For all of the concerns that were identified and reported by the owner during the one-year homebuilders warranty, a superintendent was sent to address the problem and repairs were made, as needed. We have met the expectations of DeSoto County Building Departments guidelines for home construction and followed through with our commitment to the one-year homebuilders warranty, which expired May 2024. This company installed a water heater unit that was recalled due to being so cheap and breaking but *********** did nothing for the homeowners. They also do not register any AC units under warranty that they installed leaving the homeowner with no way of fixing the horrible unit they put in the homeBusiness Response

We have no correspondence in our files regarding a hot water heater. Our buyers are given a list of subcontractors by trade to call when they have problems. We have contacted *********** who has never heard from ************** and has no knowledge of any hot water heaters being recalled. We also contacted our HVAC people. Our buyers do not have to register a unit because our HVAC people have records on all houses where they have installed a unit. On 6/292021 ************* did make a service call on **************** unit. His complaint was that the unit was not working properly. Per B & W the unit was filthy, and filters had not been changed. Homeowner must perform routine filter changes to preserve their warranty. **************** does offer extended warranties but that is the responsibility of the homeowner not us to register for that and pay any fees associated with it.

For the past year we have talked about an issue we are having with Skylake Construction about a hole underneath our driveway that could lead to cracking. We have sent multiple emails stating that it has finally cracked and now some of steel the reinforcements are showing through. ******* has come out multiple times to look at and now states this is not a tripping hazard and they will not cover it. Yet, 1 week before we moved in the home inspector came out and saw them digging a gigantic hole underneath the driveway because of a leak they found. The home inspector told me AND wrote it clearly in the home inspection report to *monitor this for cracks*. We have emails dating back to August and September of 2021 mentioning the huge hole STILL underneath my driveway. When they came and fixed our sidewalk on 8/8/2022 ************************************* started in an email on 8/4/2022 that. Your warranty submission for the sidewalk/driveway is scheduled for repair on Monday 8/8/2022. They only came and fixed the sidewalk while I saw MULTIPLE other houses in our subdivision getting their driveways repaired. This is an expensive fix that I do not feel I should have pay to get repaired as per the home inspection (I have written and photographic proof) there was a hole underneath my driveway at the time of the home inspection and there is STILL a hole, to this day, underneath my driveway. I expected this to be repaired on 8/8/22 when the sidewalk was repaired and this is NOT something Im going to pay to fix as this is a builders issue prior to us moving into the home.Business Response

I am rejecting this response because:
Our driveway was never inspected, nor repaired. Theres a big hole under our driveway that id imagine could collapse at any time. ******* has not sent anyone to fix it and this is getting exhausting. This issue is clearly stated in our private home inspection report that Ive sent them multiple times. We have been sending this request through their warranty page for the last year and a half. Finally on august 8 they said someone was gong to come and fix the sidewalk and driveway. Someone came and fixed the sidewalk but never touched our driveway. I was home, I also have outdoor cameras and they did nothing on our driveway. As I said, trick or treaters were nearly tripping with this gap in our driveway, that is a safety issue and certainly a problem that should of been handled as like I said our private inspector caught this. This should of been handled before we even closed on the house. No one has come and inspected our driveway nor repaired it.

I am rejecting this response because:You have the correct house this time but I am unsure what is being proven to me in these photos? Its my house and driveway, it by no means proves that any repairs/inspections were conducted.You just came and took pictures of my house. The home inspector caught this before closing which means this should of been fixed before we were given keys. It states that this would become a problem, it has become a problem, so it needs to be fixed by the home builder, not us. I have gone back and forth with ******* on this for nearly 2 years and I am getting exhausted. I wont be accepting any responses that include pictures of my driveway or saying the home inspection report was done before closing. Thats what you keep insisting, yet that makes no sense, this should of been repaired before we got our keys, thats why we paid $300 for a private inspection in the first place.

When I put the contract on the house I was unable to see anything other than a model house. I really liked the house. Once I close on the house and di my walk through I found that I had two backyards. This was because of a drainage ditch I was unable to see before hand. Running down the middle of my backyard was drainage ditch that comes from the top of the street down to my house. I was told there was nothing that could be done and I could not alter it in anyway. I was then told I could put in a French Drain. I was given the name of a landscaper who came out to give me an estimate. I was told a French Drain was not going to work. I needed a much larger drain pipe. I was given an estimate of $8,000 to $10,000 to this fix this. I am on a fixed income! who in their right mind is going to pay that kind of money when the builder should have fixed the problem to begin with. SLC refuses to even talk to me about this.I also had a chunk of my driveway taken out. One of the workers found it and told me it would be repaired. After several months they finally came out and repaired the driveway. They cut out a rectangular area and poured concrete. What they did doesn't even match my driveway. They sent someone out to look at it. He suggested to SLC that they reseal the entire driveway and then it would all look the same color. They refused to do even that. So now I'm stuck with a driveway that is a pinkish color with a huge white rectangular area that stands out like a sore thumb! This company is horrendous. I have talked to other residents out here that have been denied repairs that were covered under warranty!Business Response

There is a drainage swale in the yard that carries water away from the house. As long as the water is carried away within 48 hours the swale is doing what it was designed to do. The drainage plan for this subdivision was designed by a reputable engineer and approved by all governmental agencies. The city inspector checks the drainage before issuing a certificate of occupancy. This homeowner has informed us that when it rains the water is carried away within 45 minutes.
The superintendent has resealed the driveway twice. The homeowner told our superintendent that she was happy with the driveway.
