      1. I made a paid reservation for June 4-18, 2022 with Midgett Realty and notified them the morning of June 11 that we'd vacate the property next morning, returning home for health reasons. Midgett confirmed in writing and verbally that best efforts would be made immediately to re-rent the property and provide refund. Midgett's website also states their policy to re-rent and refund. 2. We vacated the property at 9 AM on June 12, following thorough cleaning of the property. 3. During following days in numerous messages, I told ******* that their website was NOT permitting reservation requests for the property for the week we vacated. Finally, Midgett described a "website IT error." On June 14 the property finally became available. 4. Due to Midgett's error, the website permitted reservation requests only for a portion of June 14 for a reservation period limited to June 15-18 given a 3 day minimum stay. In other words, despite the fact that I notified Midgett on the morning of June 11 and they were obligated to have the property listed shortly thereafter, Midgett made the property available only for a few hours on June 14. 5. W/ very high demand and very low supply of properties during high season, the likelihood of re-renting the property was virtually certain if Midgett had promptly listed the property. Given their severe handicapping, however, it was not. 6. The outcome of a 6 day refund is appropriate due to Midgett's failure. I've asserted a modest claim for a minimum of 3 days refund because I shouldn't be bearing the expense of 6 days while Midgett failed, day after day, despite my appeals, to make the property available. This is ill-gotten gain by Midgett and failure to redress at least partially their sole failure is blatantly unethical. 7. If Midgett disputes these facts, I can provide the message exchanges between me and them that validate the truth of each statement. 8. I've appealed civilly to Midgett with this claim. They don't reply.
