    When Ms. ******** first reached out about her driveway we responded and the owner, Kostas, went and met with her husband.   At that meeting, Mr. ******** advised Kostas he wanted the gravel removed and requested we put seed and straw down to help the grass.  Mr. ******** also told Kostas that he wanted to “wait and see” about the driveway itself.  He would watch it and call Kostas if he wanted us to return and put concrete caulk in the cracks, to which Kostas agreed.   Kostas explained to Mr. ******** that we would be back to take care of it however we could not commit to a time and date as all the crews were currently at job sites and we would get this taken care of either between jobs or on a rainy day when they could not work at another site.   On a day that it had rained the night before, we called Ms. ******** and advised that we could be there shortly to get it done.   She was at work and agreed due to the fact that we were not sure when we would be able to get back there.   Kostas met the crew at her house and stayed with the crew the entire time they were working.   About 10 minutes before the crew was ready to put down the seed and straw, Ms. ******** called and asked that Kostas and crew wait because she was leaving work to come meet them at the house.  Kostas and the crew waited and when Ms. ******** got there, she inspected everything that had been done.  Once she approved the work, the crew began to lay the seed and straw, as promised.    This was all done on or around September 8, 2022. 

    On September 22, 2022, Ms. ******** reached back out requesting photos of the backyard hill.  Kostas advised that he did not take photos of that area because Ms. ******** had been onsite and approved the hill.  She stated the it actually looked better than before and thanked us for coming out and correcting the issue. 

    On September 23, 2022, we received correspondence from Ms. ******** wherein she made several assumptions, all of which are false.   These assumptions will be addressed as well.   Unfortunately, our response to this correspondence was not sent and ended being saved in the drafts folder (although Kostas thought he had sent it).    Due to the recent storm, we lost power and did not realize it was unsent until the following Monday (October 3rd).   In the email response to Ms. ********, we again offered to come back and do what she was asking, although this had already been done and approved by Ms. ******** previously.   I am not going to delve into the entirety of Ms. ******** complaint since, as I previously stated, I supervised the crew on site and made sure the work was done correctly.   Ms. ******** is correct in stating that there was still gravel remaining.  As she stated in the complaint the area was covered with poison ivy and I was not going to ask my employees to go in to the ivy.  I advised Ms. ******** in person that we could spray the area with round-up and come back again.     

    Ms. ******** also made the accusation that we did not pick up the gravel and only dumped more dirt on the area.   This is completely false.   Here is a statement of exactly what occurred at the time of cleanup.  The crew started raking all the rocks from the street in the front yard, and worked their way to the side yard and then the back yard area.  They started to use a metal rake and then they started putting the rocks etc. in the wheel barrow.  At that point the crew decided they were working twice as hard and not working smarter than harder so then they started putting all the rocks and sticks etc. inside black garbage bags so it would be easier to throw in the back of the truck and it be easier to separate the rocks and dirt from the NC 57 stone that was already in the back of the dump truck.  The crew then proceeded to clean all the area with metal rakes scraping the ground and getting all the rocks up etc. and leaving behind clean and bare dirt to plant new grass seed on.  At this point, my office manager called me and said that Ms. ******** was on her way from work and that wanted inspect the area and approve everything before we put out new seed, fertilizer and wheat straw.  When Ms. ******** arrived, the crew was sitting on a bale of wheat straw waiting for her the approval before they started putting out the new seed, fertilizer and wheat straw.  Mrs. ******** and I walked to the back Ms. ******** stated that she would like the back a little cleaner if possible.  I then told Ms. ******** that it was no problem but the area is covered in poison ivy and if she would like we would come back and spray the area with Round up to kill the poison ivy.  After it died, I would send the guys back out there to clean that area on the hill in the woods to Ms. ******** satisfaction.  Ms. ******** then stated “No I am not trying to be hard to get along with and that it would be good enough.”  Ms. ******** and I then walked up the side yard and up to the front yard area and checked everything out.  Ms. ******** said that the area looked much better and that she appreciated that we came and got the area cleaned up.  She then also thanked me for being a man of my word with two of my employees standing next to us.  She then gave my two employees the green light to put out the new seed, fertilizer and wheat straw.  I then asked Ms. ******** is she wanted me to send you before and after’s pictures and was told “NO” because she had already seen it and approved it.  During the time spent at Ms. ******** house, I took several pictures all of which have been sent to Ms. ******** as proof of what occurred.  I additionally sent Ms. ******** a picture of herself assessing the area in question moments before she gave the approval. 

    I have again told Ms. ******** via email on October 3, 2022, that we would come back again to get it worked out.  To date, we have not had a response from Ms. ******** and the issue remains.
