On November 1st I put 500 deposit down and was supposed to come back on the 15th to pay the rest to move in. The week of the 15th I had the money and called to see if it was fine if I came in that day to pay. They ask me my name and what apartment. The apartment i had my deposit on was already leased. I was 18 years old and didnt know much. I also told the lady that gave me my receipt. I never knew the deposit was unrefundable. They said someone called and said they wanted the deposit back. I found out who it was because i had no clue. The lady also says it was me that called and said she told whoever that the deposit is non refundable and that if we wait a week after the 15th we could move in then if we didnt have all the money. The property manager said the person that was supposedly me at first said okay . It was never me that called. They had no proof that it was me other than my number. Which my step sister used my other phone. I only got a receipt that i paid down on that certain apartment. They leased already. They should have gave me the apartment or my money back. I also ask could i get another since the one my deposit on was leased already. I never signed any papers or knew the deposit was non refundable. I have called and explain but they hung up in my face after i ask about it. I am feeling like they are only doing it because i am young and african American.

The client paid a $500.00 deposit to hold her unit, which would have become a refundable deposit upon move-in. However, she provided multiple reasons for not moving in, including a death in the family. In response, we extended the hold on the unit for an additional week as a courtesy.
The attached phone call confirms that she was informed of her options: either move into the unit or forfeit the deposit. We did not rent the unit to someone else while keeping her deposit, as her complaint suggests.

I called the day i was supposed to move in Which was November 15, 2024. To come in to pay that said the unit has been leased. Please provide that call also. That wasnt my doing. Even in the voice call it says the person says “okay” at the end the person never once said they still did not want it after that info…

The unit was not leased to anyone else. We did however offer to move her move in date by 1 week to help her financial. She was also given the option to select a different unit that she could move into at a later date as well. The applicant called multiple times with multiple stories as to why she could not move in. She also claimed  other individuals called and it was not her. I personally spoke to her and gave her these options.

I called to bring the money. The apartment had been leased. Ayanna Finley answered and was the one who informed me that the apartment was leased. If all calls are recorded please found the call I made during the week of nov 15 when she told me it was leased and she was going to call me back. I never once got a call back and ask for my deposit or another apartment. They never mentioned getting me into another apartment that was and is a lie. This is the reason im doing all this. I WAS TOLD AND HAVE A WITNESS WHEN i was told the apartment in feemster lake was leased already. You never gave me a week or whatever . It was already leased .

    Timeline
    11-1- Paid Deposit
11-5 10:51 called how much she needs to pay to move in she wants to move in ASAP. Was told how much it would cost to move in on the 8th &  how much it would cost to move in on the 15th
11-8 Called to get deposit back  said she had a her mother call said. At this time she was offered to move her move in date back which she did not want. We use the deposit to hold the unit for a specific person and do not lease to anyone other person. She said she was not going to move in so we kept the deposit because we held the unit for her from 11/1-11/8 . Instead of leasing it to someone else.
11/15- She calls and says she wants to move in to that unit and at this time we had leased it to someone else. This is a whole week later after she said she didn’t want the unit.

If you would have told us on 11/8 that you still wanted the unit that you would be able to move on 11/15 then we would of waited like it was offered on the call. Instead you understood that you were forfeiting your deposit. Then you called a week later wanting the unit after it was already rented because you said you couldn't move in.
